L The Applicant shall be required to submit a paper copy of the plat and proof that all the
conditions of approval have been met to the Building and Planning Department at least
twenty-one (21) days prior to the expiration of the 120-day deadline required for signing the
plat by the Board. This is to ensure timely Staff review of the materials submitted as well as
proper scheduling the plat to be signed by the board.
10.Once all of the conditions, if any, have been satisfied, an Exemption Plat shall be
presented to the Board for signature within 120 days of approval. The plat shall include a
legal description of the exempted property, and Exemption Certificate, the County
Surveyor's Certificate and a statement, if four (4) lots, parcels, or interest have been
created on the parcel, that "NOTE: No further divisions by exemption from definition will
be allowed." The plat shall be recorded with the County Clerk and Recorder no later than
thirty (30) days after the Chairman's signature. The Chairman of the Board of County
Commissioners shall not sign a plat of a conditionally approved exemption until all
conditions of approval have been complied with.

GARFIELD COUNTY (hereinafter COUNTY) and Aaron Daler and Kristina Swanson
(hereinafter APPLICANT) agree as follows:
1. APPLICANT has submitted to COUNTY an application for E-emFf i on f rom the

2. APPLICANT understands and agrees that Garfield County Resolution No. 98-09, as amended,
establishes a fee schedule for each type of subdivision or land use review applications, and the guidelines for the
administration of the fee structure.
3. APPLICANT and COUNTY agree that because of the size, nature or scope of the proposed
project, it is not possible at this time to ascertain the full extent of the costs involved in processing the
application. APPLICANT agrees to make payment of the Base Fee, established for the PROJECT, and to
thereafter permit additional costs to be billed to APPLICANT. APPLICANT agrees to make additional
payments upon notification by the COUNTY when they are necessary as costs are incurred.
^ 4. The Base Fee shall be in addition to and exclusive of any cost for publication or cost of
]onsulting service determined necessary by the Board of County Commissioners for the consideration of an
application or additional COUNTY staff time or expense not covered by the Base Fee. If actual recorded costs
exceed the initial Base Fee, APPLICANT shall pay additional billings to COUNTY to reimburse the COUNTY
for the processing of the PROJECT mentioned above. APPLICANT acknowledges that all billing shall be paid
prior to the final consideration by the COUNTY of any land use permit, zoningamendment, or subdivision plan.

Applicants: Aaron Daler and Kristina Swanson (fka Kristina Daler)
Dear Staff Planner:
Enclosed is the Application for Exemption from the Definition of Subdivision for Aaron
Daler and Kristina Swanson (fka Kristina Daler) for property located at 1225 County Road 226,
Rifle, CO 81650 ("Property"). I am submitting this application and the following supplemental
material on behalf of the applicants as per the Application Submittal Requirements:
Applicants purchased the Property, which is an 18 acre parcel of land that has been
improved with modular home and outbuildings, for use as a primary residence in
2002. Applicants and their predecessors have been hauling water for domestic uses
since the house was built. It came to applicants' attention in 2007 when they
attempted to get a domestic well permit that the Property was split off from the larger
parcel in 7979 by Ira and Vivian Langstaff without a formal exemption from the
County subdivision regulations. All relevant deeds are attached hereto, as stated
below.
Applicants have been told that they cannot get a well permit for the Property or make
any other improvements to the Property because it is not considered to be a legally
created parcel. The County has been treating this Property as a separate parcel, and
the Property has been assessed separately since 1991 under Assessor's Parcel Number
2\2703400L35. As is set forth in paragraph 8 below, a building permit, septic permit
and Certificate of Occupancy for the residence on the Property were issued for this
Property in 1996, providing further proof that this Property has been considered to be
a separate parcel in the eyes of the County.
This application is being submitted to obtain the exemption that should have been
applied for and received in 1979 at the time the Property was split from the larger
parcel. The successors in interest to and heirs of Ira and Vivian Langstaff, Raymond

