Upon review of the Amended Final Plat of Terrell Subdivision Exemption, I have no comments or corrections
to be made prior to approval for survey content and form.
Once all final comments from Community Development have been completed, the Mylar may be prepared for
recording. The Mylar shall be delivered to the Community Development office with all private party signatures
no later than Monday the week prior to the next commissioner meeting day in order to make that meeting.

Dear Richard and Carol:
Thanks you for the additional application materials you have provided in
response to our completeness review of your application for an Amended Plat for
the Terrell Subdivision Exemption. Your request involves a boundary line
adjustment between the two lots in the subdivision exemption. Your property is
located north of the Town of New Castle off of County Road 241 with Assessor's
Parcel Numbers 2125-131-00-034 and 2125-131-00-035.
This letter is to advise you that that the application has been deemed Technically
Complete and scheduled for a decision by the Director of the Community
Development Department. Please understand that a determination of technical
completeness shall not be viewed as a recommendation of approval, finding of
an adequate application, or a finding of general compliance with any goal or
objective of the Garfield County Land Use and Development Code or the Garfield
County Comprehensive Plan 2030.
The Application will be reviewed by Staff and a report will be sent to you. The
date upon which the Director of the Community Development Department will
render a decision has been set for December 9, 2013.
Public notice at least 30 days prior to the Director's Decision is required by
written notice by certified mail, return receipt requested, to the owners of record
of all property adjacent to the property and within 200 ft. and the mineral owners
of record for the subject property. The Applicant shall be solely responsible for
the mailing of the notice. The Applicant shall present proof of the required notice
to the Community Development Department prior to the Director's Decision.
Details regarding the notice requirements are found in the Land Use and
Development Code in Table 4-103 and Section 4-103(B). Please review the
following notice requirements from Section 4-103(B).

Loving Trust have applied to the Community Development Department Director, Garfield
County, State of Colorado, to request an Administrative Review for an Amended Final Plat
an a property situated in the County of Garfield, State of Colorado; to -wit:

Final Plat Terrell Subdivision Exemption Recorded March 17,
1999 as Reception No. 541927 with the Garfield County Clerk

That property described in a Quit Claim Deed between Vix
Ranch and the Charles J. Terrell Loving Trust, recorded as

Practical Description: Said property is located at 2090 County Road 241,
approximately 3.5 miles north of the Town of New Castle,
Colorado. The properties are also known by Assessor's Parcel
Numbers 2125-131-00-034 and 2125-131-00-035.
Description of Request:
The Applicant is requesting an Amended Plat to adjust the lot
line between the two lots (Lot 1 and Lot 2). The property is
zoned Rural (R). The File No. is FPAA-7735.

All persons affected by the proposed Administrative Review for an Amended Final Plat are
invited to comment regarding the application. You may state your views by letter or you
may call the Community Development Department at (970) 945-8212 regarding the
application. The Director will give consideration to the comments of surrounding property
owners, and others affected, in deciding whether to approve, approve with conditions or
deny the request. The application may be reviewed at the office of the Community
Development Department located at 108 8th Street, Suite 401, Garfield County Plaza
Building, Glenwood Springs, Colorado between the hours of 8:30 a.m. and 5:00 p.m.,
Monday through Friday.
The Director will make a decision on this application on December 9, 2013. Any comments
to be considered must be received prior to that date.

Dear Richard and Carol:
This letter is in regard to our completeness review of your application for an Amended
Plat for the Terrell Subdivision Exemption. Your request involves a boundary line
adjustment between the two lots in the subdivision exemption. Your property is located
north of the Town of New Castle off of County Road 241 with Assessor's Parcel
Numbers 2125-131-00-034 and 2125-131-00-035.
Our completeness review included input from the County Attorney's Office and has
noted several items that need to be addressed prior to a determination of technical
completeness. In accordance with the Garfield County Land Use and Development
Code, please respond to the following items:
1. The Application needs to include a vicinity map expanded to include an area
within approximately 3 miles of your property. It needs to be formatted on an 81/2 by 11
inch paper for attachment to your public notice.
2. Your submittal should include a waiver request from the requirement for an
Improvements Agreement. Demonstration of compliance with the waiver criteria in
Section 4-118 should also be included. Your narrative already creates a good basis for
requesting the wavier.
3. Your submittal should include a copy of any covenants for the property or clarify
that none exist.
4. A copy of the existing subdivision exemption plat needs to be provided with the
Application.
5. The Application needs to clarify if you currently own all the mineral rights. If you
do not own 100% of the mineral rights, then information on mineral rights ownership
and/or your efforts to research the remaining ownership needs to be provided.
6. The County Attorney has also requested documentation that you are authorized
representatives of the Charles Terrell Loving Trust. Existing documentation for the
Trust and/or an executed and recorded "Statement of Authority" using the County's form
should be acceptable.
7. While not a completeness issue, any information that you have regarding the
past acquisition of additional real estate in 2001 that may have an impact on the plat
and/or legal description of your property would assist in the review of your application.
Once the above information is provided we can finalize our completeness review,
schedule a date for your Director's Decision and proceed with the public notice
requirements. Also, once determined to be complete, you will need to provide
additional copies of the submittal materials to send to referral agencies.
Please note that the Garfield County Land Use and Development Code requires that the
technical completeness issues be resolved within 60 -days of the date of this letter,
otherwise the application will be deemed withdrawn unless a request for extension is
submitted and approved.
