GARFIELD COUNTY, COLORADO
REQUEST FOR SKETCH PLAN REVIEW AND EXEMPTION
Pursuant to 1973 C.R.S. 38-28-101 and the Garfield
County Subdivision Regulations, as amended, Caroline B. Condon,
by her attorney, Thomas W. Stuver, respectively submits this
Request for Sketch Plan Review and Exemption of a proposed
division of property located in Garfield County which would
result in the creation of two tracts of land one of which would
be less than 35 acres and petitions the board to exempt the
division of this tract from the provisions of the Garfield
County Subdivision regulations otherwise pertaining.
In support of this request, the Petitioner states as
follows:
1) The Petitioner is the owner of 134.5 acres more or
less in Sections 5, 8 and 9, Township 6 South, Range 93 West of
the 6th P.M. situated contiguous to the City of Rifle, Colorado.
This parcel is designated "subject property" on the VICINITY MAP
submitted herewith and is more fully described on Exhibit "A"
hereto attached.
2) It is the intention of the Petitioner to detach
from the subject property a parcel comprising approximately
9.763 acres for sale for residential purposes. The said parcel i
shown on the survey and SKETCH PLAN MAP submitted herewith and
is more fully described on Exhibit "B" hereto attached.
Situated on the parcel is a single-family residence and a mobile
home.
3) The Petitioner is unable to proceed with the de-
tachment and sale of the 9.763 acre tract without the permission
of the Board of County Commissioners.
4) The 9.763 acre tract is held in fee by the
Petitioner as more fully set forth on the Certificate of Title
submitted herewith.
5) The source of domestic water for the two dwelling
units on the subject 9.763 acre property is the City of Rifle
water system. An individual sewage treatement system is presently
situated on the tract.
6) Access to the 9.763 acre tract is via County Road
244 which is contiguous with the North boundary line of the
subject property.
7) The current zoning of the subject property is
A/R/RD and additional residential units would not be permissible
under the current zoning.
8) Soils maps and soils interpretations from the
National Cooperative Soil Survey have been made available to the
Garfield County Planning Department previously. The proposed
development is not inconsistent with the natural topography,
soil drainage, and other physical characteristics of the subject
property.
9) The detachment of property requested is not part of
a larger, existing or proposed division.
10) Upon conveyance of the 9.763 acre parcel, a copy of
the deed of conveyance will be filed with this request and the
resolution of exemption, if granted.

RIFLE PLANNING COMMISSION
December 30, 1976
The Rifle Planning Commission met in regular session on December
30, 1976 with the following members present: Robert Choate, David
Downey, Richard Perry, Donald Thompson, Ronald Zastrow. Also
present were Stephen Carter, Dan Deppe, Lynn Behrns.
Motion by Donald Thompson to accept the minutes of the November
29th meeting as received. :seconded by David Downey. On roll call
the following voted aye: Choate, Downey, Perry, Thompson, Zastrow.
Lynn Behrns presented the developer's criteria and standards booklet.
Motion by Donald Thompson, seconded by Robert Choate that we recom-
mend to City council acceptance of this booklet. On roll call the
following voted aye: Choate, Downey, Perry, Thompson, Zastrow.
Changes to the draft revised zoning ordinance were discussed. It
was the consensus that 17.11.070 should be added as follows: No
moving, flashing, or rotating signs, animated signs with moving
lights, or signs which create the illusion of movement shall be
permitted. A sign whereon the current time and/or temperature is
indicated shall be exempt from this restriction, provided that if
time and/or temperature are indicated by changing lights, the
figures shall not change more than once in ten seconds.
The following shall be added: 17.11.050. Each apartment shall
provide two off-street parking spaces per unit. Each church shall
provide one space per three seats; each hospital shall provide three
spaces for every two beds.
The section providing for riding and/or livery stables within the.
city limits shall be deleted.
Sections providing for posting of public notices were added in
17,15.045 and 17.19.013.
Motion by Robert Choate, seconded by Richard Perry to recommend to
city council adoption of the revised zoning ordinance with changes
above. On roll call the following voted aye: Choate, Downey,
Perry, Thompson, Zastrow.
Mobile Homec.and Mobile Home Park ordinance was presented. Paragraph
regarding responsibility of managers will be revised by Attorney
Carter.
Motion by Richard Perry, seconded by David Downey, to recommend to
city council repeal and reenactment of the mobile home ordinance.
On roll call the following voted aye: Choate, Downey, Perry, Thompson
Zastrow.

Motion by David Downey, seconded by Robert Choate that we accept the
1976 reference volumes, building standards, building codes, sign code,
plumbing code and mechanical code. On roll call the following voted
aye: Choate, Downey, Perry, Thompson, Zastrow.
Motion by Donald Thompson, seconded by David Downey, that we recommend
to city council that they recommend to county commissioners that we
extend Howard Avenue as previously proposed and that Condon & Condon
take up the financial responsibility of :geeing that this is dedicated
as Howard Avenue, if this portion of land is to he sold separately.
On roll call the following voted aye: Choate, Downey, Perry, Thompson,
Zastrow.
Donald Thompson moved to adjourn at 10:25 P.M. Seconded by Robert
Choate. All voted aye.
