Sketch map at a minimum scale of 1"=200' showing the legal description of the property, dimension and area of all lots or separate interests to be created , access to a public right-of-way , and any proposed easements for drainage , irrigation , access or utilities ; and B . Vicinity map at a minimum scale of 1"=2000 ' showing the general topographic and geographic relation of the proposed exemption to the surrounding area within two (2) miles, for which a copy of U .S.G.S. quad rangle map may be used ; and C. Copy of the deed showing ownership by the applicant, or a letter from the property owner(s) if other than the applicant; and D . Names and addresses of owners of record of land immediately adjoining and within 200 feet of the proposed exemption, mineral owners and lessees of mineral owners of record of the property to be exempted, and tenants of any structure proposed for conversion; and E . Evidence of soil types and characteristics of each type ; and F. Proof of legal and adequate source of domestic water for each lot created , method of sewage disposal , and letter of approval of fire protection plan from appropriate fire district ; and G . If connection to a community or municipal water or sewer system is proposed , a lette r from the governing body stating a will ingness to serve ; and H . Narrative explaining why exemption is being requested ; and I. It shall be demonstrated that the parcel existed as described on January 1, 1973 or the parcel as it exists presently is one of not more than three parcels created from a larger parcel , as it existed on January 1, 1973 . Concerning item A." Sketch map". I have enclosed the final plat of the Dooley subdivision exemption granted in 1998 as it exists in the county records . This plat will give you an overview of the property (labeled exhibit 1). The sketch map (labeled exhibit 2) utilizes the plat and shows all information required for item A for this current requested petition . Concerning items C and I. "Copy of deed showing ownership"; I have enclosed a title search of the properties in the origi n al parcel including the deed of ownership of the original parcel prior to January 1, 1973 . Also enclosed are all deeds of ownership for one parcel sold from the original parcel (original sale July 3, 1973). In 19 98 Lot 1 and Lot 2 were created under the Dooley subdivision exemption. The P lat for this exemption was recorded September 2 , 1998 (reception no . 531630 Garfield County). Lot 1 was th en conveyed from the original Dooley property indicated by warranty deed of June 14, 199 9. At this time I am requesting SB 35 exemption for the remaining Dooley property. (See exhibit 2 : Lots 2 and 3 as indicated on the sketch map of the plat of 1998 .) Concerning item F. "Proof of lega l and adequate source ofDomestic water", I have enclosed my well permit number 201479-A, which is approved for up to (3) single family dwellings . I propose to utilize this well as a shared well for the proposed exemption . The method of sewage disposal shall be septic. Under item G. no connection to a community or municipal water or sewer system is planned . Enclosed also please find a personal check for$ 300.00 as requested. (Copy enclosed) Regarding condition 2 a plat of the property is enclosed . For condition 3 please find a letter from attorney Tom St uver, along with a copy of the recorded well access easement. (Easement book and page number s hown on plat) Concerning condition 7 please find the ( 4) hour pump test along with the well completion report. Jn the well test data ofJ+M pump Co. the pumping rate is indicated along with the written opinion as to the adequacy of the pump for the supply requirements. The water quality test enclosed conducted by Grand Junction Lab indicates the water is within state guidelines for health. Water sharing agreement copy is enclosed . The original is being filed with the recorders office by Mr. Stuver and should have a book and page number this week .. Garfield County BUILDING & PLANNING DEPARTJVJENT RECEIVED FFR 2 f: 2003 GARFIELD COUNTY BUILDING & PLANNING RE: Exemption from the Definition of Subdivision Dear Mr. Dooley, ' As you are aware, on Monday, February 3, 2003, the Board of County Commissioners moved to approve the Dooley Exemption from the Definition of Subdivision with the following conditions: 1. That all representations of the Applicant, either within the application or stated at the v' meeting before the Board of County Commissioners, shall be considered conditions of approval. 2. The Applicant shall submit a final exemption plat indicating the legal description of all the lots created, dimensions and areas (in acres) of the lots, and all easements (such as the access and well easements) encumbering the property. 