Hopefully the visit will be able to assist both of us in finalizing any remaining items of information that may need to be submitted in order to declare the above application technically complete and allow the owners to obtain final approval and the ability to record an amended plat. In addition I believe the visit will allow you to confirm that there are no outstanding site constraints that would affect the adjustments to any lot lines or the intended use of the property. (attached). As we discussed, I am including additional materials/exhibits requested in your letter and providing narrative explanation of any outstanding issues and their resolution from a planning perspective. For completeness, I am including a complete copy of the remainder of the application for your easy review. Please let me know if you need additional copies and I will supply them. Responses to the items you outlined are provided below: 1. Assessor's Mapping. I am providing a copy of the County Assessor's parcel Maps and have identified property owners so that you may cross-reference this with the list of property owners that I have provided within 200 feet of the subject property. Because of the varying lot sizes and the fact that the subject is located on the southern boundary of Parcel Map # 2393-284, I have had to include multiple copies of portions of the appropriate parcel map(s). All owners' within 200 ft. have been identified and confirmed. Of course, they will be updated prior to any notice being mailed as per code requirements. 2. Vicinity Map. A separate vicinity amp has been provided. 3a. Improvements and non -conforming situations. No improvements are affected by the lot line adjustments. Hazards. No hazards identified in Article VII, Division 2 of the ULUR are affected by the lot line adjustments. The physical constraints identified on the subject property are floodplain and high groundwater. The existing structure on Lot B is located approximately 20 feet higher in elevation than the exiting floodplain. The building envelope for the vacant Lot (Lot C) is also located on the same shelf well above the floodplain and high water table. The existing house on Lot A is located more than 200 feet from the river's edge and is not located within the floodplain or the high ground water areas as noted on the County GIS Maps. 3c. Topography. The building envelope areas for Lots 2 and 3 are located on the previously discussed shelf approximately 20 feet above the floodplain. While the house on Lot A is located on the lower level compared to Lots B and C, it is located out of the constraint areas. Topography does not affect the proposed lot line adjustments or any proposed uses (single-family detached residential) on the subject property. 3d. Technical Studies. Mark Chain Consulting and High country Engineering have analyzed the subject site, the proposed uses and the site constraints. Environmental constraints have been noted on the Site Improvement and Constraints Map and described in various locations within the application documents. We are aware of no other constraints that would have an affect on the land use application. We would request that the Planning Director waive any requirements for any further technical study based on the existing approval, existing and proposed land use and the nature of the lot line adjustment. 4. Well Permit Information. Copies of the Well Permits are attached. Please note that the original well on Lot A was recently replaced and a new well permit was obtained and work completed and approved. The original well permit obtained for Lot C was actually dug on Lot B. That well permit has been properly permitted to the current owners on Lot B (Bazley) and a new well permit obtained for Lot C. This well was dug and tested, but is currently not physically used as there is no structure on Lot C. However, that well was tested and is suitable for production and beneficial use. The other two lots have private service lines from their wells and these lines do not cross any existing or proposed lot lines. They are operational and in good condition. 5. Lien Holder Documentation. HCE has put the appropriate Iienholder consent certificates on the plat. One lineholder has consented to the Lot Line Adjustment, while the other Iienholder stated they will not approve any adjustment until the Cointy has indicated approval of the application. We will of course modify any Iienholder consent language per County attorney fdirection. 6. Application Form Signatures. The application is consistent with past preapplication meetings and has been reviewed to determine if the submittal materials are complete. That review included input from the County Attorney's office. Staff has identified several items that need to be addressed prior to a determination of technical completeness. A statement regarding topography of the property and any impact topography of the property might have on the lot line adjustment. d. A general statement requesting that the Director waive requirements for technical studies based on the existing approvals and nature of the lot line adjustment. 4. Copies of the well permits for each lot should be provided in addition to the summary printouts from the Colorado Division of Water Resources that have been provided. Your narrative statement should also include a general description of the wells, private service line locations and condition, including the suitability for production and beneficial use of the well on Lot C. 5. Compliance with additional input from the County Attorney's Office which may include additional lien holder documentation. 6. An updated application form reflecting current signatures by the Applicant should be provided. Once the above information/topics are adequately addressed or resolved we can finalize our completeness review and schedule a date for the Director Determination for the Application. Also, once determined to be complete, the adjacent owner notification is required as well as referrals to the County Surveyor. Please note that the Garfield County Unified Land Use Resolution of 2008, as amended requires that these technical completeness issues be resolved within 60 -days of the date of this letter, otherwise the application will be deemed withdrawn unless a request for extension is submitted and approved. As the completeness items are relatively minor we look forward to being able to schedule your application and move forward with the development review process in the very near future. As you may remember, we had a supplemental pre - application conference on this project on November 15, 2010. An updated copy of the pre -application summary is attached. At our November 15 meeting we discussed a number of issues on why the application was considered not technically complete. I believe I have remedied all of these items. I have included the following: • A signed authorization form from all of the owners of the property dated November 1, 2010. Barbara Snobble has been added as a signatory. • A copy of Well Permit information from the Colorado Division of Water Resources for all three of the