PROJECT INFORMATION AND STAFF COMMENTS REQUEST: Exemption from the Definition of Subdivision APPLICANT: A. Guy Crouch & Martha Crouch LOCATION: A tract of land situated in Sections 19, 20, 29 & 30, T7S, R87W; located approximately 6 miles east of Carbondale off County Road 102. SITE DATA: The site consists of a 200 acre tract. WATER: Individual wells SEWER: Individual Sewage Disposal Systems ACCESS: Proposed access drives off County Rd. 102. EXISTING ZONING: A/R/RD ADJACENT ZONING: A/R/RD & P.U.D. I. RELATIONSHIP TO THE COMPREHENSIVE PLAN The site is located in District C, Rural Areas with Minor Environmental Constraints and District B, Rural Serviceable Areas 1/2 to 1 mile radius, Minor Environmental Constraints as designated on the Comprehensive Plan Management District Map. The District B designation is due to proximity to the Panorama Ranches Subdivision and central water system. II. DESCRIPTION OF THE PROPOSAL A. Site Description: The site is located in a rural portion of the County with adjacent land uses primarily single family residential, agricultural, and open space. Slopes on the site are fairly gentle with the majority used for agricultural/grazing purposes. Improvements include one single family dwelling. B. Protect Description: The applicant proposes to divide the 200 acre parcel into two tracts of 10 acres and 190 acres in size with the larger tract containing all existing improvements. (See attached map, page /S' C. History: Since 1972, the overall tract has been divided into four (4) parcels, one of which is greater than 35 acres in size and separated by County Rd. 100 and therefore qualifies for exception to the Subdivision Regulations limit on splits by exemption. Two other lots were created by Subdivision Exemption approved by Resolution No. 84-96 for Jake Stoner. III.MAJOR ISSUES AND CONCERNS 1. The proposed 10 acre lot would be the last split allowed by exemption consistent with Section 8.52 of the Subdivision Regulations should the Board of County Commissioners consider the previous split by C.R. 100 an exception to the limit on splits by exemption. 2. The applicant has represented that an additional well permit would be obtained through contracts with the Basalt Water Conservancy District. Copies of these documents should be submitted, prior to final approval. 3. Soil Conservation Service information on the site indicates that the soils are suited to homesite development with the main limitations being shrink -swell soils and slopes. 4. Approval by the County Road and Bridge Department is required for any new access point off C.R. 102 and may require improvements including culverting. IV. SUGGESTED FINDINGS 1. That proper posting and public notice was provided as required by law for the meeting before the Board of County Commissioners. 2. That the meeting before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted, and that all interested parties were heard at that meeting. 3. That for the above stated and other reasons, the proposed exemption is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. V. RECOMMENDATION APPROVAL, with the following conditions: 1. That the following plat notes be included on the Exemption Plat: a) That no further exemptions from the definition of subdivision shall be granted on this site, or any portions of it. b) This 10 acre lot is being subdivided out of the A. Guy Crouch and Martha Crouch property as described in Book Page , as recorded in the Garfield County Clerk & C Recorder's office. That the applicant submit evidence of a domestic water source for 2. rthe proposed 10 acre tract, consisting of an additional well permit, contract with the Basalt Water Conservancy District or other verification acceptable to the Board of County Commissioners. 3. That the applicant submit $200 per lot in School Impact Fees for the creation of one new lot. 4. That the applicant shall submit an approved driveway access permit from the Garfield County Road and Bridge Department for the 10 acre lot, or a letter stating that permit would be issued at a future date. 5. This map unit is on alluvial fans, high terraces, and valley sides. Elevation is 7,000 to 8,500 feet. The average annual precipitation is 14 to 16 inches, the average annual air temperature is 42 to 44 degreest'F, and the average frost -free period is 80 to 90 days. This unit is 45 percent Showalter very stony loam and 35 percent Norval loam. The components of this unit are so intricately intermingled that it was not practical to map them separately at the scale used. The Showalter soils occupy convex parts of the landscape, and Nbrval soils are in more concave positons. p Included in this unit are small areas of soils similar to this Norval soil which have 30 to 50 percent cobble in the substratum. Included areas make up about 20 percent of the total acreage. The lower 28 inches of the subsoil is very cobbly clay. The substratum to a depth of 60 inches or more is very cobbly clay loam. Permeability of the Showalter soil is slow. Available water capacity is moderate. Effective rooting depth is 60 inches or more. Runoff is medium, and the hazard of water erosion is moderate. The rbrval soil is deep and well drained. It formed in alluvium derived dominantly from basalt. Typically, the surface layer is brown loam 7 inches thick. The upper 12 inches of the subsoil is clay loam. The lower 4 inches is loam. The substratum to a depth of 60 inches is loam. The soil is noncalcareous to a depth of 19 inches and calcareous below that depth. Runoff is medium, and the hazard of water erosion is slight. This unit is used for rangeland, hayland, and homesite development. The potential plant community on the Showalter soil is mainly bluebunch wheatgrass, western wheatgrass, prairie junegrass, Indian ricegrass, true mountainmahogany, antelope bitterbrush, Saskatoon serviceberry, and big sagebrush. The average annual production of air-dry vegetation is about 900 pounds per acre. The potential plant community on the Norval soil is mainly needleandthread, western wheatgrass, muttongrass, praire junegrass, and big sagebrush. The average annual production of air-dry vegetation is about 1,500 pounds per acre. If this unit is used for rangeland seeding or mechanical treatment, the main limitation is stones on the surface of the Showalter component. Management practices suitable for use on this soil are proper range use, deferred grazing, rotation grazing, and aerial spraying for brush management. If this unit is used for hay and pasture, the main limitations are stones on the surface, steep slopes, and slow permeability of the Showalter soil. Grasses and legumes grave well if adequate fertilizer is used. This unit is very poorly suited to homesite development. The main limitations are slope, shrink-swell, and stones throughout the profile. This map unit is in capability subclass Vie, nonirrigated. The Showalter soil is in Loamy Slopes range site, and the Morval soil is in Deep Loam range site.
