WHEREAS, Boyd W. and Betty Cornell have petitioned the Board of County
Commissioners of Garfield County, Colorado, for an exemption from the definition
of the terms "subdivision" and "subdivided land" under C.R.S. 1973, 30-28-101
(10)(a) -(d) as amended, and the Subdivision Regulations of Garfield County,
Colorado, adopted September 1, 1972 and amended April 14, 1975 Sections
1.02.17(d) and 3.02.01, for the division of a one (1) acre tract of land into
two (2) tracts of approximately 0.5 acres each, more or less, and said one (1)
acre tract is more particularly described as follows:
Lot 7, Block 1, Rifle Village South Subdivision, first filing
according to the Plat Recorded as Document 227220, Garfield
County, Colorado subject to convenants, conditions, restrictions,
rights of way, and easements of record and further subject to a
deed recorded August 12, 1960 in Book 329, at Page 168, oil, gas,
petroleum and mineral rights.
WHEREAS, the Petitioners have demonstrated to the satisfaction of the
Board of County Commissioners of Garfield County, Colorado, that they desire
said exemption for the purpose of resale of said tracts into single-family
residential acreage, and;
WHEREAS, the Petitioners have demonstrated to the satisfaction of the
Board of County Commissioners of Garfield County, Colorado, that each of said
lots will be served by central water and sewer systems, that there is adequate
ingress and egress to each of said tracts, that the requested division is in
accordance with the general purposes and intent of the Subdivision Regulations
of the State of Colorado and the County of Garfield, and should, therefore,
be exempted from the definition of the terms "subdivision" and subdivided land"
as set forth in C.R.S. 1973, 30 -28 -101(10)(a) -(d) as amended;
NOW, THEREFORE, upon the motion of Richard C. Jolley, seconded by Flaven J.
Cerise, and carried, said one acre tract is hereby exempted from such definitions
and said tract may be divided into two (2) tracts of 0.5 acres each, more or less,
all as is more fully described above, and said tracts maybe conveyed in the form
of such smaller tracts without further compliance with the aforesaid subdivision
statutes and regulations; provided, however, that said exemption is conditioned
on the Petitioner obtaining a proper legal description of said tracts prior to
conveyance thereof. Further, this exemption is granted cn the condition and with
the express understanding and agreement of the Petitioner that no building permits
are to be issued until central water and sewer service is provided to said tracts.
