CABRINHA have petitioned the Board of County Commissioners of Garfield County, Colorado, for an exemption under C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted September 1, 1972 and amended April 14, 1975, Sections 1.02.17 (d) and 3.02.01, for the division of a 3,098 acre tract into two (2) parcels of approximately 4 and 3,094 acres, more or less, and more particularly described as follows: Township 6 South, Range 88 West, 6th P.M.: Section Section Section Section Section Section Section Section Section Section Section 14: SW4 SW4. 15: NE4, N1/2 SE4, NE4 SW4f Lots 1 ,2,3, and 4. 22: NE4, MASE', E1/2NW4, NE4 SW/, Lots 2, 3, and 23: E1/2W1/2, Lots 1,2,3, and 4. 26: E2NW4, Lots 1,2,5,6,7,8, 27: Ali of Section 27. 28: Lots 3,6,7,8,9,11 ,12,13, 29: Lots 11,12,24,25, and 32 32: Lots 1 and 2. 33: NE4, Lots 1,2,3,4,5, and 34: 141/2, NW4, SE1/4NW4. and 13. and 14. 6. 4. Comprising 3,098 acres. WHEREAS, the Petitioners have shown to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that they desire said exemption for the purpose of re -sale into single-family residential acreage, and; WHEREAS, Petitioners have demonstrated to the satisfaction of the Board that there is a reasonable probability of locating domestic water on each of said tracts, that there is adequate ingress and egress to said tracts, that the location of septic tanks will be permitted by the Colorado Department of Health, that the requested division is in accordance with the general purposes and intent of the Subdivision Regulations of the State of Colorado and the County of Garfield, and that said division will actually restrict the density of housing within said area, and should therefore, be exempted from the definition of the terms "subdivision" and "subdivided land" as set forth in C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as amended; NOW THEREFORE, upon motion of a.LPe�Y} l LQ seconded by ijA L - `—t fc,1c LL" and carried, said 3,098 acre tract of land is hereby exempted from such definition and transfer of said tract may be made by division into two (2) tracts of 4 and 3,094 acres, more or less, all as is more fully described above. A copy of the instrument or instruments of conveyance when recorded shall be filed with this Resolution. Dated this t day of February, A.D. 1977.
