TYPE OF'REVIEW: APPLICANT(S): LOCATION: ZONING:A/R/RD (Agricultural /Residential /Rural Density) I. DESCRIPTION OF THE PROPOSAL The Applicant is requesting approval from the Board of county commissioners to amend the boundary line between Lot A oith" Dixon Subdivision (Planted Earth) and a neighboring property known as the Coley parcel. The intent for this application is so that Planted Earth can obtain additional property. The property is located at 127 44Highway 82, Carbondale, Colorado. More practically, the property is located on the north side of Highway 82 ut th" property containing the "Planted Earth Nursery'" The Applicant indicates no change in water or sewer will occur and only a transfer of land will result of the transfer. Because the Coiey property is not part of a recorded subdivision, the Applicant intends to file an affidavit once this amended plat request is approved. The end result of the transfer of land from the Coley property to Lot A of the Dixon Subdivision will be that the Coley property will have 3.121 acres-ana Lot A of the Dixon Subdivision will have 4.627 acres which meets the minimum lot area for the A/R/RD zone district. The transfer will result in the transfer of approximately 1 acre of land. II. REGULATORY AUTHORITY Section 6:10 of the Subdivision regulations states that an amendment may be made to a recorded plat, if such amendment does not 1f increase the number of subdivision lots or dwelling units, or 2) iesult in the major relocation of a road or add new roads. This request will not increase the number of subdivision lots or dwelling units and will result in the major relocation of a road or add new roads. Based on this information, Staff finds these standards are met. III. STAFF RECOMMENDATION The Applicant has provided all required documentation and has satisfied the applicable standards for a plat amendment. Therefore, recoilrmends that the Board of County Commissioners, pursuant to Section 6:10 of the Subdivision Regulations of 1984, as amended, approve this amended plat request with the following conditions: I 2 3 Divide Creek Land and Cattle Company Amended plat BOCC _ 09/1s/03 Page 2 That all representations of the Applicant, either within the application or stated at the meetingbefore the Board, shall be consideied conditions of approvar; The Applicant shall modify the title of the plat to read: Amended Final plat of Lot A of theDixon Subdivision; and w-tn]n 90 days of approval, the Amended Final Plat shall be reviewed (pgpelqepy), then signedand dated (mylar copy)_by the County Surveyor, than signed ura aut"aTlffitiairman of theBoard and recorded in the Clerk and Recorder's office Jf Garfield County. The Amended plat shall meet the minimum CRS standards !r fand survey plats, as required by Colorado state law, 1nd approved by the County Surveyor and shall include, at a minimum, the information outlinedin Section 5:22 of the Garfield county subdivision Regulations. IV. RECOMMENDED MOTION "I move to approve the plat amendment request for Lot A of the Dixon Subdivision and the coleypropert5z."
