Re: Carpenter Martin Exemption Public Meeting
Dear Mr. Stuver:
As you are aware, yesterday the Board of County Commissioners moved to conditionally
approve the Carpenter/Martin request for an Exemption from the Rules of Subdivision. The
conditions placed on the approval are as follows:
1. That all representations of the applicant, either within the application or stated at the
meeting before the Board of County Commissioners, shall be considered conditions
of approval;
A Final Exemption Plat shall be submitted, indicating the legal description of the
property, dimension and area of the proposed lots, 25 ft. wide access to a public right-
of-way, and any proposed easements for setbacks, drainage, irrigation, access or
utilities;
3. That the applicant shall have 120 days (until 5/7/02) to present a plat to the
Commissioners for signature from the date of conditional approval of the exemption;
4. That the applicant shall submit the applicable School Site Acquisition Fees for the
creation of the exemption parcels prior to approval of the exemption plat;
5. That the 1978 Garfield County Zoning Resolution and the Colorado Department of
Health standards shall be complied with.
6. All recommendations made by the Grand Valley Fire Protection District
(GVFPD), in their letter dated 12/14/01, shall be followed for existing and
proposed residences: A storage tank at least 2,500 gallons in size must be
provided for residences 3,500 square feet or less, with sprinkler systems optional;
Residences larger than 3,500 sq. ft. must provide both adequate storage and a
sprinkler system; Access/egress and defensible space shall meet the CSFS NFPA
299 standard; Sprinkler systems shall adhere to NFPA 13D and shall be approved
by the GVFPD and supplied from cistern; However, the applicant shall either
provide the fire protection cisterns as part of the domestic water delivery system,
or shall provide a separate system.

7. Only one additional access to the parcels from County Road 303 shall be provided
and an access permit shall be obtained from the Road and Bridge Department for the
access. The access shall be maintained adequately to accommodate the weights and
turning radius' of emergency apparatus to permit access during adverse weather
conditions. A thirty (30') foot right-of-way from the centerline of the road along the
entire northern boundary of the property shall be dedicated to the County, and
improvements to the roadway shall trigger the property owner's moving or removal
of the fences in order to be consistent with the right-of-way boundaries.
8. Prior to the signing of a plat, all physical water supplies shall demonstrate the
following:
a) That a four (4) hour pump test be performed on the well to be used;
b) A well completion report demonstrating the depth of the well, the characteristics
of the aquifer and the static water level;
c) The results of the four (4) hour pump test indicating the pumping rate in gallons
per minute and information showing drawdown and recharge;
d) A written opinion of the person conducting the well test that the well
e) should be adequate to supply water to the number of proposed lots;
f) An assumption of an average of no less than 3.5 people per dwelling unit, using
100 gallons of water per person, per day;
g) If the well is to be shared, a legal, well sharing declaration which discusses all
easements and costs associated with the operation and maintenance of the system
and who will be responsible for paying these costs and how assessments will be
made for these costs;
h) The water quality be tested by an independent testing laboratory and meet State
guidelines concerning bacteria and nitrates.
9. A disclosure to all potential lot owners regarding the potential for mineral exploration
and recovery must be included in the covenants, plat notes, and at the time of closing,
in the event that the mineral rights have been severed.
10. That the following plat notes shall appear on the Final Exemption Plat:
"One (1) dog will be allowed for each residential unit and the dog shall be required to
be confined within the owners property boundaries."
"No open hearth solid -fuel fireplaces will be allowed anywhere within an exemption.
One (1) new solid -fuel burning stove as defied by C.R.S. 25-7-401, et. sew., and the
regulations promulgated thereunder, will be allowed in any dwelling unit. All
dwelling units will be allowed an unrestricted number of natural gas burning stoves
and appliances".

"All exterior lighting will be the minimum amount necessary and all exterior lighting
will be directed inward, towards the interior of the subdivision, except that provisions
may be made to allow for safety lighting that goes beyond the property boundaries".
"Only one further division of the 80 acre parent parcel (the NE 1/4 NW 1/4 and the NW
1/4 NE Y4 of Section 20, Township 7 South, Range 95 West of the 6th Principle
Meridian) by exemption from the rules of Subdivision is possible under the current
regulations."
"Any new buildings shall avoid areas of natural drainage. Natural drainages shall
be preserved to the maximum extent possible."

