SITE DATA: A 35.50 acre tract WATER: Shared Well SEWER: Individual Sewage Disposal System (ISDS) ACCESS- County Road 162 ZONING: A/R/RD ADJACENT ZO_ ING: North: A/R/RD South: A/R/RD East: A/R/RD West: A/R/RD i_ RELATIONSHIP TO THE COMPREHENSIVE PLAN The property is located within District C - Rural Areas/Minor Environmental Constraints of the Garfield County Comprehensive Plan Management District map. II. DESCRIPTION OF THE PROPOSAL A. Site Description: The property is bordered on the west by County Road 162 (La Casita Road), on the east by a proposed county road right-of-way to serve Sun Mesa Subdivision, and on the south by Sun Mesa. Sage and oak brush are the prevailing vegetation on the site. The property trends from southeast corner of the property (high point at approximately 7000 feet), and slopes moderately to the west and north. The property is bisected by the county road, and the exemption is requested to identify the isolated tract as a separate parcel. 1 An existing house is located near the center of the parent parcel, approximately 75 feet from the eastern property line, and approximately 15 feet from the edge of the county road right-of-way. The house is served by an existing domestic well located at the north end of the property. The property is also divided by three powerlines, two running east -west, and a second running north -south, both bisecting the property. A vicinity map is attached on page -6— . B. Project Description: The applicant is proposing to split the 35.5 acre parent parcel into two (2) tracts of 28.18 and 5.53 acres in size. The proposed division occurs at County Road 162. The existing house will remain on the 28.18 acre tract. Access to both parcels would still remain as County Road 162. A sketch plan of the exemption is shown on page - 7- . A copy of the application is attached on pages &� /D. In addition to the exemption, the applicant is requesting the relocation of a portion of County Road 162. In staff's opinion, this issue should be addressed as a separate request, particularly due to the unresolved nature of the proposed Sun Mesa access. The proposed alignment of the County road, shown on the sketch plan cited earlier, does not adversely impact the exemption request, although the current alignment would alter the gross acreages shown on the applicant's submittals. III. MAJOR ISSUES..AND CONCERNS 1. Subdivision• Section 8:10 (Applicability -Exemptions) states that the Board has discretionary authority to except a division of land from the definition of subdivision. Following a review of the facts of each application, the Board may approve, conditionally approve, or deny an exemption request. The board may not grant an exemption unless the applicant can demonstrate compliance with zoning, legal access, adequate water and sewer, state environmental health standards, necessary road and drainage improvements, fire protection, adequate easements and school impact fees. 3. Exemption Regulations. Section 8.52 (A) of the Garfield County Subdivision Regulations state that no more than four (4) parcels will be created from any parcel as that parcel was described in the Records of the Clerk and Recorder's Office in January 1, 1973, and is not a part of a recorded subdivision. The parcel has been split four times since January 1, 1973. Section 8.52 (A) allows the creation of a parcel split by a public right-of-way to not be considered to have been created by exemption with regard to the four (4) lot limitation. 4. Zoning- All lots meet the minimum lot size requirements of 2 acres for the AJR/RD zone district. Required setbacks for this zone district are as follows: Front and Back = 25 feet; Sides =10 feet. For the purpose of interpretation, the south property line is the front property line for the 5.33 acre exemption parcel. 2 5. Legal Access: Access for the additional lot will be obtained directly from County Road 162. No easements are necessary to provide direct access to either parcel. 6. Water: The existing dwelling unit is served by a well located on the north exemption parcel. The well was permitted in 1967, and allows for a maximum of three residences. Appropriate easements for waterlines and access to the well Iocation will be required prior to the submittal of a Final Exemption Plat. A copy of the well permit is attached on page"The project was forwarded to Division of Water Resources for review, but no response has been received. Local staff (Dwight Whitehead) did not foresee in issues regarding the well being used for an additional dwelling unit. 7. Sewage: Sewage is proposed to be handled by ISDS. Soil mapping from SCS indicate that the predominate soils on the site are the Forelle-Brownsto and Showalter-Morval complexes. Both of these soil complexes present development constraints. The Forelle-Brownsto complex is mainly limited by slope constraints. The Showalter-Morval complex is considered poorly suited for homesite development, due to the shrink -swell potential and excavation difficulties. These soil types have severe restrictions for septic tank absorption fields, due to slope and inadequate perc rates.' 