REQUEST: BOCC 7/2/90 PROJECT INFORMATION AND STAFF COMMENTS An Exemption from the Definition of Subdivision. APPLICANT: A. Guy Crouch and Martha Crouch LOCATION: A tract of land situated in Sections 19, 20, 29 and 30, T7S, R87W; located approximately 6 road miles east of Carbondale off C.R. 102. SITE DATA: The site consists of a 165+ acre tract. WATER: Individual wells SEWER: I.S.D.S. ACCESS: Proposed access drives off of C.R. 102. EXISTING ZONING: A/R/RD ADJACENT ZONING: A/R/RD and P.U.D. I. RELATIONSHIP TO THE COMPREHENSIVE PLAN The site is located in District C, Rural Areas with Minor Environmental Constraints and District B, Rural Serviceable Areas 1/2 to 1 Mile Radius, Minor Environmental Constraints as designated on the Comprehensive Plan Management District Map. The District B designation is due to proximity to the Panorama Ranches subdivision and central water system. II. DESCRIPTION OF THE PROPOSAL A. Site Description: The site is located in a rural portion of the County with adjacent land use primarily single family dwelling and outbuildings. B. Project Description: The applicant proposes to divide the 165+ acre parcel into two (2) tracts of 10 and 155 acres with the larger tract containing all.existing improvements. (See attached map on page )7.Gf) C. History: Since 1972, the overall tract has been divided into five (5) parcels, one of which is greater than 35 acres and separated by County Road 100 and therefore qualifies for exception to the Subdivision Regulations limit on splits by exemption. Two (2) other lots were created by Subdivision Exemption approved by Resolution 84-96 for Jack Stoner. In January 1990, a deed was recorded creating a fifth parcel, 35 acres in size. In October, 1989, the Board of County Commissioners conditionally approved an exemption request allowing the 200 acre parcel to be split into two tracts of 190 and 10 acres each. The applicants never resolved the conditions and no resolution was ever approved. Subsequent to conditional approval by the Board of County Commissioners, the applicants split off a 35 acre parcel becoming the fifth parcel created from the parent property since 1972. III. MAJOR ISSUES AND CONCERNS 1. The applicants are reapplying to the Board after previous approval due to their desire to reconfigure the proposed 10 acre parcel. In addition, the original approval has lapsed due to inactivity. 2. Since 1972, the original tract has been divided into 5 parcels. The one parcel split by the County road would be considered an exception, leaving a total of four (4) parcels for the purposes of qualification exemption. At the time of application, staff was unaware of the creation of the fourth parcel. In subsequent research, staff became aware of the existence of this fourth parcel. 3. Section 8:52 of the Subdivision Regulations allow the Board to grant exemption provided that no more than a total of four (4) lots will be created. Consideration and approval of this request, for a fifth parcel, would constitute a direct contradiction of the regulations. IV. SUGGESTED FINDINGS 1. That proper posting and public notice was provided as required by law for the meeting before the Board of County Commissioners. 2. That the meeting before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. 3. That for the above stated and other reasons, the proposed exemption is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County.