3. The Applicant shall record a well sharing agreement that governs the water serving Lots 2 and 3, the access easement for the purpose of maintaining access to Lot 3 from CR 225. In addition, the Applicant shall need to amend the well easement between / Richard Murr and Michael Dooley so that it correctly addresses the ability to serve Lot 3 as well as Lot 2. These two documents (well sharing agreement and the well easement shall be consistent with each other) so that legal and adequate water is served to Lots 2 and 3. These easement s shall be recorded in the Clerk and Recorder's Office and shown on the exemption plat with the associated book and page number. 4. That the applicant shall have 120 days to present a plat to the Commissioners for ,/ signature from the date of approval of the exemption. 5. One (1) new solid-fuel burning stove as defied by C.R.S. 25-7-401 , et. seq., and the regulations promulgated thereunder, will be allowed in any dwelling unit. All dwelling units w ill be allowed an unrestricted number of natural gas burning stoves and appliances ". e) "All exterior lighti.qg be the minimum amount necessary and that all exterior lighting be directed inward, towards the interior of the subdivision, except that provisions may be made to allow for safety lighting that goes beyond the property boundaries". , f) "Soil conditions on the site may require engineered septic systems and building foundations ." g) "All residential construction will be consistent with the Colorado State Forest Service (CSFS) recommendations for construction of homes contained in the CSFS publications "Wildfue Protection in the Wildland/Urban Interface" and "Model Regulations for Protecting People and Homes in Subdivisions and Developments." h) "The legal and adequate source of domestic water for Lots 2 and 3, is a domestic well No. 201479, approved by the Colorado State Engineers Office, Division of Water Resources." 6. That all recommendations contained in the S eptember 12, 2002 letter of the Rifle Fire Protection District related to the posting of an address, road construction, and defensible space will be considered conditions of approval. 7. Prior to the approval of an exemption plat, the applicant will demonstrate that the well will meet the following items as applica ble: a) That a four (4) hour pump test be performed on the well to be used. b) A well completion r.eport demonstrating the depth of the well, the characteristics of the aquifer and the static water level. c) The results of the four ( 4) hour pump te st indicating the pumping rate in gallons per minute and information showing drawdown and recharge . d) A written opinion of the person conducting the well test that this well should be ( . • • adequate to supply water to the number o f proposed lots . e) An assumption of an average or no less thah 3 .5 people per dwelling unit, using 100 gallons of water per person, per day . f) The water quality be tested by an approved testing laboratory and meet State guidelines concerning bacteria and nitrate s. g) A water sharing agreement will be filed with the exemption plat that defines the rights of the property owners to water from the well. 8. The applicant shall submit the applicable School Site Acquisition Fees for the creation of the exemptiop parcels prior to approval of the exemption plat; and 9. Submitted herewith you will find the Grant of Easement (original and two copies) from Richard Murr to you for the well easement which s erves the two lots included witlun the exe mption. As you can see it has been recorded in Book 1431 at Page 140 in the o ffice of the Garfield County Clerk and Recorder. Also, submitted herewith i s what I believe t o be the final Well Sharing Agreement ready for your signatures. I respectfully submit that the access easeme11t nee d not be amended because the real property described in the Grant is identical to ~ot Two and Lot Three of the Dooley Subdivision Exemption. The exemption plat, when recorded, establishes thi s identity and there is no reason t o clutter the County real estate records with superfluous documents. Similarly, it is not necessaiy to record a document separate from the subdivision exemption plat and Well Sharing Agreement to establish the access easement or well easement. The well sharing agreement has an internal reference to the well easement which fmther elaborates on its use and maintenance. An immediate attempt at a separate grant of these easements is futile as you ov.n both the dominant and servient parcels and a grant ·wo