Pursusant to C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as
amended, and the Subdivision Regulations of Garfield County, Colorado,
adopted April 23, 1934 Section 2:20.49, the undersigned

EASEMENTS
There is an easement for telephone and electrical utilities.
Said utility easement being 20 feet in width and comprising
the eastern most 20 feet of that portion of the SWaNE4 of
Section 23, Township 7 South, Range 88 West of the 6th P.M.,
conveyed to first parties herein by deed recorded in Book
464, Page 544, as document number 264829 of the Garfield
County Records commencing at the SE corner of said property
and running northerly to the NE corner of said property. No
other easements are proposed.
ACCESS TO PUBLIC HIGHWAY
Each of the proposed properties is bordered by a private
road and is maintained by owners of other parcels in the area
who use that road. This private road connects with County
Road 112. The proposed exempted property is approximately
one-half mile from County Road 112.

Gentlemen:
As requested, we observed the excavation at the subject site on
June 11, 1981 to deterrine the general subgrade conditions for foundation
support.
The building site is located within a gently rolling area covered
with grass, cedar and some evergreens. At the time of our site visit,
the excavation had been cut to design footing grade at approximate depth
1 to 4 feet below adjacent ground surface. Footings approximately 16
inches wide and 12 inches deep had been placed. The subsoils exposed in
the excevat.ion consisted cf a silty to clayey gravel with cobbles and
boulders to approximate maximum 3 foot size. The coarse material is
mainly basaltic rock. Gradation analysis performed on the :pinus 7 inch
size material is shown on Figure 1.
We understand the residence will consist of a single -story structure
and impose light foundation loadings typical of this type construction.
The subsoils have relatively high bearing capacity and low settlement
tendencies and should be suitable to support the 16 inch wide footings.
Continuous foundation walls should be adequately reinforced, top and
bottom, to redistribute loading in the event of some differential
movement. Any below grade crawl space level should be protected floin
wetting by an ndardrain system.

This report is based upon observation of the soils exposed in the
open excavation. In order to reveal the subsoil conditions below
foundation elevations, exploration would be required. It is possible
that the subsoils below those exposed in the open excavation may change
and may contradict the recomendations presented in this report.

Dear Webb,
As you requested, I would like to offer the following
comments to you regarding fire protection and ambulance
service to Bob and Terri Carter's proposed sub -division
exemption located at 0481 County Road 112. As I understand
it, the build out on the proposal is only two or three
single family houses.
Water supply for fire protection purposes will be supplied
by tanker trucks. The Carbondale Fire Department tanker trucks
carry a total of 5500 gallons of water with back-up tankers
as close as Redstone and Basalt. This is an adequete water
supply to control most single family house fires.
Access to the improved properties should be maintained year
round. The crossing of any culverts or small bridges by the
proposed access's should be avoided due to the 56,000 Lb
weight of the fire trucks.
It should be noted that the response time for fire trucks
and ambulances from the Carbondale Fire Station is approx-
imately 20 minutes, on good roads.

REQUEST FOR EXEMPTION
This exemption is requested by the Petitioner since the
properties were once divided by a private road serving other
properties in the area. A subdivision exemption allowing
the construction of an additional household in the area would
be compatible with the use of the land especially since the
continuity of the properties was once disturbed by that road,
and would not affect the rural nature of the area.

I.
HISTORY OF PARCEL OF LAND
A review of the history of this parcel relevant to this
request appears from the County Court records of Garfield County,
Colorado.
A. In May, 1967, O. Louis Wille bought the SW4NE4 of
Section 23, Township 7, Range 88 West of the 6th P.M. from
the Carbondale Land Development Corporation. (Book 385/Page 16)
B. On the 12th day of May, 1967, O. Louis Wille bought
the SW4NE4 of Section 23 from the Carbondale Land Development
Corporation. In that deed the Carbondale Land Development
Corporation reserved an easement 60 feet wide across and over
the property. It appears this easement divided this parcel
into two parcels.
C. In June, 1973, Molly Fulton, in a land trade with
Wille acquired the southwest quarter of the northeast quarter
(SW4NE4) of Section 23.
D. In September, 1974, Molly Fulton sold the property
which is owned by the Petitioner to Andrew and Priscilla Taylor.
E. On December 30, 19i4, the property to the north of
the Carter property was sold to Gale Spence by Molly Fulton.

F. Research of the Garfield County Commissioner's meetings
and records does not reveal any subdivision or subdivision exemp-
tion or Senate Bill 35 exemption was requested by Molly Fulton
on or after January 1, 1973.
G. It must, therefore, be presumed that the agreement
regarding the easement in 1967 between what is now the Carter
property and the Spence property effectively divided the
SW4NE4 of Section 23 into the parcels which exist today.
