HomeMy WebLinkAbout2.0 Resolution 1975r • RESOLUTION WHEREAS, C. E. Coryell, Patrick B. Coryell and Charles R. Coryell, owners, have petitioned the Board of County Commissioners of Garfield County, Colorado for exemptions of the following described properties pursuant to the provisions of C.R.S. 1973, 30-28-101 (10) (d) ; and WHEREAS, said Board is convinced that the dispositions of said properties by the owners is not made for the purpose of evading the provisions of the statute, and should be exempt from the definition of the terms "subdivision" and "subdivided land" as set forth in said statutes. NOW, THEREFORE, upon Motion of 1aven J. Cerise seconded by Pete J. Mattivi , and unamimously carried, the Board of County Commissioners of Garfield County, Colorado hereby grants the exemptions as requested pertaining to the following described properties: STATE OF COLORADO - COUNTY OF GARFIELD A"parcel of land situate in Lot 30 of Section 1 and Lot 2 of Section 12, Township 7 South,_ Range 89 West, 6th P.M., lying Westerly of a fence as constructed in place, Northerly of the Southerly line of said Lot 2 and Easterly of the Westerly lines of said Lots 2 and 30, and more particularly described as beginning at a point in said fence whence the Northeast Corner of Lot 20 in said Section 1 -bears N. 23°39'56" E. 2,287.31 feet; thence S. 02°20'00" W. 78.20 feet along said fence; thence S. 02°16'22" W. 479.80 feet, more or less along said fence to a point on the Southerly line of said Lot 2; thence N. 86°25'04" W. 1,241.23 feet, more or less, along the Southerly line of said Lot 2 to the Southwest Corner of said Lot 2; thence N. 01°01'42" W. 443.56 feet, more or less, along the Westerly line of said Lot 2 to the Northwest Corner of said Lot 2, said point being on the section line between said Sections 1 and 12; thence N. 88°07'00" W. 81.32 feet, more or less, along said section line to the Southwest Corner of said Lot 30; thence N. 00°38'00" W. 280.65 feet along the Westerly line of said Lot 30; thence N. 89°22'00" E. 780.18 feet to a point in the center of the Glenwood Ditch whence the Northeast Corner of Lot 20 in said Section 1 bears N. 39°0212-1" E. 2,367.7a feet; ,367.78- feet; thence along the center of said ditch S. 14°48'59" W. 9.40 feet; thence along the center of said ditch S. 05°12'09" E. 211.55 feet; thence along the center of said ditch S. 13°49'12" E. 18.48 feet; thence S. 88°07'00" E. 552.33 feet to the point of beginning. STATE OF COLORADO - COUNTY OF GARFIELD A parcel of land situated in Lot 30 of Section 1 and Lot 2 of Section 12, Township 7 South, Range 89 West, 6th P.M., lying Westerly of the center of the Roaring Fork River, Northerly of the Southerly line of said Lot 2 and Easterly of the Westerly lines of said Lots 2 and 30, being more particularly described as follows: Beginning at a point in the center of said river whence the Northeast Corner of Lot 20 in said Section 1 bears N. 50°19'58" E. 2,893.87 feet; thence S. 41°07'57" E. 562.21 feet along the center of said river; thence S. 47°57'18" E. 519.80 feet, more or less, along the center of said river to a point on the Southerly line of said Lot 2; thence N. 86°25'04" W. 708.76 feet, more or less, along the Southerly line of said Lot 2 to the Southwest Corner of said Lot 2; thence N. 01°01'42" W. 443.56 feet, more or less, along the Westerly line of said Lot 2 to the Northwest Corner of said Lot 2, said point being on the line between said S<-ctions 1 and 12; thence N. 88°07'00" W. 81.32 feet, more or less, along said Section line to the Southwest Corner of said Lot 30; thence N. 00°38'00" W. 280.65 feet along the Westerly line of said Lot 30; thence N. 89°22'00" E. 43.88 feet to a point in the center of said river, the point of beginning, containing 5.70 acres, more or less. STATE OF COLORADO - COUNTY OF GARFIELD A parcel of land situated in Lot 9 of Section 12, Township 7 South, Range 89 West, 6th P.M., lying Easterly of the center of the Roaring Fork River, Westerly of the Easterly line of said Lot 9 and Southerly of the Northerly line of said Lot 9, said parcel of land is described as follows: Beginning at a point on the Northerly line of said Lot 9 whence the Northeast Corner of Lot 20 in Section 1 in said Township and Range bears N. 17°50'04" E. 2,792.01 feet; thence S. 00°22'58" E. 816.90 feet; thence S. 67°24'19" W. 211.00 feet to a point in the center of said river; -thence N. 08°01'04" E. 130.25 feet along the center of said river; thence N. 04°46'25" W. 390.41 feet along the center of said river; thence N. 34°28'56" W. 123.72 feet along the center of said river; thence N. 47°17'30" W. 466.70 feet along the center of said river to a point on the Northerly line of said Lot 9; thence S. 86°25'04" E. 617.87 feet, more or less, along the Northerly line of said Lot 9 to the point of beginning, containing 5.61 acres, more or less. That granting the aforesaid exemptions is specifically conditioned upon no further sales nor subdivision of said properties without first complying with Garfield County subdivision regulations pertaining to any of such exempted properties.
