RESOLUTION CONCERNED WITH GRANTING AN EXEMPTION FROM THE GARFIELD COUNTY SUBDIVISION REG-
ULATIONS FOR CALVIN AND PAUL COX.
WHEREAS, Calvin and Paul Cox have petitioned the Board of County Commissioners
of Garfield County, Colorado, for an exemption from the definition of the terms "sub
division" and "subdivided land" under C.R.S. 1973, 30-28-101 (10) (a) -(d), as amended
and the Subdivision Regulations of Garfield County, Colorado, adopted January 2, 1979,
Sections 2.02.21 (d) and 3.02.01 for the division of a 16.396 acre tract described as
follows:
That parcel of land as described in Document No. 164596 as filed in the Office
of the Clerk and Recorder of Carfield County, Colorado into 2 tracts of approx-
imately 8.176 and 8.220 acres each, more or less, which proposed divided tracts
are more particularly described as follows:
Tract A: A tract of land lying in Govt. lot 7, Sec. 30, Township 6 South,
Range 88 West, 6th P.M. Beginning at a corner from whence the E1/4 corner Sec.
25, Township 6 South, Range 89 West, 6th P.M. bears S 21°26'54" W., 2843.84
feet, thence N 1117.86 feet, thence S 55°07'08" E, 37.68 feet, thence S 64°
27'52" E, 84.11 feet, thence S 55°10'13" E, 155.11 feet, thence S 44°17'59"
E, 75.05 feet, thence S 39°13'24" E, 220.47 feet, thence S 37°37'39" E, 115.82
feet, thence S 40°40'09" E, 48.70 feet, thence S 49°01'59" E, 70.13 feet, thence
S 50°21'28" E, 25.28 feet, thence S 47°12'34" W, 818.74 feet to point of begin-
ning. Containing 8.176 acres more or less.
Tract B: A tract of land lying in Govt. lot 7, Sec. 30, Township 6 South,
Range 88 West, 6th P.M. Beginning at a corner from whence the E1 corner Sec.
25, Township 6 South, Range 89 West, 6th P.M. bears S 21°26'54" W, 2843.84 feet,
thence N 47°12'34" E, 818.74 feet, thence S 50°21'28" E, 73.00 feet, thence
S 51°28'28" E, 428.51 feet, thence S 50°52'16" E, 254.59 feet, thence S 40°29'
05" E, 107.85, thence W 1259.80 feet to point of beginning. Containing 8.220
acres more or less; and
WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of
County Commissioners of Garfield County, Colorado, that the proposed division does not
fall within the purposes of Part 1, Article 28, Title 30, Colorado Revised Statutes 1973,
as amended, for the reason that the impact created does not warrant further subdivision
review, and
WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of
County Commissioners of Garfield County, Colorado, that there is a reasonable probability
of locating domestic water on each of said tracts, that there is adequate ingress and egress
to said tracts, that the location of septic tanks will be permitted by the Colorado
Department of Health, that the requested division is not part of an existing or larger
development and does not fall within the general purposes and intent of the subdivision
regulations of the State of Colorado and the County of Garfield, and should, therefore,
be exempted from the definition of the terms "subdivision" and "subdivided land" as set
forth in C.R.S. 1973, 30-28-101 (10) (a) -(d), as amended;

NOW, THEREFORE, BE IT RESOLVED that the division of the above described tracts
"A", "B", from the above described 16.396 acre tract is, hereby exempted from such def-
inition and said tract may be divided into tracts "A", "B" all as is more fully des-
cribed above, and said divided- tract may be conveyed in the form of such smaller tracts
without further compliance with the aforesaid subdivision statutes and regulations;
provided, however, that this exemption is granted on the condition and with the express
understanding and agreement of the Petitioner(s) that no further exemptions be allowed
on said tract(s) "A", "B" and that a copy of the instrument or instruments of conveyance
when recorded shall be filed with this Resolution.
