D. 19 80 , there were present: Richard C. Jolley Larry Velasquez Flaven J. Cerise Arthur A. Abplanalp, Jr. Nancy Sprick Page, Deputy Commissioner Chairman Commissioner Commissioner County Attorney Clerk of the Board when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 80-225 RESOLUTION CONCERED WITH GRANTING AN EXEMPTION FROM THE GARFIELD COUNTY SUBDIVISION REGULATIONS FOR RUNAR AND SIGRID CARLSON WHEREAS, Runar and Sigrid Carlson have petitioned the Board of County Commissioners of Garfield County, Colorado, for an exemption from the def- inition of the terms "subdivision" and "subdivided land" under C.R.S. 1973, 30-28-101 (10) (a) - (d), as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted January 2, 1979, Sections 2.02.21 (d) and 3.02.01 for the division of a 36.5 acre tract described as follows: A parcel of land lying in the SW1, SW1 of Section 10 T6S, R 93 W of the 6th P.M. more particularly described as follows: Tract A: Beginning at a point on the southerly right of way line of County Road #294 whence the Southwest corner of Section 10 hears S. 14°54'07"W. 1187.71 feet; thence S 55°10'00" W. 210.00 feet; thence S. 72°50'00"E. 125.00 feet; thence S. 0°00'00" E. 140.00 feet; thence N. 90°00'00"E, 130.00 feet; thence N. 0°00'00"E. 150.00 feet; thence N. 68°42'00"E, 75.50 feet; thence N. 29°22'00"W. 298.81 feet to a point on the southerly right of way line of Section 10; thence along a non -radial curve to the left having a central angle of 4°33' 02", a radius of 170.00 feet, an arc length of 13.50 feet and of which the chord bears S 71°26'33" W. 13.50 feet: thence S. 69°10'02" W, 131.35 feet; thence S. 69°03'50"W. 19.53 feet; thence along a curve to the left having a central angle of 3°26'00", a radius of 1970.00 feet, an arc length of 118.05 feet and of which the chord bears S. 67°20'50" W, 118.03 feet; thence S. 65°37'50" W. 90.99 feet to the point of beginning. Containing 2.339 acres, more or less. (in the State of Colorado and County of Garfield); and WHEREAS, the Petitioners have demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that the proposed division does not fall within the purposes of Part 1, Article 28, Title 30, Colorado Revided Statutes 1973, as amended, for the reason that the impact created dors not warrant a full subdivision review. WHEREAS, the Petitioners have demonstrated to the satisfacticn of the Board of County Commissioners of Garfield County, Colorado, that there is a reasonable probability of locating domestic water on each of said tracts, that there is adequate ingress and egress to said tracts, that the location of septic tanks will be permitted by the Colorado Department of Health, that the requested division is not part of an existing or larger development and does not fall within the general purposes and intent of the subdivision regulations of the State of Colorado and the County of Garfield, and should, therefore, be exempted from the definition of the terms "subdivision" and "subdivided land" as set forth in C.R.S. 1973 30-28-101 (10) (a) - (d), as amended; BOOK 555 PAc 826 NOW, THEREFORE, BE IT RESOLVED that the division of the above described tract "A", from the above described 36.5 acre tract is hereby exempted from such definitions and said tract may be divided into tracts "A", all as is more fully described above, and said divided tract may e conveyed in the form of such smaller tracts without further com- pliance with the aforesaid subdivision statutes and regulations; provided, however, that this exemption is granted on the condition and with the express understanding and agreement of the Petitioners that no further exemptions be allowed on said tract "A", and that a copy of the instrument or instruments of conveyance when recorded shall be filed with this Resol- ution. And further, that no other splits be allowed on the 34 acre tract until that tract is annexed to the City of Rifle.
