HomeMy WebLinkAbout2.0 BOCC Staff Report 10.16.1989REQUEST: APPLICANT: Jay Cose, Jr., and Buelah Mae Cose BOCC 10/16/89 PROJECT INFORMATION AND STAFF COMMENTS Exemption from the Definition of Subdivision LOCATION: A tract of land situated in the NW 1/4 SE 1/4 Section 6, T6S, R99W; approximately five (5) miles east of Rifle off C.R. 225. SITE DATA: The site consists of a 35.0 acre tract. WATER: Existing shared well SEWER: Individual Sewage Disposal Systems ACCESS: County Road 225 EXISTING ZONING: A/R/RD ADJACENT ZONING: A/R/RD I. RELATIONSHIP TO THE COMPREHENSIVE PLAN The site is located in District C, Rural Areas with Minor Environmental Constraints. II. DESCRIPTION OF THE PROPOSAL A. Site Description: The site is located in a rural portion of the County with adjacent land uses primarily single family residential, agricultural, and open space. Slopes on the site are gentle with native types of vegetation. Currently, there is a single family dwelling on the site. B. Project Description: The applicant proposes to divide the 35.0 acre parcel into three lots of 12.7, 12.1 and 10.1 acres in size. It is proposed to share the existing well as a water supply for the proposed lots. Individual Sewage Disposal Systems will be utilized. C. History: The applicant has submitted documentation establishing that only one lot of five (5) acres has been created out of this tract since January 1, 1973 by Resolution No. 77-66. III.MAJOR ISSUES AND CONCERNS 1. Soils information on the site indicates that the main limitation for homesite development is shrink -swell potential, which may require engineered foundations and individual sewage disposal systems. 2. The existing domestic well to be used as a source of domestic water for the proposed lots will need to have a legally described access and repair easement at least 10 feet square around the well and then waterline access and repair easements to each lot from the well, shown on the plat. IV. SUGGESTED FINDINGS 1. That proper posting and public notice was provided as required by law for the meeting before the Board of County Commissioners. 2. That the meeting before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted, and that all interested parties were heard at that meeting. 3. That for the above stated and other reasons, the proposed exemption is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. V. RECOMMENDATION APPROVAL, with the following conditions: 1. That the following plat notes be included on the Exemption Plat: per Section 8:00: a) That no further exemptions from the definition of subdivision shall be granted on this site, or any portions of it. b) Each lot may be subject to engineered foundations and septic systems. 2. That all utility and access easements on the site be included on the plat. 3. That the applicant submit $400 in School Impact Fees for the creation of two new lots. 4. That all representations of the applicant, either within the application or stated at the meeting before the Board of County Commissioners, shall be considered conditions of approval.