8. Natural Hazards: County staff referenced hazards mapping conducted for the County in 1976 by Lincoln-Devore Laboratories for the subject property. In staff's opinion, the constraint definitions and methodology used in the Lincoln- Devore study are a more accurate data source for project -specific hazards identification. The project area is not located in an area defined as in an area of slope or soil hazards. Therefore, no plat notes are necessary. 9. Fire Protection. The applicant has not submitted any documentation from the Carbonda le -Rural Fire Protection District regarding the ability of the district to serve the project. The submittal of a letter from Ron Leach will be a condition of approval. IV. SUGGESTED FINDINGS 1. The proposal is in general compliance with the Garfield County Comprehensive Plan and the Garfield County Zoning Regulations. 2. The proposed land use would be consistent and compatible with the existing surrounding land uses. 3. The proposal is in best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. V. RECOMMENDATION APPROVAL, subject to the following conditions: ' Table 11 - Sanitary Facilities, Soil Survey of Aspen -Gypsum Area, Colorado. Parts of eagle, Garfield, and Pitkin Counties, United States Department of Agriculture, Soil Conservation Service, May 1992, p. 201-209. 3 1. All representations of the applicant shall be considered conditions of approval unless otherwise stated by the applicant. 2. The applicant shall have 120 days to complete the required conditions of approval. Extensions of 120 days may be granted by the Board for a period of up to one (I) year. 3. A Final Exemption Plat will be submitted, indicating the legal description of the property, dimension and area of all proposed lots or separate interests to be created, access .to a public right-of-way, and any proposed easements for drainage, irrigation, access or utilities. 4. The applicant shall submit $200.00 in School Impact Fees prior the signing of an exemption plat. 5. Prior to the submittal of a Final Exemption Plat, the applicant will submit a letter from the Carbondale -Rural Fire Protection District regarding the provision of fire protection to the site. 6. That easements for waterlines and for access and maintenance of the proposed well be included on the Exemption Plat. In addition, each parcel shall receive a deeded interest in the well. 7. A well sharing agreement shall be provided prior to the approval of the plat and shall be recorded in conjunction with each deed conveying well ownership. 8. This thirty-five acre parcel is bisected in the southeast corner by County Road 162, isolating approximately six acres from the rest of the property. This exemption is requested to identify this isolated tract as a subdivided lot. The parcel is_bordered on the west by County Road 162 (La Casita Road), on the east by a proposed county road right-of-way to serve the Sun Mesa Subdivision and on the south by by the Sun Mesa Subdivision. Sage and oak brush dominate the vegetation of the site. Topographi-dally, the highest area is in the southeast corner which has a gentle westerly aspect. From this platform slopes roll moderately to the west and north. Simultaneous With this exemption application, Ms. Crouch is requesting the .relocation of a portion of County Road 162. The present 162 location is on the very door step of Ms. Crouch's residence (La Casita). The house is located on the westerly right-of-way line with the edge of road roughly 15 feet from the residence. It is our understanding that a new county road will be built along the easterly boundary of the Crouch property to serve the Sun Mesa Subdivision. The proposed road will intersect Road 162 immediately north of. La Casita. Ms. Crouch proposes to relocate this intersection to a site south of her residence. Even though there is very little traffic on Road 162, this relocation would significantly enhance the safety and quality of the Crouch residence and I believe will result in a safer intersection. Box 517 • Glenwood Springs, Colorado 81602 918 Cooper Avenue (303) 945-2246 J Crouch Application, cont. 12/7/92 page 2 Obviously some expenditure is anticipated to create the intersection proposed north of La Casita since the old 162 will need to be realigned to create a 90 degree intersection and elevated to properly match the profile of the proposed road. Ms. Crouch proposes to pay the cost of reconstructing Road 162 in the new location only to the extent that these costs exceed the expenditures required for the northerly intersection. It would be built to the minimum county standards for a road servicing two dwelling units. The Crouch residence will take access from the realigned section of 162 (see Sketch Plan). An existing dwelling unit located off the Crouch property will continue to utilize the old 162 Road for access and proposed Lot B may choose between old 162 or the proposed road to Sun Mesa if it is dedicated as a County Right -of -Way. The relocation of Road 162 will require the vacation of a segment of the existing right-of-way and the dedication of a new right-of-way by Ms. Crouch. Water for the proposed lot will be provided by the'sharing of the existing well that serves the Crouch residence. The well is located on the remaining 30 acre parcel. The