HomeMy WebLinkAbout2.0 Resolution 77-50RESOLUTION 7%-0 WHEREAS, PAT B. CORYELL, has petitioned the Board of County Commissioners of Garfield County, Colorado for an exemption under C.R.S. (1973) Section 30- 28-101 (10) (a) - (d) as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted September 1, 1972 and amended April 14, 1975, Sections 1.02.17 (d) and 3.02.01, for the division of a 1.74 acre tract into two tracts of approximately .53 acres and 1.21 acres, more or less, and more particularly described as follows: A tract of land situated in Lot 20 of Section 1, Township 7 South, Range 89 West of the 6th Principal Meridian, lying Southerly of the Northerly line of said Lot 20, Easterly of the Denver & Rio Grande Western Railroad (Aspen Branch) and Westerly of State Highway No. 82, described as follows: Beginning at a point on the Northerly line of said Lot 20, being also a point on the Westerly right-of-way line of said highway, whence the Southeast corner of Lot 36, said Section 1, bears S. 87° 06' E. 548.65 feet; thence S. 370 23' E. 263.91 feet along the Westerly right-of-way line of said highway; thence S. 70° 53' W. 181.13 feet to a point on the Easterly right-of-way line of said railroad; thence N. 190 35' W. 291.37 feet along the Easterly right-of-way line of said railroad to a point on the Northerly line of said Lot 20; thence S. 87° 06' E. 108.70 feet along the Northerly line of said Lot 20 to a point on the Westerly right-of-way line of said highway, the point of beginning. The above described tract of land contains 0.83 of an acre, more or less. WHEREAS, the Petitioner has shown to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that he desires said exemption for the purpose of re -sale into single-family residential acreage, and; WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board that there is a reasonable probability of locating domestic water on each of said tracts, that there is adequate ingress and egress to said tracts, that the location of septic tanks will be permitted by the Colorado Department of Health, that the requested division is in accordance with the general purposes and intent of the Subdivision Regulations of the State of Colorado and the County of Garfield and should, therefore, be exempted from the definition of the terms "subdivision" and "subdivided land" as set forth in C.R.S. (1973) Section 30- 28-101 (10) (a) - (d) as amended; NOW THEREFORE, upon motion of by 4 we4, ,5e �.� rtll V / sqz seconded and carried, said 1.74 acre tract of land is exempted from such definition and transfer of said tract may be made by division into two tracts of •53acres and 1.21 acres, more or less, all as is more fully described above, further that such approval is conditioned upon the Petitioner obtaining a lot size variance from the Garfield County Zoning Resolution for individual sewage disposal for the 1.21 acre parcel from the Garfield County Zoning Board of Adjustment. A copy of the instrument or instruments of conveyance when recorded shall be filed with this Resolution. Dated this d2,0day of June. A.D. 1977.
