BEFORE THE BOARD OF COUNTY COMMISSIONERS
OF GARFIELD COUNTY, COLORADO
PETITION FOR EXEMPTION
Pursuant to C.R.S. 1973, 30-28-101 (10)(d) the undersigned,
Charles R. Coryell, respectfully petitions the Board of County
Commissioners of Garfield Couty, Colorado to exempt, by
resolution, a certain parcel of land owned by said petitioner
and, in connection therewith, would show said commissioners
as follows:
1. That petitioner is the owner of certain property
generally located southerly of Glenwood Springs, Colorado,
containing approximately 19.57 acres, more or less, being
more specifically described as follows, to -wit:
STATE OF COLORADO - COUNTY OF GARFIELD
A parcel of land situate in Lot 30 of Section 1 and Lots 2
and 9 of Section 12, Township 7 South, Range 89 West, 6th
P.M., being more particularly described as follows, to -wit:
Beginning at a point in the center of the Glenwood
ditch whence the northeast corner of Lot 20 in
said Section 1 bears N. 39°02'21" E. 2,367.78 feet;
thence S. 14°48'59" W. 9.40 feet along the center
of said ditch; thence S. 05°12'09" E. 211.55 feet
along the center of said ditch; thence S. 13°49'12" E.
18.48 feet along the center of said ditch; thence
S. 88°07'00" E. 552.33 feet to a point in a fence,
as constructed and in place, whence the northeast
corner of said Lot 20 bears N. 23°39'56" E. 2,287.31
feet; thence S. 02°20'00" W. 78.20 feet along said
fence; thence S. 02°16'22" W. 479.80 feet, more or less,
along said fence to a point on the southerly line
of said Lot 2 (being the same as the northerly line
of said lot 9); thence S. 86°25'04" E. 85.40 feet,
more or less, along the northerly line of said Lot
9 to a point whence the northeast corner of said Lot
20 bears N. 17°50'04" E. 2,792.01 feet; thence S. 00°22'58" E.
816.90 feet; thence S. 67°24'19" W. 211.00 feet to
a point in the center of the Roaring Fork River; thence
N. 08°01'04" E. 130.25 feet along the center of said
river; thence N. 04°46'25" W. 390.41 feet along the
center of said river; thence N. 34°28'56" W. 123.72
feet along the center of said river; thence N. 47°17'30" W.
466.70 feet along the center of said river to a point
on the northerly line of said Lot 9; thence N. 47°57'18" W.
519.80 feet along the center of said river; thence
N. 41°07'57" W. 562.21 feet along the center of said
river to a point whence the northeast corner of said
Lot 20 bears N. 50°19'58" E. 2,893.87 feet; thence
north 89°22'00" E. 736.30 feet to the point of beginning,
containing 19.57 acres, more or less.
Together with existing easements or rights-of-way for access
purposes to County Road No. 154 and for utility purposes,
including, but not exclusively, a strip of land 20 feet
in width situate in Lots 21 and 30 of Section 1, Township
7 South, Range 89 West, 6th P.M., being 10 feet on each
side of the following described centerline, to -wit:
Beginning at a point whence the northeast corner of
Lot 20 in said Section 1 bears N. 55°29'22" E. 1,586.90
feet; thence S. 47°52'25" W. 132.64 feet along said
centerline; thence S. 17°41'47" W. 200.15 feet along
said centerline; thence S. 49°28'16" W. 61.60 feet along
said centerline; thence S. 58°02'36" W. 46.73 feet along
said centerline; thence S. 19°24'04" E. 312.88 feet along
said centerline; thence S. 02°09'04" W. 216.75 feet along
said centerline; thence S. 00°22'29" W. 45.27 feet along
said centerline; thence S. 14°48'59" W. 51.34 feet along
said centerline; thence S. 05°12'09" E. 205.87 feet along
said centerline; thence S. 13°49'12" E. 23.12 feet along
said centerline to its intersection with the north line
of the above described property situate easterly of the
Glenwood ditch.
2. That the parcel for which the exemption is sought is
a part of the above described property, contains 14.87 acres,
more or less, with easements, and is more specifically described
as follows, to -wit:

