SITE DATA: The site consists of approximately 171 acres. WATER: Proposed domestic well. E ER: I.S.D.S. ACCESS: Access directly off of County Road 214 EXISTING ZONING: A/R/RD ADJACENT ZONING: A/R/RD I. RELATIONSHIP TO THE COMPREHENSIVE PLAN The site is located in District C, Rural Areas with Minor Environmental Constraints as identified on the Garfield County Comprehensive Plan Management Districts' Map. II. DESCRIPTION OF THE PROPOSAL A. Site Description: The project site is located Inortheastlof the town of Silt, on County Road 214. The total parcel, approximately 171 acres in size, is split by the County right-of-way. (A vicinity map is attached as Exhibit 1, on page IP 3 • .) i) z g - B. Section 8:10 (Applicability - Exemptions) states that the Board has discretionary authority to except a division of land from the definition of a subdivision. Following a review of the facts of each application, the Board may approve conditionally or deny an exemption request. The Board may not grant ant.50r30v� ,„ exemption unless the applicant can demonstrate compliance with ?enu g, legal Fk.i-I""T'°NS access, adequate water and sewer, state environmental health standards, necessary road and drainage improvements, fire protection, adequate easements, and school impact fees. 2. Subdivision Regulations. Section 8:10 states that the Board may approve a total of four (4) lots, parcels, interests, or dwelling units, as that parcel was described in the records of the Garfield County Clerk and Recorders Office on January 1, 1973. (_ *ydyt 1,4 1°ls3 wovt,p = 9 Lors I �a, �rlax�w DANso�, 1.4 1,1%3- However, q%3However, any parcel to be divided by exemption that is split by a public right-of- way or natural feature, preventing joint use of the proposed tracts, and the division occurs along the public right-of-way, such parcels thereby created, may, at the discretion of the Board, not Ibe considered to have been created by exemption with regard to the four (4) lot, parcel, or dwelling unit limitation otherwise applicable. This does not preclude further subdivision via the full subdivision review process mandated by C.R.S. 30-28-133 and the County Subdivision Regulations. As indicated on the vicinity map, the subject parcel is divided by County Road 214. Lo -c Size MET 3. Legal Access. Legal access for both of the parcels is via County Road 214, which is a two-lane undivided roadway in good condition. The most recent traffic volumes collected along this segment of roadway indicatde an ADT of approximately 500 vehicles. Legal access is not an issue with the proposed exemption. 4. Adequate Water and Sewer. The 7.31 acre parcel, witi the applicants are intending on retaining, has an existing permitted well for stock. Based on conversations with The Division of Water Resources, a new application would be necessary to convert the well to domestic uses. The applicants are proposing to provide water to the additional parcel from a new domestic well. To the best of staff's knowledge, no formal well permit applications have been submitted to the Division of Water Resources. However, discussions and documentation with Dwight Whitehead indicate that no administrative or statutory barriers exist to prevent well permits from being obtained in the larger exemption parcel. As long as a parcel is 35 acres or more it would qualify for an Exempt Domestic Well Permit. Sewer service will be provided by I.S.D.S. Only Moderate solid limitations are indicated by the SCS soils information. A review of High Groundwater and Septic System Limitations mapping conducted by Lincoln-Devorelindicate no significant constraints to the use of I.S.D.S. on the site. \ (.Ae� 2 ��UC • • 5. State Environmental Health Standards. The proposed exemption is consistent with applicable State Environmental Health Standards. 6. Necessary Roadway and Drainage Improvements. No additional roadway improvements are necessary to provide adequate, safe access to both exemption parcels. Drainage may present isolated difficulties depending precise building locations. Slope Hazard mapping conducted by Lincoln Devore Testing Laboratory identified portions of the property as an area of moderate hazard, typical of areas in the County with debris fans and minor rockfall areas. Building sites in these areas may require detailed geologic investigation, engineering studies, test drilling, strength tests and stability analysis. Mitigation in these areas is usually possible, and carefully located building envelopes are recommended. (The relationship between the project site and the hazards mapping is shown on Exhibit 2 on page• 4, . .) 7. Fire Protection. Fire protection is provided by the New Castle -Silt Fire Protection District. L..E. t .Q. (egos5 TALP i ) IV. SUGGESTED FINDINGS 1. That proper posting and public notice was provided as required for the meeting before the Board of County Commissioners. 2. That the meeting before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. 3. That for the above stated and other reasons, the proposed exemption is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. V RECOMMENDATION APPROVAL, subject to the following conditions: 1. That all representations of the applicant, either within the application or stated at the meeting before the Board of County Commissioners, shall be considered conditions of approval. 2. That the applicant shall have 120 days complete the required conditions of approval. Extension of 120 days may be granted by the Board for a period of one (1) year. 3. The applicant shall submit $200.00 in School Impact Fees, prior to the signing of an exemption plat. 3 • • 4. A final Exemption Plat will be submitted, indicated the legal description of the property, dimension and area of all lots or separate interests to be created, access to a public right -a -way, and any proposed easements for drainage, irrigation, access or utilities. 5. The applicants shall demonstrate availability of domestic water by providing well permits prior to the approval of the Final Exemption Plat. 6. The following note shall be shown on the Exemption Plat: Certain building locations may be subject to slope hazards. All structures shall require the submittal of an engineering report addressing geological conditions, foundation design and drainage prepared by a registered professional engineer. 7. With Board Approval, this split not be considered to have been created by exemption with regard to the four (4) lot, parcel, interest or dwelling unit limitation otherwise applicable due to the public right-of-way. Per your letter dated July 23, 1992 I would like to state the following: 1) It appears this request should bc referred to our engineering branch in Denver. This would allow for 4 firm commitment on water supply for this exemption. Although I have a basic understanding of water supply for subdivision and exemptions, our engineering branch must review and comment on water supply plans. 2) Regarding the parent parcel creation date, as long as a parcel is 35 acres or more it would qualify for a Exempt Domestic Well Permit. If a parcel is less than 35 acres the applicant must show HOW and WHEN the parcel was created to see if they would qualify for a Exempt Household Use Only Well Permit. June 1, 19/2 is the operating date the Office of the State Engineer uses to determine if the pa.:cel. is Fre--1972 or Post --1972 when evaluating a well permit application on less than 35 acres. 3) A change in use for any existing well must be evaluated as a new application. To change the use of Permit No 21770 a permit application would have to be submitted for evaluation as a new well. It :eight be possible to change the use to a Exempt Household Use Only Well, although this proposal should be reviewed by our engineering and ground water sections. As noted above to qualify for a Exempt Domestic Well Permit an applicant must have 35 acres or more. I am enclosing some standard information regarding well permits (Exempt and Non -- Exempt) for your reference. I hope this information is helpful. Dear Dwight: Please find enclosed information related to a subdivision exemption request for a parcel of land in the Silt area. The applicants are proposing to split a 171 acre parcel into two (2) parcels of 163.94 and 7.31 acres each. Apparently, the parent parcel was created prior to January 1, 1973. Enclosed is a well permit (number 21770) for stock water, which would be converted to domestic use for the 7.31 acre parcel. The remaining parcel (171 acres) is proposed to be served by an additional well. Do you foresee any issues related to the applicants proposal regarding domestic water supply for either of these parcels? This matter has not been scheduled for consideration by the Board of County Commissioners, pending your comments regarding the possibility of obtaining domestic water supply for both of these parcels.