well was permitted in 1967 (see attached copy of permit) and allows for a maximum of three residences to be served. The well has a history of producing ample amounts of good quality water. Appropriate easements for access through Lot A to the well will be provided by the Exemption Plat. Covenants filled with the Exemption Plat will provide for shared use of the well, well permit and water lines. All irrigation water rights will remain with LotA where the water has historically been used. The Soil Conservation Service soils mapping identifies the exemption property as overlain by primarily two soil types, a Forelle-Brownsto complex and a Showalter-Morval complex. Both complexes suggest that steep slope may be a.limitation to homesite development. Lot A is already built on and is gently rolling. Lot B has some areas of steeper slope but there is adequate space for home construction on the more gentlysloping areas of the site. Normal site specific soils investigations will identify any shrink -swell potential that might require consideration in the design of the foundation system. Neither the soil type descriptions nor the experience of the present residence suggest any significant limitations to the use of individual sanitary disposal systems on.the property. The site will not be threatened by flooding from any major drainage or stream. Deer and elk have historically moved about this area during the winter months and will continue to do so even after the addition of a new home on Lot B. Adrienne Crouch who lives at LaCasita 6 also appeared. After receiving the return receipts and acknowledgment 7 from Ron Liston that he posted the property, Steve Zwick stated that 8 the meeting could proceed. 9 Dave Michaelson presented the following exhibits: Exhibit "A" - Proof 10 of Publication, Exhibit "B" Return Receipts, Exhibit "C" - 11 application, Exhibit "D" - Staff Report and Exhibit "E" - 01/27/93 12 letter from John Schurer from the State Engineer's office addressing 13 existing well on the site. Chairman Arbaney entered Exhibits "A" 14 through "E" into the record. 15 Dave explained that this is a 35.50 acre parcel with the water proposed 16 to be a shared well, sewer handled by ISDS and access is provided from 17 CO RD 162. Dave stated that the split is allowable because of the 18 split of the property by CO RD 162. Dave said that the applicant is 19 also requesting the relocation of a portion of CO RD 162 which in 20 Staff's opinion should be addressed as a separate request due to the 21 unresolved nature of the proposed Sun Mesa access. 22 Dave said that the Staff was recommending approval with the following 23 conditions: 24 1. All representations of the applicant shall be considered conditions 25 of approval unless otherwise stated by the applicant. 26 2. The applicant shall have 120 days to complete the required 27 conditions of approval. Extensions of 120 days may be granted by 28 the Board for a period of up to one year. 29 3. A Final Exemption Plat will be submitted, indicating the legal 30 description of the property, dimension and area of all proposed 31 lots or separate interests to be created, access to a public 32 right-of-way, and any proposed easements for drainage, irrigation, 33 access or utilities. 34 4. The applicant shall submit $200.00 in School Impact Fees prior to 35 the signing of an exemption plat. 36 5. Prior to the submittal of a Final Exemption Plat, the applicant 37 will submit a letter from the Carbondale -Rural Fire Protection 38 District regarding the provision of fire protection to the site. 39 6. That easements for waterlines and for access and maintenance of the 40 proposed well be included on the Exemption Plat. In addition, each 41 parcel shall receive a deeded interest in the well. 42 7. A well sharing agreement shall be provided prior to the approval of 43 the plat and shall be recorded in conjunction with each deed 44 conveying well ownership. 45 8. Control of noxious weeds are the responsibility of the property 46 owner. 47 Ron Liston discussed the request for changing the alignment of CO RD 48 162 for a 90 degree intersection with the Sun Mesa Road. Chairman 49 Arbaney explained that this was a private road and Sun Mesa would have 50 to grant a right of way to the County for the use of this road. He 51 stated that the County is waiting for Sun Mesa representatives to come 52 back with a proposal. Dave stated that if the Sun Mesa dispute is 53 resolved, the applicant could conte back at that time and amend the plat 54 as a boundary line adjustment. 55 Dave explained that this is the only split that is available. 56 Commissioner Smith made a motion that an exemption from the definition 57 of a subdivision be granted to Adrienne Crouch with all the major 58 issues, concerns, suggested findings and recommendations of the Staff 59 as part of that approval. Commissioner Mackley seconded the motion; 60 carried. 