"Colorado is a "Right -to -Farm" State pursuant to C.R.S. 35-3-101, et seq.
Landowners, residents and visitors must be prepared to accept the activities, sights,
sounds and smells of Garfield County's agricultural operations as a normal and
necessary aspect of living in a County with a strong rural character and a healthy
ranching sector. All must be prepared to encounter noises, odor, lights, mud, dust,
smoke chemicals, machinery on public roads, livestock on public roads, storage and
disposal of manure, and the application by spraying or otherwise of chemical
fertilizers, soil amendments, herbicides, and pesticides, any one or more of which
may naturally occur as a part of a legal and non -negligent agricultural operations."
"All owners of land, whether ranch or residence, have obligations under State law
and County regulations with regard to the maintenance of fences and irrigation
ditches, controlling weeds, keeping livestock and pets under control, using
property in accordance with zoning, and other aspects of using and maintaining
property. Residents and landowners are encouraged to learn about these rights
and responsibilities and act as good neighbors and citizens of the County. A good
introductory source for such information is "A Guide to Rural Living & Small
Scale Agriculture" put out by the Colorado State University Extension Office in
Garfield County."
Once these conditions have been met, the exemption process may be finalized. Please do not

Submitted herewith please find the following:
1. Check no. 027720 for school site acquisition fee in the amount of $200.00 for the additional
parcel created by this exemption.
2. Colorado Division of Water Resources Permit No. 95280, amended October 25, 2001, to
provide for use inside up to three single-family dwellings.
3. Copy of Water Bacteriology Report for the Martin well dated March 20, 2001.
4. Samuelson Pump Company, Inc. report dated February 8, 2002.
5. Water Well Community Sharing and Maintenance Agreement executed by the applicants,
with check no. 027721 for $20.00 payable to the Clerk and Recorder of Garfield County
appended for recording it.
6. Right -of -Way Deed to the Garfield County Commissioners with check no. 027722 for $5.00
payable to the Clerk and Recorder of Garfield County appended to it for recording.
A copy of the final exemption plat has been submitted to the County Surveyor for final review and
the mylars will be submitted to you under separate cover.

This is in response to your letter of August 14, 2001.
Submitted herewith you will find copies of two deeds which were executed by me as the Personal
Representative for the Estate of Elnora Della Martin. One Deed conveys the NE'/4NW'/4 of Section
20 to the Applicants, and the other conveys the NW'/4NE'/4 of Section 20 to Marl Martin and Mickey
Martin, the other heirs of the decedent. Please note that these deeds were recorded in October of
2000. The Carpenter/Martin Application is for exemption of subdivision into two 20 acre tracts.
The other 40 acres can not be divided without exemption.
Also submitted herewith you will find a copy of the State of Colorado Well Permit No. 95280 now
containing the endorsement "Note: Conditions are amended to allow for use inside up to 3 single
family dwellings. JSG 10/25/01."

Re: Plat review of the Carpenter/Martin Subdivision Exemption.
Dear Mark;
I have reviewed the above referenced subdivision plat and note the following comments or
corrections to be made to this plat prior to approval for survey content and form:
1. All controlling monumentation needs to be referenced on the plat with a description
of the monument found or used to control the location of the boundary of this parcel.
2. Individual lots descriptions need to appear on the plat.
S. Is the area calculation for each lot including the Road Right of Way? Is this Right of
Way being depicted as an easement or in fee simple to the County?
4. The County Surveyor Certificate does not require the "filing information" as shown
since this plat will ultimately be recorded and not deposited.
5. A specific Basis of Bearings statement needs to appear on the plat. This statement
according to the bylaws of the State Board of Registration must include the bearing
used and a description of the controlling monumentation or be described fully on the
plat map itself.
6. The line type between the lot lines should be a continuous line.
7. Are there any Mortgage's or Mineral Owners who should be noted on the Plat?