A parcel of land situate in Lot 30 of Section 1 and Lots 2
and 9 of Section 12, Township 7 South, Range 89 West, 6th P.M.,
being more particularly described as follows, to -wit:
Beginning at a point in the center of the Glenwood ditch
whence the northeast corner of Lot 20 in said Section 1
bears N. 39°02'21" E. 2,367.78 feet; thence S. 14°48'59" W.

point on the southerly line of said Lot 2 (being the same

Lot 2 to a point on the northerly line of said Lot 9 whence
the northeast corner of said Lot 20 bears N. 17°50'04"
E. 2,792.01 feet; thence S. 00°22'58" E. 816.90 feet;
thence south 67°24'19" W. 211.00 feet to a point in
the center of the Roaring Fork River; thence N. 08°01'04"
E. 130.25 feet along the center of said river; thence
N. 04°46'25" W. 390.41 feet along the center of said
river; thence N. 34°28'56" W. 123.72 feet along the
center of said river; thence N. 47°17'30" W. 466.70
feet along the center of said river to a point on

the northerly line of said Lot 9; thence N. 47°57'18"
W. 519.80 feet along the center of said river; thence
N. 41°07'57" W. 562.21 feet along the center of said
river to a point whence the northeast corner of said
Lot 20 bears N. 50°19'58" E. 2,893.87 feet; thence
N. 89°22'00" E. 736.30 feet to the point of beginning.
Together with existing easements and rights-of-way for
access purposes to County Road No. 154, and for utility
purposes.
3. That exemption of the above described parcel of
land, with easements, is sought to enable the petitioner
to sell said parcel;
4. That the petitioner plans to retain and build
his home upon the following described property, to -wit:
STATE OF COLORADO - COUNTY OF GARFIELD
A parcel of land situate in Lot 30 of Section 1 and Lot
2 of Section 12, Township 7 South, Range 89 West, 6th P.M.,
being more particularly described as follows, to -wit:
Beginning at a point in a fence as constructed and
in place whence the northeast corner of Lot 20 in
said Section 1 bears N. 23°39'56" E. 2,287.31 feet;
thence S. 02°20'00" W. 78.20 feet along said fence;
thence S. 02°16'22" W. 479.80 feet, more or less,
along said fence to a point on the southerly line
of said Lot 2; thence N. 86°25'04" W. 86.16 feet,
more or less, along the southerly line of said Lot
2 to a point in the center of the Glenwood ditch;
thence N. 41°29'50" W. 97.44 feet along the center
of said ditch; thence N. 50°56'22" W. 276.94 feet
along the center of said ditch; thence N. 33°02'48"
W. 250.09 feet along the center of said ditch; thence
N. 13°49'12" W. 116.58 feet along the center of said
ditch; thence S. 88°07'00" E. 552.33 feet to the point
of beginning, containing 4.70 acres, more or less.
Together with an easement or right-of-way 20 feet in width
for access purposes to County Road No. 154, and utility
purposes, situate in Lots 21 and 30 of Section 1, Township
7 South, Range 89 West, 6th P.M., being 10 feet on each
side of the following described centerline, to -wit:
Beginning at a point whence the northeast corner of

5. That the sizes of the parcel being retained by
your petitioner and the parcel your petitioner desires
to sell lend themselves to division in this manner due
to the fact that the parcel being retained is higher in
elevation and easterly of the Glenwood ditch from the parcel
petitioner desires to sell, and both, because of their
sizes, are suseptable to the lccation of both a water well
and septic system, with leach field, on each parcel, and
both have access to County Road No. 154 and easements for
utility purposes;
6. That the granting of this exemption will in no
way interfere with the property rights of others and is
within the spirit of Senate Bill No. 35 allowing division
of lands in this manner.

Re: Senate Bill 35 Exemption

Gentlemen:
We have reviewed the proposed exemption and find that it is in
compliance with the Garfield County Senate Bi11 35 procedures.
The proposed exempted partial is to be used as a place of residency
by Mr. Coryell and will result in the creation of another partial
in an area that you are familiar with has many problems, but this
partial is physically separated by geologic definition from the
adjacent land. It is our understanding that this has been dis-
cussed for you gentlemen by the petitioner when the last exemption
dated March 11, 1975 was granted.
We do conclude and recommend approval of this request, but we
would caution the petitioner and the Commissioners that further
exemptions not be allowed in this area.