61 PUBLIC HEARING FOR ABATEMENTS 62 Commissioner Smith made a motion that a Public Hearing be set for 63 February 16, 1993 at 10:30 A.M. for the following abatements: Bill 64 Challis, Jerry Rankin and Brigett A. Page 7 GARFIELD COUNTY BOARD OF COUNTY COMMISSIONERS MINUTES 1999 Page 84 Chairman Martin mentioned that a letter was received from Connie Earhardt, A motion was made by Commissioner McCown and seconded by Commissioner McCown to approve the request for an exemption from the definition of subdivision for James and Judy Lemon creating r parcels with staffs eight recommendations as shown in the staff report; adding No. 9 - "an emergency egress be available from lot 1 back south to CR 301." Chairman Martin mentioned that he would like to have Item 6 subsection 6 - "suspended solids" be met in the water testing. Commissioner McCown included the suspended solids and a 16 foot driving surface could be included instead of turnouts if the applicant found this to be better; and the total easement be 25 foot easement. Commissioner Stowe seconded the amendments; motion carried. CONTINUED PUBLIC MEETING: VACATION/DEDICATION CR 162. APPLICANT: ADRIANNE COUCH Mark Bean and Don DeFord was present. !Mark said Ms. Couch is not available. The plat has been drawn up and they are in the process of the alignment. Kenny Gardner has gone up and verified the new road alignment. Mark said what was needed was a motion for placement of the appropriate items in the consent agenda for approval. Joint Meeting - Board and City Council Friday March 19 at 9:00 A.M. was set for the meeting for the City Council and the Board of County Commissioners. BOARD OF HEALTH Mary Meisner submitted the Commissioner with packets of infonnation. Pediatric Access Task Force Mary said that the designation of "medically under served"' is looking good for this area. Valley View Hospital has pledged space and will also be willing to look at labs and x-rays for the center as well. This is for the east end as the west end has already been declared a rural health center. Letter of Support A motion was made by Commissioner Stowe and seconded by Commissioner McCown to authorize all of the Commissioners to sign the letter of support for this "medically under served classification." Motion carried. Diane Maiden and Dr. Chris Tonozzi of Columbine were present. A key factor was in Richard Allen of Medicaid calling Colorado Community Health Network which is the Colorado Association of all the Community Health Centers and saying That we need a Community Health Center in Garfield County -- can't you help us. Columbine has been taking care of the uninsured and Medicaid participants, In January they began and found an overwhelming need to offer care for about 20% of the population who do not have insurance or low income. It is more than Medicaid situation. The hospitals have been contacted and free space has been committed as well as pharmacy and lab. Diane Maiden said she has written some small grants for startup and they are asking $350,000 in the large federal grant. This would mean they would receive $350,000 each year. Outreach is a key factor and includes a lot of collaboration with Mary Meisner and Margaret Long. Dr. Chris Tonozzi addressed the medical part. He said they would be open for all ages, hospital, outpatient, auxiliary services, x-ray,lab, and women services.- Women services does not include prenatal as it is done by— Healthy Beginnings. He said there will be an eligibility screener to assist in going through the paperwork. Some may qualify for a sliding scale. They will need to provide proof of residence, last 3 months of income, etc. Diane Maiden said they try to keep this streamlined. The clinic will be bilingual - Spanish; some nontraditional office hours will be offered as well. They will work also with (he elderly. Columbine Health will be the operator of the clinic and have an advisory board of up to 6 people and possibly 2 of those would become Columbine Home Health Board Members, Mary Meisner passed out the presentation given at the Human Commission meeting. Diane Maiden said they work with Boulder, Gilpin and Clear Creek Counties and to bring in the coordination of what resources are available would be a high priority. There would be Medicaid dollars to provide for an outpatient Medicaid paper worker. The next steps include notice of federal funding and a commitment with Medicaid to operate some type of a clinic even if the federal funding doesn't come. Diane said her goal is to have a community health center up and going by August of 1999. Space Diane said there is about 2000 sq. ft. provided in the first year and availability to expand up to 4,000 sq. ft.. Valley View Hospital has committed to the long range plan. Dr. Tonozzi said Valley View Hospital will be building Glenwood Medical Associates a new building and the hospital administration will move to the current Glenwood Medical Associates building; and space will be committed within the hospital. Diane mentioned Garfield County would be the focus of the medical care. Commissioner McCown asked if the entire Garfield County would be eligible for this clinic? Diane said yes. Dr. Chris Tonozzi said there would not be any barriers. PUBLIC HEARING EXTENSION OF PRESHANA FARMS PLANNED UNIT DEVELOPMENT Mark Bean, Don DeFord, Kevin Patrick - water attorney and Herb Cline Attorney for Jay Weinberg were present. Mr. Cline mentioned that his client is a perspective purchaser under contract to buy Pcrshana Ranch.
