PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) Section 30 -28 -101(10)(a) -(d) as amended, and the Subdivision
Regulations of Garfield County, Colorado, adopted April 23, 1984, Section 2:20.49, the undersigned
BRANNAN PROPERTIES, INC., respectively petitions the Board of County Commissioners of
Garfield County, Colorado, to exempt by Resolution the division of a 104 acre tract of land into four
(4) tracts of approximately 8.5, 25.5, 35 and 35 acres each, more or less, from the definitions of
"subdivision" and "subdivided land" as the terms are used and defined in C.R.S. (1973) Section
30 -28 -101(10)(a) -(d) and the Garfield County Subdivision Regulations for the reasons stated below:

SUBMITTAL REQUIREMENTS:
An application which satisfies the review criteria must be submitted with all the following information:
A. Sketch map at a minimum of 1" = 200' showing the legal description of the property,
dimension and area of all lots or separate interests to be created, access to a public right-
of-way, and any proposed easements for drainage, irrigation, access or utilities.
B. Vicinity map at a minimum scale of 1" = 2000' showing the general topographic and
geographic relation of the proposed exemption to the surrounding area within two (2)
miles, for which a copy of U.S.G.S. quadrangle map may be used.
C. Copy of the deed showing ownership by the applicant, or a letter from the property
owner(s) if other than the applicant; and
D. Names and addresses of owners of record of land immediately adjoining and within 200
feet of the proposed exemption, mineral owners and lessees of mineral owners of record
of the property to be exempted, and tenants of any structure proposed for conversion;
and
E. Evidence of the soil types and characteristics of each type; and
F. Proof of legal and adequate source of domestic water for each lot created, method of
sewage disposal, and letter of approval of fire protection plan from appropriate fire
district; and
G. If connection to a community of municipal water or sewer system is proposed, a letter
from the governing body stating a willingness to serve NOT APPLICABLE; and
H. Narrative explaining why exemption is being requested; and
I. It shall be demonstrated that the parcel existed as described on January 1, 1973, or the
parcel as it exists presently is one of not more than three parcels created from a larger
parcel as it exists on January 1, 1973.

Re: Application to split by natural feature or exemption - 2026 County Road 245
Dear Commissioners:
Pursuant to the Garfield County Subdivision Regulations, I respectfully apply to the Board of
County Commissioners for the right to divide the above referenced property to create two
parcels each containing 35 acres each, and to divide the remainder along East Elk Creek into two
parcels containing 8.5 acres and 25.5 acres.
A sketch map and vicinity map are enclosed indicating the lots proposed and showing the natural
division created by East Elk Creek.
The applicant is the owner of the property and a copy of the deed showing ownership is enclosed.
Two parcels have been split off this property since 1973. One by County Subdivision
Exemption Resolution No. 82-289 dated 11;24/82. The other parcel, possibly by lot line
adjustment in April 1978 when conveyed to Rosgen and Richards.
There are currently two permitted wells on the property , copies of which are enclosed. Under
the provisions of C.R.S. 37-92-602(1)(b)(II)(A), an owner of a tract of land 35 acres or
more in size may obtain an exempt well permit for ordinary household purposes.
The proposed lots will be served by a ISDS waste water system. Access to parcels 1, 3 and 4
will be from County Road 245. Access to Parcel 2 will be from County Road 241.
The area in the vicinity of this parcel has a number of approved subdivision lots and properties
containing small acreage, and the granting of this application will not materially affect the
character of the neighborhood.

• FINDINGS OF THE STATE ENGINE,
IN THE MATTER OF AN APPLICATION TO REPLACE AN EXISTING DECREED WELL IN GARFIELD COUNTY,
COLORADO.

In compliance with the provisions of Section 37-90-137, C.R.S. 1973, Paul H.
Lindstrom, 2026 245 Road, New Castle, Colorado, 81647 (hereinafter "applicant") sub-
mitted an application for a permit to replace. an existing well, Permit No. 45579, to
withdraw ground water from a tributary aquifer of the Colorado River System. The
application was received complete by the State Engineer on October 21, 1982. On the
basis of the information submitted by the applicant, the field inspection report froiii
the Water Commissioner and the records in the State Engineer's office, the State
Engineer makes the following findings:
1. The well is located in the SE 1/4 of the SW 1/4 of Section 24, Township 5
South, Range 91 West of the 6th Principal Meridian, Garfield County, Colorado.

2. The well is located outside the boundaries of a designated ground water
3. The proposed maximum pumping rate is 50 gallons per minute.
4. The proposed well would divert ground water from sand and gravel deposits
which are hydraulically connected to and can affect the rate or direction of movement
of water in the Colorado River.
5. The Colorado River is overappropriated at some or all times of the year.
The water supply from said river is insufficient to satisfy all the decreed water
rights
6. The water diverted from the well is used for domestic purposes in a prin-
cipal residence and five (5) cabins.
7. A permit, No. 45579, was issued on April 22, 1971 for domestic purposes.
The well was complcLed July 2.0, 1971.
8. The well was adjudicated by the Division 5 Water Court in Case No. W-1144
on November 22, 1972 for domestic and commercial purposes.
9. The subject well is adjudicated for 50 gallons per minute.
10. The well does not qualify under the provisions of CRS 1973, 37-92-602(1)(b)
as an exempt well and therefore must be evaluated under CRS 1973, 37-90-137(2).
In view of the above, the State Engineer has found that there will be no sub-
stantial change from the historic use and the issuance of the requested permit will
not materially injure vested water rights. Therefore, the permit may be issued subject
to the following conditions:

I. The existing well must be plugged and abandoned according to the revised and
amended Rules and Regulations for Water Well and Pump Installation Contractors.
2. This well shall be administered in priority.
3. The use of thi s well is restricted to the historic use for one principal
residence and five (5) cabins.
