It does appear the new driveway is off of the ROW. As long as there is communication regarding the utilities, I feel save

Andy -
just spoke with Mr. Ulrych and he verified that he will NOT be grading a driveway and access road in the RFTA Railroad
Corridor. That his driveway and access road will be adjacent to his parcel and adjacent to the RFTA Railroad Corridor but
not located in the RFTA Railroad corridor.
His electric utility pull and road crossing to access his parcel will be the only encroachments into the RFTA Railroad
Corridor.
I've copied him in on this response so that he can clarify further if necessary.

Abbey Pascoe forwarded me your email and I wanted to get back to you regarding the license and the utilities for Mr.
Ulrych's license.

Mr. Ulrych has a license to use an existing crossing of the Railroad Corridor but not for the construction of a new access
road inside of the Railroad Corridor. It is my understanding that he will be upgrading an existing access road located
adjacent to his parcel and located outside of the RFTA Railroad Corridor. I've left Mr. Ulrych a message to call me back
on this so we can make sure we are on the same page.
As far as the utilities, Mr. Ulrych has provided me with a rough sketch of his plan for tying into the Holy Cross electric
pole and I will be getting back to him on Tuesday of next week to discuss further. Mr. Ulrych is required to do a utility
locate prior to any work being completed in the Railroad Corridor , it is a condition of his license agreement and this
includes any grading of the Railroad Crossing.

Abbey,
Thanks for sending the Access License for Andre Ulrych. Mr. Ulrych has applied for a grading permit to construct his
driveway to his future home. It appears the utilities for his home are also located on the railroad ROW from an existing
power pole. I do not see that utilities are part of the Access License but the source for his electricity is the existing pole.
Utilities are exempt from our grading permit, so we can issue the permit just for construction of the driveway. I will put
a condition on the permit to contact RFTA regarding any utility extensions into the ROW. It appears there are existing
fiber optic cables (Item 7 of License Agreement) somewhere in the ROW. Please call if you have any comments or
questions.
