BEFORE THE BOARD OF COUNTY COMMISSIONERS OF
GARFIELD COUNTY, COLORADO
PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) Section 30-28-101 (10) (a) -(d) as amended, and
the Subdivision Regulations of Garfield County, Colorado, adopted September 1,
1972 and amended April 14, 1975, Section 1.02.17 (d) and 3.02.01 the undersigned
Leo Swartzendruber, agent for Runar & Sigrid Carlson respectfully
petitioners the Board of County Commissioners of Garfield County, Colorado, to
exempt by resolution the division of 361/2 acre tract of land into 2
tracts of approximately 21/2 acres and 34 acres each, more or less, and
which tract to be subdivided is more particularly described as follows:

6th P.M.
from the definitions of "subdivision" and "subdivided land" as the terms are used
and defined in C.R.S. (1973) Section 30-28-101 (a) -(d) and the Garfield County
Subdivision Regulations, for the reasons stated below:
Owners wish to sell approximately 34 acres and retain approximately 21/2 arrP site with
present improvements
In support of this petition, the petitioner also submits the following:
(a) Map drawn to scale showing proposed
lot subdivision and access
(b) Copy of deed
(c) Vicinity map
(d) State on source of domestic water
(e) Statement on method of sewage disposal
(f) 100 year floodplain information where
live stream crosses or adjoins said tract
(g) Fee in the amount of $ 86.00
(h) Evidence of the soil types

Dear Mr. Jolley:
I understand that in the presentation yesterday concerning the
request for a subdivision exemption on the Runar Carlson property a
statement was made that the property is not adjacent to the City of Rifle.
Before the resolution is prepared, I would like to request that the sub-
division be reconsidered because the Carlson property is adjacent to the
city limits on its northern boundary. Highlands East, a residential hous-
ing development which has been annexed to the city, is immediately to the
north of East 7th Street (County Road 294) which forms the northern boun-
dary of the Carlson property. It is because of the contiguous boundary
that I had recommended that the 2.50 acres of property which is being
served with municipal water annex to the city rather than sign a pre-
annexation agreement.
Pre -Annexation agreements are used by the City of Rifle in cases
where municipal water or sewer service is extended to property which is
not contiguous with the city limits and therefore cannot be annexed to the
city. As the Carlson property is already adjacent to the city limits, a
pre -annexation agreement would not he logical.
The County will very likely be receiving more and more similar
requests as Rifle grows in the next few years. It certainly seems that it
is in Rifle's interest to make decisions on subdivisions adjacent to the
city's corporate boundaries, especially any decisions where the provision
of municipal services are involved. Therefore, you might consider refer-
ring such requests for subdivisions to the City of Rifle. If you should

Dear Davis:
I am writing in response to your request concerning City
of Rifle water service to the Carlson residence located at 0680
-294 Road.
Rifle has served the residence with municipally treated
water for many years. As the owners are now requesting a sub-
division of the land in the county, Rifle's policy dictates that
the residence be annexed to the City of Rifle. The existing
residence would then continue to be served with city water at
the in town rate.
