Enclosed herewith is the legal description of the 0.78 acre
parcel of land located on County Road 154 belonging to Merle
N. Carver and Vivian T. Carver.
As I understand it an SB -35 exemption has been granted for this
land and the appropriate zoning variance has also been obtained.
Would you please furnish me a copy of the appropriate SB -35
resolution as soon as possible.

0.78 ACRE PARCEL OF LAND RFLONGING TO
MERLE N. CARVER AND VIVIAN T. CARVER
A parcel of land situated. in Lot 34 of Section 1,
Township 7 South, Range 89 West of the Sixth Prin-
cipal Meridian lying southerly of the southerly
line of County Road No. 154 (formerly State Highway
No. 82) and northerly of the southerly line of said
Lot 34, said parcel of land is described as .follows:
Beginning at a Brass Cap found in place and properly
marked for the Southeast corner of said Lot 34,
thence N. 89°51'00" W. 365.51 feet along the south-
erly line of said Lot; thence N. 1.5°57'00" E. 71.23
feet; thence N. 74°03'00"W. 13.00 feet along the
northerly side of a building as constructed and in
place to its intersection with a fence as construc-
ted and in place: thence N. 14°24'23" W. 70.73 feet
along said fence; thence N. 86°42'47" E. to a point
on the southerly line of said County Road No. 154;
thence S. 70°42'48" E. 174.00 feet along the south-
erly line of said County Road; thence S. 64°12'05"
E. 143.38 feet along the southerly line of said
County Road to the easterly line of said Lot 34;
thence S. 01°31'00" F. 24.35 feet along the east-
erly line of said Lot 34 to the point of beginning,

PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) Section 30-28-101 (10) (a) -(d) as amended, and
the Subdivision Regulations of Garfield County, Colorado, adopted September 1,
1972 and amended April 14, 1975, Section 1.02.17 (d) and 3.02.01 the under-
signed
respectfully petitions the Board of County Commissioners of Garfield County,
Colorado, to exempt by resolution the division of --} `7`4 acre tract of

of Lot 4, said Section, Township and Range, lying South of Colorado State Highway
No. 82 and North of the center line of the Roaring Fork River, and East of a line
described as beginning at a point North 7,0°59' West 636.02 feet from the northwest
corner of Lot 34, Section, Township and Range aforesaid, and running thence South
9°30' West, 150 feet, more or less, to the center line of the Roaring Fork River,
together with the 15 foot right-of-way from Colorado 82 to the lands described reserved
in that certain Warranty Deed to joint tenants of record in the office of the
Clerk and Recorder for Garfield County, Colorado, as Document No. 210906, and in
Book 329 at Page 543, together with any and all water and water rights, ditch and
ditch rights, used in connection with or appurtenant to the property described above.
There is excepted and reserved from the above and foregoing tract that tract of
land heretofore conveyed by instrument of record in the Office of the Clerk and
Recorder of Garfield County, Colorado, as Document No. 221170, in Book 348 at Page 450.

Patents for such lands, to the right of way for Colorado State Highway No. 82,
and to rights of was for ditches, telephone lines and power lines.
