I PROPOSAL
The Applicant is requesting approval of a minor exemption application to allow for the
division of a 10 -acre site into two (2) separate parcels. The site currently has existing
structures that include a single-family home and an accessory dwelling unit (Resolution
2007-36), this division is intended to create individual lots to allow for separate ownership
of each of these units. Both units are currently served by a shared well and shared leach
field though each has an individual septic tank. The application states that a new leach
field would be constructed on proposed Lot 2 so that each lot would have an
independently functioning wastewater system. The existing well would continue to be
shared and the use would be administered by a Well -sharing Agreement.
This application is reviewed pursuant to the Unified Land Use Resolution of 2008, as
amended, Sections 5-202 A. County Exemptions Requiring Platting, Minor (2 Lot)
Exemption; 5-406 General County Exemption Criteria; and Article VII, Standards, as
contained within.
The Applicant has provided information sufficient to determine that this parcel, legally
described as Lot 1, Peach Valley Orchard, has existed in its current configuration since
1909 thus meeting the criteria of existence prior to January 1, 1973.

III RELATIONSHIP TO THE COMPREHENSIVE PLAN
The Comprehensive Plan 2030 establishes broad
uses and densities which will be utilized in land use
decisions. Chapter 2, Future Land Use, evaluates
how best to accommodate future growth types and
densities within the County while retaining diverse
needs such as open space and economic
development. The Future Land Use Map graphically
depicts the anticipated future growth of Garfield
County and designates a density range appropriate to
specific areas. The Peach Valley Orchard
subdivision, 1909, was designated as Residential
Medium Density which recommends a range of 6 -
acres per dwelling unit to Tess than 10 -acres per

outside of the subdivision are in
the Residential Medium High
designation (2 to <6 acres per du).
The Lloyd Parcel consists of
approximately 10 acres which
complies with the FLUM, however
the approval of an accessory
dwelling unit for the site in 2007
caused the property to exceed the
6 to <10 acres per dwelling unit
range recommended by the
Comprehensive Plan. The

subdivision of the property to allow each unit to be owned separately will not increase the
density on the site and the existing non -conformity with the FLUM.
The Comprehensive Plan contains additional components which are to be reviewed for
consistency, including elements including Housing, Transportation, Agriculture, Natural
Resources, and Open Space. The Lloyd Parcel is consistent with many of the
recommended goals and policies including agriculture, water and sewer services and
preservation of natural resources.
IV COUNTY EXEMPTION CRITERIA
The following general exemption criteria (Section 5-406) shall apply to all proposed
exemptions requiring platting.
A. Compliance with Zoning and Use Regulations. The development and use of
Exemption Lots comply with the zoning regulations and use restrictions of this Land Use
Code and the PUD zone designations, if applicable.
1. The resulting Exemption Lots are not illegal or nonconforming Tots under
these Regulations. Any Exemption Lot that is nonconforming shall not
increase its degree of nonconformance.
2. The resulting Exemption Lots contain safe, adequate building sites capable
of complying with applicable use restrictions, criteria and standards set forth
in these Regulations.
B. Not within the Purposes of Subdivision Statutes or This Land Use Code. The
division of land by the exemption processes, detailed herein, is not within the purposes of
the state subdivision statutes, Part 1 of the County Planning and Building Code Act,
C.R.S. §30-28-101, et seq., or the subdivision regulations of this Land Use Code.
C. Adequate Water Supply. The resulting Exemption Lots have a sufficient legal and
physical source of water, in compliance with the requirements of this Land Use Code set
forth in Section 7-105 of Article VII, Standards.
D. Adequate Water Distribution and Wastewater Disposal System. The resulting
Exemption Lots have demonstrated the existence of an adequate water distribution
system and wastewater disposal system in compliance the requirements of this Land Use
Code set forth in Section 7-106 of Article VII, Standards.
E. Adequate Access. The resulting Exemption Lots have legal and adequate access
in compliance with the requirements of this Land Use Code set forth in Section 7-108 of
Article VII, Standards.
F. Hazards. The resulting Exemption Lots do not create hazards identified in Section
7-209 and Section 7-210 of Article VII, or exacerbate existing hazards.
G. Compliance with Comprehensive Plan and Intergovernmental Agreements.

The proposed exemption is generally consistent with applicable provisions of the Garfield
County Comprehensive Plan and any intergovernmental agreements between the County
and a municipality that apply to the area where the division of land will occur. The site
does not specifically conform to the Future Land Use Map designation of Residential
Medium density however the fact that two units currently exist on the site pursuant to land
use permits issued by County, and the fact that the site otherwise conforms to
components of Future Land Use and Chapter 3, Plan Elements, staff has determined that
the exemption proposal is in general conformance with the Comprehensive Plan.
H. Exemption Map Requirements. See the specific requirements for Exemption
Plats at Section 5-502(C)(6) and (C)(7). The following general criteria also applies:
I. Taxes, The Treasurer is required to sign the plat attesting to taxes paid.
V ISSUES AND CONCERNS
A. Comprehensive Plan — The