I have reviewed the Carpenter/Martin Exemption as requested and offer the following:
The options available to the applicant include either a local water supply for each
residence or a central pressurized water supply for all residence as well as fire protection
sprinklers. Because of the size of your project, it would appear that the localized water
supply systems (NFPA 1231) and fire protection sprinkles might be better suited to
provide such protection.
The use of sprinklers in new construction is always encouraged, and has proved to be both
cost effective and to have made the critical difference :n the "saving of a structure". The
key element of a 13D system is to provide enough suppressant to get the occupants out of
the residence. The system is designed to provide a 10 -minute water supply. In a normal
urban setting, with prompt notification to the fire department, a response and
extinguishment can be started during this 10 -minute time frame. However, with a small
volunteer fire department, which does not staff fire station crews, response times can be
much longer. Hence, it is hoped the sprinklers provided enough time for the occupants to
leave, but the fire has most likely continued to burn, and after the 10 -minute period of
water delivery, the fire may again start actively burning. Fire sprinklers are not required in
structures less than 3500 square feet, however we encourage homeowners to consider
their value and the benefits that they may provide in the event of an actual fire.
The recommendations of NFPA 1231 are to have a water supply located within 150 feet
of a residence, a 4 V2" hydrant connection capable of providing 500 gpm and a capacity to
be determined by the square footage of the residence, After consulting other fire agencies
within Garfield County, a minimum size of 2500 gallon tank per lot is a reasonable
requirement for residence under 3500 square feet. Sprinkler systems would be optional
for residence up to 3500 square feet. Residences over 3500 square feet will need to have

both the calculated size storage tank and a sprinkler system to provide initial knockdown
capabilities. As far as access / egress requirements & defensible space, the Colorado State
Forest Service has recommended using the NFPA 299 standard, Protection of Life and
Property from Wildfire. The Grand Valley Fire Protection District, as well as the other
fire districts within Garfield County, has adopted this as the standard within it's
boundaries.
Other issues to be included and noted in the proposal are as follows:
• If a sprinkler system is installed, the requirements for NFPA 13D will be adhered
to. A minimum flow of 26 gpm with a duration of ten minutes or 260 gallons (see
Section 2-1) are required. The storage tank used for fire protection will be
separate from that used for domestic use. If a homeowner wishes to combine the
water supply for both the sprinkler system and domestic use, the requirements of
the code shall be met. Annual inspection / maintenance and reporting requirements
of a sprinkler system are the responsibility of the homeowner. For structures over
3500 square feet, an approved fire protection sprinkler system will be required.
The sprinkler system is to be supplied from the firewater cistern (for those
structures 3500 square feet or greater).
• An agreement to use the water stored in a. fire water cistern, in the event of an
emergency, is not limited to the specific residence where it is located and that its
use/need is at the discretion of the fire department.
✓ The water supply (fire water cistern) is for fire protection only, not to be used for
domestic use.
If the above conditions are met and made apart of your building application and plat notes,
the Grand Valley Fire Protection District has no further concerns regarding this project.

The purpose of this letter is to inform you that your clients' request for an exemption from the rules
of subdivision has been scheduled for a public meeting before the Board of County Commissioners.
The public meeting will occur at 1:15 p.m., on Monday, January 7, 2002, in the Garfield County
Courthouse, Commissioners Hearing Room, Suite 301, 109 8th St., Glenwood Springs. The
applicant shall be solely responsible for the publication, posting and mailing of all notices and shall
present proof of publication and mailing at or before the meeting. Notice for the meeting shall be
given as follows:
(1) Notice by publication, including the name of the applicant, description of the subject lot, a
description of the proposed exemption and nature of the meeting, and the date, time and
place for the hearing shall be given once in a newspaper of general circulation in that portion
of the County in which the subject property is located at least thirty (30) but not more than
sixty (60) days prior to the date of such meeting, and proof of publication shall be presented
at hearing by the applicant.
(2) Notice by mail, containing information as described under paragraph (1) above, shall be
mailed to all owners of record as shown in the County Assessor's Office of lots within two
hundred feet (200') of the subject lot and to all owners of mineral interest in the subject
property at least thirty (30) but not more than sixty (60) days prior to such meeting time by
certified return receipt mail, and receipts shall be presented at the meeting by the applicant.

The site shall be posted such that the notice is clearly and conspicuously visible from a
public right-of-way, with notice signs provided by the Planning Department. The posting
must take place at least thirty (30) but not more than sixty (60) days prior to the hearing date

to the Board of County Commissioners, Garfield County, State of Colorado, for a subdivision
exemption in connection with the following described property situated in the County of
