At the present time we do not have knowledge of any easements.

as proposed between Landmark Services and the Town of New Castle, for the
above referenced exemption proposal.
The contents of this letter were accepted and approved at our last
regular meeting, July 11, L984. Thereforer the proposed recommendation
(pg. 2) from the Town of New Castle is hereby given.
Please note the very last paragraph of the letter. It agrees that a
statement of New Castle approval will be affixed to the Exemption P1at.
We will consider our acceptance of the Plat as our final approval of the
exemption.

After reviewing the most recent map submitted for theDietz senate Bill 35 exemption reguest, we have found a fewitems that we feel deserve sorne extra attention. The NewCastle Planning and Zoning commission reviewed the originalsubmittal 0n February 22, 1-991, and recommended approvalprovided that the water system not be adversety aiiecteaand that there be a plat noter on the final plat which requiresreview of all uses on the lots b.rz the Tovrn of New Castle.Now that we see the proposed building envelopes we just wantto alert you to the idea that the two northern most envelopes,particularly the one closest to the Elk creek subdivisionaccess road, causes us some concern. Their septic-systemsshould be closely scrutinized due to their pro*i*ity'to .r,r,water plant.
As you know, the road to the Erk creek subdivision issteep and does not comply with the County's stanrlards. Theaddition of four (4) new individuaJ accesses onto that rodmay cause sonne safety problems in the wi.nter timer so theirexact locations and actual construction will need close supervision.Also, the proposed access that is adjacent on the North andEast of our water plant may not be a realistic po"iiultitv.

Parcel No. 4 is basiscally two sites; the smaller triangular
shaped portion is the most probable building site. This build-'ing site appears smal I on the plat but it is actual ly much larger
than the adiacent sites which have been developed. This buildinqsite was not tested as it appears to be in the same,,potts,'soil
as parcel Nos. i and 3 and proximate cut banks are vi sab'te con-
firm'ing bedrock and qround water conditions favorable to soil
absorption systems. A northerly placement of the soil absorption
system i s recommended for optimum safety rel ati ve to the water
p'l ant works. To avoid contamination final placement of the
absorpt'ion system must be at I east 100 f t f rom a potabl e water
well and at least 50 ft from a potable water storaqe tank; such
clearances are ava'i lable at the subject site.
All details of the disposal system design must be approved by the
Garfield County environmental officer prfor to construction. I
w'i ll be available to assist in fjnal design details upon request.

3. Homeowners and Dietz r.:ish to provideimposition of certain covenants and obligations to runownersnip of the four (4) parcels created by Dietz uponof the senate Bill 35 Exemption by the GarfielciCommissioners.

Homeowners Association. Dietz fitsy, at his election, ehoose to
impose covenants upon the parcels owned by him which are morerestrictive than the covenants to which the Elk creek subdivisionis presently subject.
5. Dietz agrees to impose

covenants upon the four ( 4 )
owners of the parcels to

participate, on an equitable basis, with the Elk Creek Homeowners
Association or the owners of the inoividual lots in the E1k Creek
Development in providing for the costs of any improvements made to
the roadway situate within the sixty (60) foot easement to be
granted by Dietz. Further, such covenants sha11 provide that the
four ( 4 ) parcels of land sha11 not be subdivided to greater
density in the future. The parcel of land exiting on Navajo
Street in the E1k Creek Subdivision shall also be subject to
assessments for street improvements within the E1k Creek
Subdivision.
6. Dietz and Homeov.,ners agree that the Homeowners may
create a special class of members, including the owners of lots in
the El,k Creek Development and the owners of the parcels to be
created by Dietz for the purpose of aSSeSsing to such members the
ccsts of improving anO maintaining the roadv:ay and other
irilprovements, such aS peciestrian walkways, to be situate within
f-he sixtl'(60) foot easement granted by Dietz; anC Dietz agrees to
subject his parcels to membershir: in the Homeowners Association
v:ithin such special class of members if oeemed appropriate b]'the
Homeowners Association. It is intenderi that the provisions of the
Homeowners Association governing such e.ssessments shall incluoe
the right io collect oelinquent asSeSSments, to assess oenaltl'
interest on overoue aSsessments, and to collect from the
non-prevailing party, the reasonable attorne\"' fees ano costs
incurreC in anv action to collect such assessmenfs.
7. Dietz agrees, for himself and his assigns, that the
Homeowners, by entering intO this agreement, are not assuming any
obligation to Dietz or his assigns to maintain or improve the
roadway situate within the sixty (501 foot easement. Any such
obligation shal1 be governed by the common law of Colorado
pertaining to maintenance of easements, unless subseguently
modified by action of the Homeowners inctuding the owners of the
parcels to be created by Dietz as a special class of members in
the Homeowners Association.

Dietz further agrees, for himself and the
respective future assigns of each of his lots, to indemnify and
hold harmless the Homeowners of any claims arising out of
defective design, conStruction or maintenance of the respective
dr ivevrays and turn-out areas serving any of the four lots
belonging to Dietz or his respective future assigns and to pay the
reasonable attorney'S fees incur recl by the Homeowners in the
oef ense of any such clai::s.
8. Dietz agrees, that upon sale of the first of the
parcels created by him to third parties, Dietz will cause the
roadway situate v.'ithin the easement to be improved by installation
of appropriate culverts for the driveways serving Dietz's parcels
and construction of puI1-off areas for each parcel at the point of
driveway access in order that access may be had to each of Dietzrs
parcels r.'ithout interfering'- with the pre-existing use of the
roadway by the owners of lots v;ithin the Elk Creek Subdivision'

roadway within the easement shall not suffer any significant '

9. The parties recognize that in order to ir"olenent
Ene foregoing covenantS and agreements it may bc necessary to make
amenciments to the Articles of Ineorporation of the EIk Creek
Homeowners Association and to enter into additional agreements to
carry out the intent of the parties. Dietz agrees to have such
documents prepared at his expense, and to pay the cost of filino
such documents v.'ith the appropr iate author ities.

ELK CREEK HOMEOWNERS ASSOCIATION
A11 persons, corporations or associations, including the

a special class of members of the Elk Creek Homeowners
Association, a Colorado Corporation not for profit, in accordance

Thank you for the coPY of the Dietz
Plat amended final plat of Lot 7, Block 4, Unit
Creek Development.
Upon review of the final p1at, we find that the
requi-rements of the negotiated agreement between the Town
of New Castle and Landmark Services have been complied with,
although upon review of the final plat, i-t was noted that
the plat did not show where the septic system and leach
field locations would be for building envelopes two and
three.
The Town of New Castle is requesting our app-
roval of the location of the septic systems before they ar.e
installed. The reason the request is being made is because
of the close proximity to the Town's water supply line and
the water treatment P1ant.