Tots. • Three updated copies of the Site Improvement and Constraints map as well as the Exemption Plat. • Reference to a previously recorded plat recorded in 2004 has been eliminated from Plat Note No. 8. • An updated Title Commitment which is contained in Attachment B. On some other matters, at our November 15 meeting you requested that the legal description for the original "Fathering" parcel be included on the plat. High Country Engineering and I have not been able to find the original legal description for the 9+ acre Fathering parcel. All legal descriptions reference the three tracts into which the original parcel was divided. I have updated the adjacent property owner map in Attachment F. I also made an effort at researching any mineral rights owners for the subject parcel. I could not find any. I have included the "active" mineral rights owners for that section of land in Garfield County. Please note that this research was done on my own and was not done by a title company or title examiner. Four (4) Lots or Less: The Administrative Review Process, detailed in Section 4- 104 of Article IV, shall be used for review of a request to amend an Exemption Plat for modifying lot lines, building envelopes, easement locations or other interests affecting up to four (4) lots. An Amended Exemption Plat which modifies lot lines or easements affecting not more than two (2) adjacent Exemption Lots or a single building envelope shall be subject to the Administrative Review Process set forth in Section 4-104 of Article IV, with the addition of presentation of the Amended Exemption Plat to the Board of County Commissioners for signature, prior to recording with the Office of the Clerk and Recorder. 2. (Signature of Property;bwn (; �l• 1)2 6 .7(((07 Date SNOBBLE EXEMPTION AMENDMENT PROJECT LOCATION The Snobble Exemption is located along CR 109 at 5970 and 5966 CR 109 in Garfield County. The exemption is composed of 3 lots or tracts and was 9.43 acres in size at the time of Exemption Approval in 1981. The subject property is located on the east and north sides of CR 109 and lies immediately adjacent (east) to the Midland Point Subdivision. REASON FOR REQUEST OF EXEMPTION AMENDMENT The reason for the exemption request is three fold. First, the original exemption had questionable access, with all three lots coming to a single point along CR 109. The proposed legal descriptions for the tracts resolve this access issue. Second, the family members wish to adjust the lot lines in order to accommodate wishes of the family members. Specifically, some of the lot area for Tract 2 along the riverfront is used by the original owner of the property and it includes a memorial site for the husband/father, and the family wishes that site to be on the same tract as the original family house (Tract 1). Third, family members wish to realign the tracts/lots as proposed, and they wish to do it now while Ms. Barbara Snobble is still in reasonable health. RELEVANT BACKGROUND AND HISTORY Jack (John) and Barbara Snobble submitted an application for an Exemption from the terms "subdivision" and "subdivided land" for a 9.43 acre tract in 1981. That application was approved by virtue of adoption of Resolution No. 81-298 and the resolution was recorded on October 7, 1981 at Reception No. 320026. No plat was recorded with the Exemption documents. Tracts (AKA lots) were established set by legal description. A copy of the resolution is attached (Exhibit A) One house existed at the time of the original exemption application. This house was located on Tract A. This house has an associated well and ISDS. A single- family residence was built on Tract B on or about 1996. That home has a well (shown on plat) and ISDS located on Tract B. Tract C is vacant, though a well has been provided for future use. The next action related to the property involved the reconstruction and realignment of County Road 109 in the late 1990's. The Garfield County BOCC adopted resolution no. 99-051 on May 10, 1999 which vacated a portion of public road right-of-way and accepted an easement deed as new public road Snobble Exemption Amendment Page 1 of 4 March 2010 right-of-way from James and Connie Bazley ( Recorded at Reception No. 545312). A related easement deed was recorded at Reception No. 545313. Finally, a Snobble Lot line Adjustment Plat was recorded at Reception No. 659044 on August 31, 2004. The purpose of this amended plat was to adjust the lot lines per wishes of the family as noted above. However, this plat was not reviewed nor approved by the County prior to the recordation and the required Affidavit was not included on the plat. We therefore look at this plat as invalid not affecting the original Exemption. APPLICATION MATERIALS The appropriate application materials have been submitted. Below is a quick summary and comment if appropriate: 1. Application materials and fees. Included with application. 2. Vicinity Map. A vicinity map is included on the Exemption Plat. 3. Site Plan. The Exemption Plat effectively functions as a Site Plan. It includes building footprint, location of wells, overhead utility lines, and other relevant features such as a pond, etc. 4. Names and mailing addresses of owners of record within 200 feet of subject property. A search of the Garfield County records was made to establish whether there was an active record of a mineral rights owner for the subject property. Their appears to be a mineral rights owner of record for land on the other side of the Crystal River (surface property is now Colorado Rocky Mountain School). As land ownership patterns have changed substantially over the decades and we are unsure if subsequent sales were properly tracked, we are including this mineral rights owner with the names and addresses of property owners within 200 feet of the subject property. CRITERIA FOR AMENDED EXEMPTION PLAT The criteria for submission of an Amended Exemption Plat are contained in Section 5-306 of the Garfield County Unified Land Use Resolution. We will address these criteria on a point by point basis. • The Amendment does not increase the number of Exemption Lots. Response: The application does not increase the number of lots. Three lots were approved and three are proposed on the new plat. The sole reason for the Snobble Exemption Amendment Page 2 of 4 March 2010 application is to change the lot line boundaries and the sizes of the lots themselves. • The amendment does not result in a major relocation of a road or add one or more new roads. Response: No new road(s) is being created. • The amendment is sought to correct technical errors such as surveying or drafting errors. Response: NA Miscellaneous Please note that a plat has been placed on the draft Exemption Plat which vacates the plat for the property that was recorded in 2004. There is an over head utility line on Tract B that comes off of a utility pole located on Tract A. An appropriate easement will be placed on the plat. SUMMARY The Snobble Exemption was approved by the Garfield BOCC in 1981 and met the land use code requirements in place at that time. Family members still own al of the parcels.
