(1973) Section 30-28-101 (10) (a) -(d) as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted September 1, 1972 and amended April 14, 1975, Section 1.02.17 (d) and 3.02.01 the undersigned Leo Swartzendruber, agent for Runar & Sigrid Carlson respectfully petitioners the Board of County Commissioners of Garfield County, Colorado, to exempt by resolution the division of 361/2 acre tract of land into 2 tracts of approximately 21/2 acres and 34 acres each, more or less, and which tract to be subdivided is more particularly described as follows: (legal description - attach separate sheet if additional space is required) the NW Corner of the SW4SW4 Section 10, Township 6 South4 Range 93 West cif the 6th P.M. from the definitions of "subdivision" and "subdivided land" as the terms are used and defined in C.R.S. PRIMMER argler 4 - Iran September 9, 1980 Mr. Richard Jolley 1288 - 245 Road New Castle, CO 81647 Dear Mr. Jolley: I understand that in the presentation yesterday concerning the request for a subdivision exemption on the Runar Carlson property a statement was made that the property is not adjacent to the City of Rifle. Before the resolution is prepared, I would like to request that the sub- division be reconsidered because the Carlson property is adjacent to the city limits on its northern boundary. Highlands East, a residential hous- ing development which has been annexed to the city, is immediately to the north of East 7th Street (County Road 294) which forms the northern boun- dary of the Carlson property. It is because of the contiguous boundary that I had recommended that the 2.50 acres of property which is being served with municipal water annex to the city rather than sign a pre- annexation agreement. Pre -Annexation agreements are used by the City of Rifle in cases where municipal water or sewer service is extended to property which is not contiguous with the city limits and therefore cannot be annexed to the city. As the Carlson property is already adjacent to the city limits, a pre -annexation agreement would not he logical. The County will very likely be receiving more and more similar requests as Rifle grows in the next few years. It certainly seems that it is in Rifle's interest to make decisions on subdivisions adjacent to the city's corporate boundaries, especially any decisions where the provision of municipal services are involved. Rifle has served the residence with municipally treated water for many years. As the owners are now requesting a sub- division of the land in the county, Rifle's policy dictates that the residence be annexed to the City of Rifle.