currently has a density of 5

would not increase or change
with the subdivision of the site
into two parcels.
B. Legal Water — The site (two
units) is currently served by a
well permit augmented by
water purchased from West Divide Water Conservation District. Response from
Janet Maddock with the District stated that an active contract covers two (2)
dwelling unit as well a 15,000 square feet of irrigation (lawn and garden watering)
from a well permitted by #64912-F.
C. Physical Water - A 24-hour pump test was performed on April 26, 2011 by Colorado
River Engineering and determined to satisfy the demands of the two units. Water
quality analysis has also been provided sufficient to determine adequate water
quality pursuant to primary drinking water standards.
D. Well Sharing Agreement — A well sharing agreement has been submitted and will
be finalized prior to Board signature of the plat.
E. Permitting/Construction of new leach field — Jim Rada, Environmental Health, has
recommended that the subdivision of the property be conditioned upon the

permitting of an 1SDS for Lot 2. Each home has a septic tank, however the two
units currently share a leach field — the Applicant has stated that adequate
individual facilities will be constructed. Staff recommends a condition of approval to
assure that this improvement is completed.
F. Plat issues: Amendment to the Exemption Plat is required to comply with ULUR
requirements, the following is a comprehensive list of changes that are required:
1. Required plat notes are recommended as a condition of approval.
2. Required certificates for signatures on the plat are recommended as a condition
of approval.
G. Payment for Fee in -lieu of School Land Dedication and Traffic Impact Fees (zone
14) are required prior to plat signature and recommended as a condition of
approval.
VI PROPOSED FINDINGS
1. That proper notice was provided to adjacent property owners as required by the
Unified Land Use Code of 2008, as amended;
2. That the administrative review was extensive and complete, that all pertinent facts,
matters and issues were submitted and that adjacent property owners had the
ability to be heard regarding this request;
3. That for the above stated and other reasons, the proposed exemption has been
determined to be in the best interest of the health, safety, and welfare of the citizens
of Garfield County;
4. That the application, upon compliance with conditions of approval, has met the
requirements Article V, Division 4 and Article VII of the Garfield County Unified
Land Use Code of 2008, as amended.
VI STAFF RECOMMENDATION
Staff finds the proposed Exemption, upon satisfaction of conditions of approval, complies
with the Garfield County Unified Land Use Code of 2008, as amended, and therefore
recommends that the Director of Building and Planning issue a Determination of Approval
with the following conditions:
1. The Applicant shall include the following text as plat notes on the final
exemption plat:
a. Control of noxious weeds is the responsibility of the property owner.
b. No open hearth solid -fuel fireplaces will be allowed anywhere within an
exemption. One (1) new solid -fuel burning stove as defined by C.R.S. 25-7-
401, et. seq., and the regulations promulgated thereunder, will be allowed in
any dwelling unit. All dwelling units will be allowed an unrestricted number of
natural gas burning stoves and appliances.

c. All exterior lighting shall be the minimum amount necessary and that all
exterior lighting be directed inward and downward, towards the interior of the
subdivision exemption, except that provisions may be made to allow for
safety lighting that goes beyond the property boundaries.
d. Colorado is a "Right -to -Farm" State pursuant to C.R.S. 35-3-101, et seq.
Landowners, residents and visitors must be prepared to accept the activities,
sights, sounds and smells of Garfield County's agricultural operations as a
normal and necessary aspect of living in a County with a strong rural
character and a healthy ranching sector. Those with an urban sensitivity
may perceive such activities, sights, sounds and smells only as
inconvenience, eyesore, noise and odor. However, State law and County
policy provide that ranching, farming or other agricultural activities and
operations within Garfield County shall not be considered to be nuisances so
long as operated in conformance with the law and in a non -negligent
manner. Therefore, all must be prepared to encounter noises, odor, lights,
mud, dust, smoke chemicals, machinery on public roads, livestock on public
roads, storage and disposal of manure, and the application by spraying or
otherwise of chemical fertilizers, soil amendments, herbicides, and
pesticides, any one or more of which may naturally occur as a part of a legal
and non -negligent agricultural operations.
e. All owners of land, whether ranch or residence, have obligations under State
law and County regulations with regard to the maintenance of fences and
irrigation ditches, controlling weeds, keeping livestock and pets under
control, using property in accordance with zoning, and other aspects of using
and maintaining property. Residents and landowners are encouraged to
learn about these rights and responsibilities and act as good neighbors and
citizens of the County. A good introductory source for such information is 'A
Guide to Rural Living & Small Scale Agriculture" put out by the Colorado
State University Extension Office in Garfield County.
2. The Applicant shall amend the proposed exemption plat to include the following:
a. Add a vicinity map;
b. Add the following certificates (attached):
i. Certificate of Taxes Paid;
ii. Board of County Commissioners Certificate;
iii. County Surveyor Certificate.
c. The following easements must be added to the plat:
i. Electric, for the overhead power line;
ii. Access easement for the common driveway;
iii. Water line distribution easement.
3. A well -sharing declaration must be submitted which addresses all easements
and costs associated with operation and maintenance of the system as well as
identifying the person responsible for paying costs and how assessment will be
made for those costs.

