HEFAS, John T''. Carter and Tessie F. Carter have petitioned the Board of
County Commissioners of Garfield County, Colorado, for an eremrtion tinder
C.R.S. (1973) Section 30 -25 -101(10)(a) -(d) as amended, and the Subdivision
Regulations of Garfield County, Colorado, ado -ted September 1, 1972 and
amended April 111, 1975, Sections 1.02.17(d) and 3.02.01, for the division
of a 12.27 acre tract into two tracts, one tract of approximately 10 acres
more or less and the second tract aprrcimately 2.27 acres more or less,
and more particularly described as Follows:
A tract of land situated in Lots 11 and 12 of section 35 all in Township 7
South, Range 89 West of the 6th Princi^al !'eridiar., lying Northerly of a
county road as constructed and in place, described as fullers:
Beginning at a point whence the Witness Point to the South Quarter Corner
of said Section 35 bears S. 10`21'56" F. 1225.92 feet; thence S. 80`'C0'DC" F.
597.71 feet; thence S. 36.23'15" E. 30.111 feet; thence S. 07'111'02" 'lc 2U7.4f;
feet to a point on the Northerly line of said road; thence N. 27`'2S'3I ` .
333.76 feet along the Nc'rtherly line of said road; thence S. 8017126" 77.
17.91 feet along the Northerly line of said. road; thence Y. 96-02'59" '?
152.84 feet along the Northerly line of said road; thence N. 00'34'12" E.
996.119 feet to the point of beginning.
"WHEREAS, the Petitioners have sho7n to the satisfaction of the Board of
County Commissioners of Ca^field County, Colorado, that they desire said
-eXemrtion for the purpose of re -sale into single family residential acreage,
and
WHEREAS, Petitioner has dsrnonstrat.ed to the satisfaction of the Board
that there is a reasonable probability of locating domestic ra' er on each of
said tracts. that there is adequate ingress and egress to said -tracts,
that the location of septic tanks will be permitted by the Colorado
Department of Fealth, that the requested division is in accordance with the
general purposes and intent of the subdivision regulations of the State of
Colorado and the County of Garfield and that said division rill actually
restrict the density of housing within said area and should therefore be
exempted from the definition of the teras "subdivision" and "subdivided land"
as set forth in C.R.S. (1973) Section 30 -28 -101(10)(a) -(d) as mended;
NOW THEREFORE, upon notion of , seconded. by

and unamiously carried said 12.27 acre tract of land is hereby exempted from
such definition anc: transfer of said tract may be made by division into Two
tracts, one tract of 10 acres, more or less and the other tract 2.27 acres,
more or less, all is more fully described in the petition pertaining hereto.
A cdpy of the instrument or instruments of conveyance when recorded shall be
filed with thi' Resolution.
