Board of County Commissioners of Garfield County, Colorado, to exempt by resolu-
tion the division of 'r'' acre tract of land into tracts of
approxi matel 5 acres each, more or lessn from the difinitions of
"subdivision" and "subdivided land" as the terns are used and defined in C.R.S.
(.l973) Section 30-28-l0l (a) - (d) and the Garfield County Subdiv'ision Regu'lations,
for the reasons stated below:

"l ooEXEMPTION
One of the followinq.requirements must be met to qualify for an exemption from theGarfield County Subdivision regulations:
l. The newly created parcel will be for a spouse, son, daughter, or spouseof a deceased child.
2- The subdivided parcel is sp'lit by a public right-of-way (State or Federal
Highway, County Road or Railroad) or natural feature pieventinq joint useof proposed tracts and the division occurs along that public rig[t-of-wayor natural feature.
3. The newly created tract will be ovrned by a public entity or will be used
lo1ey for the purpose of providing access to existing pircels, resultingin the creation of no additional iracts.
4. The conveyance is for the purpose of adjusting property lines, and theconveyed tracts becone part of existing tracti,'there 6eing no new parcelcreated.
5- The proposed tracts were created and separately identified prior to the1st day of September, .l973, or were created ani separately identifiedthrough the exemption process prior to the effective date of this resolution.
-"6- The property being subdivided has been under the same ownership for at-. least five (5) years, and the division together with any earlier permittedunder circumstances not defined above, wiil create no n6re than three (3)
new tracts under 35.0 acres in size.
All new parcels created must meet all requirements of the applicable zone district.
Procedures:
1. Applicant will obtain a copy of the petition for exemption from thePlanning 0ffice.
2- The completed petition for exemption will be returned with the requiredinformation as outlined on the application.
3. Upon review and determination that the application is complete, a neetingwith the Board of County Conmissioners will be set by the ptanning 0ffice.
4. If approved by the Board, a iegal description of each new tract createdwill be furnished to the Planning Departnent within I20 days. A resolutionwill be prepared and signed b-v the Chairman of the Board g-ranting the

The following information will be submitted along with the petition for exemption:
'1. Map drawn to scale showing proposed lot subdivision and access.
?. Copy of deed and letter from property owner, if other than petitioner.

4. Statenent on source of dornestic water to each tract. (Individual well,
community welI, spriDg, cistern, mrrnicipal system, etc.)"
5. Statement on nethod of sewage disposal. (Individual system or community

6. 100 year floodplain information where live stream crosses or adjoins theproposed subdivided Iand.
7. Evidence of the soil lypes and characteristics of each type. (Soil
conservation analysis)
*If community or municipal system wiIl provide service, then letter from thegoverning body stating the witlingness to serve will be provided.
Fee: $50-00 p'lus $1.00 per acre for each parcel created under 35 acres in size.checks will be made payable to "Garfield county Treasurer.,'

We have reviewed the above referenced exemption request. The
wells proposed as the water supply would intercept ground water which
is tributary to Rifle creek, an over-appropriated stream. since new
wells would cause injury to senior vested water rights, well permits
cannot be issued by this office and we cannot recommend approval of
this exemPtion.