4. A driveway sharing agreement shall be submitted that is deemed acceptable by
the County Attorney's office.
5. Prior to Board signature of the plat the Applicant shall obtain an ISDS permit for
Exemption Lot 2 for the construction of a leach field. The permit shall stipulate a
timeframe for completion of the system.
6. The property is located in the RE -2 School District therefore the Applicant shall
be required to pay $200 for the creation of an additional lot. This fee shall be
paid at or prior to the Board of County Commissioners signing the exemption
plat.
7. The property is located in Zone 14 of the Traffic Impact Fee area and therefore
is required to pay fees based upon the traffic generated by one additional single
family lot. This fee shall be paid at or prior to the Board of County
Commissioners signing the exemption plat.
8. The Applicant shall maintain its contract with the WDWCD #SM060921JNT(a)
and ensure that all annual payments required therein are timely paid to
WDWCD.
9. That prior to scheduling the plat for Board of County Commissioner signature,
the applicant shall submit a mylar with signed certificates by all entities except
the Board of County Commissioners, Clerk & Recorder and County Surveyor.
Recording fees will be due and payable at that time as well.
10. Within 90 days of this determination the Exemption Plat shall be signed by the
Chairman of the Board of County Commissioners and recorded in the office of
the Garfield County Clerk and Recorder. The Plat shall meet the minimum CRS
standards for land survey plats, as required by Colorado state law, and
approved by the County Surveyor.

I offer the following comments on that referenced application:
1. The well sharing agreement should be signed and notarized as a
condition of approval.
2. The ISDS for Lot 2 should be installed as a condition of approval.
I agree with Colorado River Engineering as to the need for additional water
treatment on the potable water supply, however, as a private water system,
there is no state regulatory requirements to do so.

Kathy,
We have reviewed the above referenced proposal to divide, by exemption, a 10+
acre parcel into two lots: Lot 1 will be 8.06 acres and Lot 2 will be 2.24 acres. The
applicant proposes to supply both lots with an existing well operating under well
permit no. 64912-F. Individual Sewage Disposal Systems will be used on each lot.
This office will be evaluating this application consistent with SEO Policy 11-1.
Permit no. 64912-F was issued on October 3, 2006 for the Thomas Well. This well
is to operate pursuant to a contract with West Divide Water Conservancy District
and their Silt Mesa Substitute Water Supply Plan or a court approved plan for
augmentation. The uses of this well are limited to ordinary household uses inside
one single family dwelling and one accessory dwelling unit, the irrigation of not
more than 15,000 square feet of home gardens and lawns, and the watering of
four head domestic animals. This permit is valid.
The applicant proposes to utilize a well sharing agreement between the two
parcels. The well uses described in the agreement should not expand beyond
those allowed by the existing permit; any such agreement would not supersede
the limitations of the permit. Currently, the well sharing agreement indicates that
15,000 square feet of landscape watering will be allowed on Parcel One on odd
days of the month and another 15,000 square feet of landscape watering will be
allowed on Parcel Two on even days of the month. This proposal would expand
the irrigation amount to 30,000 square feet. At no point should the applicant be
watering more than 15,000 square feet of home gardens and lawns total. This
office requests that the well sharing agreement be amended to read 7,500 square
feet of lawn and garden irrigation be allowed per lot, or some variation there to
that adds to no more than 15,000 square feet in total.
Once this amendment is complete, this office has no objections to the above
referenced proposal so long as the applicant continues to operate within the
bound of their well permit and their contract with West Divide. Please contact me

BUILDING & PLANNING DEPARTMENT
The Building and Planning Department has reviewed the submittal documentation for
the above referenced exemption application and determined the information to be
technically complete. A determination of technical completeness is not an approval of
the application but a determination that the information submitted is sufficient to
commence the review process. The Minor Exemption process is Administrative,
meaning that here is no public hearing required but that a decision of approval,
approval with condition, or denial will be determined by the Director of Building &
Planning. A date for the Director Determination has been set for August 12, 2011 when
a decision will be issued.
It will be your responsibility, as the Applicant, to complete the required notice to
adjacent properties within 200' of the boundary of Lot 1, Peach Valley Orchard, required
to be sent at least 15 calendar days prior to the Director's date of decision. Attached is
the notice you will send certified mail, return receipt requested, to those adjacent
properties. Prior to the Director's date of decision the County must receive the proof of
mailing and receipt. A draft notice form is attached, please verify the content and make

I am including an outline of the process from this point:
1. The Director Determination is set for August 12, 2011;
2. A referral form is attached which lists the agencies that will review the
information. I will keep you informed as we receive comments related to the
application. I will need 15 additional copies of the application material to send
out — please provide these to our office prior to the end of business on Thursday
July 14th;
3. Notice must be mailed by July 27, 2011 to meet the time criteria;
4. You will provide the proof of mailing and return receipts prior to August 11th

5. On August 12th the Director will render a Decision to approve, approve with
conditions or deny the application;
6. The Board of County Commissioners will be provided notice of the Director
decision. The Board has 10 days to review the application and make a request
for a public hearing;
7. If the time period expires without a request for hearing, the plat mylar may be
submitted for Board signature and recording.