and Elaine Langstaff, John and Renee Langstaff, and H. Wayne and Linda Langstaff,
have given letters of consent to this Application.
Attached is an Improvement Survey showing the Property, improvements on the
property, easements of record, and proximity of the Property to County Road 226.
Attached is the U.S.G.S. map showing slope/topography of the property.
Attached is a copy of the Warranty Deed for the Property showing ownership in
Applicants, and the other deeds in the Applicants' chain of title. Also attached is the
deed on the Parent Property, and deeds for the chains of title as referenced in
paragraph 5 below. I have included the Parcel Detail lnformation from the Garfield
County Assessor's Office on all of the properties. Also attached are letters of consent
from Raymond, Elaine, John, Renee, H. Wayne and Linda Langstaff, who are the
successors in interest to Ira and Vivian Langstaff, the once owners of the Parent
Property.
There have been two splits from the larger parcel, or Parent Property. A Schematic
Parcel Time Line ("Time Line") is attached to further explain these splits. This Time
Line shows the original 160 acre larger parcel as it existed in 1952, and shows the
two subsequent splits from this property in 1979, which is the Daler/Swanson
Property that is the subject of this application, and another split of a 75 acre parcel
owed by H. Wayne and Elaine Langstaff. The remainder parcel of 67 acres is owned
by Raymond and Elaine Langstaff and John and Renee Langstaff.
Attached is the Assessor's map showing the subject property and all adjacent
landowners. Also attached is a list of all property owners within 200 feet of the
Property and the mineral interest owners.
Attached is the Generalized Soil Types Map, upon which we have indicated the
Property. This map provides the evidence and characteristics of each soil type
located on the Property.
Attached are well permits and well completion and construction reports for Raymond
Langstaff, and Don and Patricia Hoach, neighboring properties to the applicant's
Property, showing that wells have been drilled in close proximity to the Property.
Also attached is a memorandum from Division of Water Resources dated May 7,
2007, stating that in order for a well permit to be issued, proof that the Property was
legally created must be given to Division of Water Resources. It is our understanding
based on our experience and conversations with the Division Engineer's office for
Water Division 5 that when the Property is deemed legally created by the County,
Division 5 will issue and in-house well permit.

The subject application for a permit to construct a well is being returned for additional
information concerning the parcel of land on which the proposed well will be located. ln order to
properly evaluate the application, this office must have evidence indi,:ating when the subdivision
or this particular 18 acre parcel of land was created (the June 6, 1967 deed that you submitted
described a 10 acre tract, not an 18 acre tract). Please provide one of the following:
1. lf the subdivision or parcel in question was in existence prior to June 1, 1972, please
provide a copy of a deed, surveyor's plat map, tax receipt, or other document to verify this.
The document must be dated before June 1, 1972, and must describe the parcel in
question.
2. lf the subdivision or parcel in question was exempted by the county from their subdivision
regulations, please provide all of the following:
a) A copy of the county commissioners resolution.

This well shall be used in such a way as to cause no material in.iury to existing water rights. The issuance of this permit
does not assure the applicant that no injury will occur to another vested water right or preclude another owner of a vested
water right from seeking relief in a civil court action.
The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402'2' unless approval
of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump lnstallation
Contractors in accordance with Rule '18.
Approved pursuant to CRS 37-92-602(3xbxll)(A) as the only well on a tract of land of 40.00 acres described as the SE 114
of the NE 1/4, Sec. 3, Twp. 5 S, Rng. 92 W, Sixth P.M., Garfield County'
The use of ground water from this well is limited to fire protection, ordinary household purposes inside not more than
three (3) single family dwellings, the irrigation of not more lhan one (1) acre of home gardens and lawns, and the watering
of domestic animals.
The maximum pumping rate of this well shall not exceed 15 GPM.
The return flow from the use of this well must be through an individual waste water disposal system of the
non-evaporative type where the water is returned to the same stream system in which the well is located.

The use of ground water from this well is limited to fire protection, ordinary household purposes inside not more than
three(3)singlefamilydwellings,theinigationofnotmorethanone(1)acreofhomegardensandlawns'andthewatering
of domestic animals.
The pumping rate of this well shall nol exceed 15 GPM'
The retum flow trom the use of this well must be through an individual waste water disposal system of the
non-evaporative type where the water is retumed to the same stream system in which the well is located'
Pursuant to Rule 6.2.3 of the water well construction Rutes, the well cronstruction contractor shall submit the as-built well
location on work reports required by Rure 17.3 within 60 days of compretion of the we*. The measured location musl be

township 5 south, range 92 west)this property is served by the Rifle Fire
Protection District. Our response for this area would normally comc out of
our main station , located at 1850 Railroad Ave. There is no approve water
supply for fire protection in the area.
