REFERENCE: Senate Bill 35 Exemption - Four -Mile Creek Property
Dear Ray:
Attached is a copy of a request for approval of Senate Bill 35
Exemption, dated October 22, 1978. The County Commissioners denied
this original application on the basis that there was no evidence
that the three sites had actual building sites and further, that a
well permit had not been granted for the property. The petitioners,
Dennis Carroll and Richard Carroll have asked that I resubmit the
request for exemption together with the following attached documents:
1. Letter from the petitioners to the effect that they will
use water cisterns or storage tanks and pay for hauling
water to the residences if well permits are denied. You
will note this letter is also signed by Willard McClintock,
son-in-law of Richard Carroll, who will be taking title to
one of the tracts of land.
2. Report from Richard J. Mandeville, a professional engineer,
to the effect that each site does contain a location for con-
struction of a house, that is, slopes under the designated
maximum of 30% and in some instances slopes of 10%.
3. Letter from Paul and Dennis Carroll and Willard McClintock
agreeing to build on the westerly side of Four -Mile Creek and
agreeing to, at their own expense, construct a bridge or cul-
vert to cross the river.
Also attached is a new petition for exemption together with the
necessary exhibits.

RE: Senate Bill 35 Exemption, Dennis Carroll, Richard Carroll,
Willard McClintock
Dear Mr. Baldwin:
Currently we are applying for an exemption from Senate Bill 35
to divide the property described on the attached description into
three tracts of land.
In the event we are unable to obtain well permit or permits for
this property, we will provide water for each house on the property,
at our sole expense, by use of water cisterns or storage tanks and
obtain water elsewhere and transport it to the cisterns for household
use.