uld simply result in a merger of title in the ownership as it presently exists . I am confident that the County attorney will analyze this problem in the same manner if asked. After the recording of the subdivision exemption plat, future conveyances of either Lot Two or Lot Three by you and your successors-in-interest 'A-ill make reference to the easements to 'vhich lots are subject and from which they benefit. That is the appropriate way to m a intain the legal existence of the se easements. The pl at, once recorded, offers a legally sufficient way to describe the easements b y r eference. The parties shall cooperate with each other at a ll times in all matter s necessary to promote the proper construction , completion and functioning and use of th e water system in such manner as to provide to th e ir re spec tive use s an optimum water su ppl y on demand at all times possible base d upon the natural availability of water. The parties agree to not waste water and to endeavor to us e no more than their re spective shares of the available water. Waste or over-u se shall be deemed to be a material br eac h of this agreement for which th e non-defaultin g parties may seek remedy at law or equity for damages or for injunctive relief, or both. Irriga tion us es shall be limited to not more than I 0 ,000 sq uare e et of lawn and garde1 o n each parcel. Unless otherwise agreed by each owner, no owner of one of the Lots shall use more th an one-half (Yi ) of th e water legally allocated to the well (i .e.~ 7 .5 g.p.m.). In the eve nt the water physically available from the well is less than the legally available a mount , th en each owner s hall proportionately reduce th e consumption of same to one-half (Yi) the amount ac tually available. In no event shall th e well be pumped at a rate exceeding fifteen ( 15) gallons per minute. Any hou se hold use of th e well water must provide for return flow through an individu a l disposal syste m of the non-eva porative ty pe, returning the water to the watershed in which the we ll is lo ca ted . 4. Michael G. Doo ley and Sharon R. Dooley s ha ll be respon s ib le for the initial cost of constructing th e well system , pump house and any jointly us ed pipe lin es . rollowing the initial construction, the actua l and continu ing costs of operation, maintenance , con s truction , extension, upgrading, cleaning, repairing and a ll other work req uired on shared compon e nts of thi s water system to cause the water at the well to become and remain available to de liver water to the parties shall be shared by the parties in proportion to their s hare i th ct well. Subject to the provi sio ns in paragrap h 4 above, any party vv ho ha s been using water from this system and at any time elec ts not to s ha re in co s ts, nece ssa ry rep a ir s, maintenance , replacement and th e lik e nec essary to maintain the water well and deliver the s ubj ect water, shall not receive water from the system . Typical pedon of Arie very stony loam, 12 to 65 per- cent slopes, about 2,450 feet north and 400 feet east of the southwest corner, section 24, T. 6 S., R. 88 W.: A 1-0 to 10 inches; reddish brown (5YR 4/3) very stony loam, dark reddish brown (5YR 3/3) moist; moder- ate medium granular structure; soft, very friable; 40 percent flagstones; mildly alkaline; gradual smooth boundary. 82-10 to 19 inches; reddish brown (5YR 4/ 4) very stony loam, reddish brown (5YR 3/4) moist; moder- ate medium subangular blocky structure parting to moderate medium granular; slightly hard, very fri- able; 40 percent flagstones; slightly calcareous; moderately alkaline; clear wavy boundary. Cca-19 to 32 inches; reddish brown (5YR 5/4) very stony loam, reddish brown (5YR 4/ 4) moist; mas- sive; hard, very friable; 60 percent flagstones; visible accumulations of secondary calcium carbonate as small lime concretions and as coatings on under- sides of coarse fragments; strongly calcareous; moderately alkaline; clear wavy boundary. Cr-32 to 60 inches; soft reddish brown sandstone and shale. The mollic epipedon ranges from 7 to 15 inches in thickness. Depth to the paralithic contact ranges from 20 to 40 inches. In places this soil is leached to a depth of 7 to 15 inches. Coarse fragments make up 35 to 80 percent, by volume, of the soil. The A horizon has hue of 2.5YR to 5YR, value of 4 or 5 dry and 2 or 3 moist, and chroma of 3 to 6. The B horizon has hue of 2.5YR to 5YR, value of 4 to 6 dry and 3 to 5 moist, and chroma of 3 to 6. The light colored, platy A2 horizon is absent in some pedons. The A horizon has hue of 2.5Y or 1 OYR, value of 5 or 6 dry and 4 or 5 moist, and chroma of 2 to 4. The A horizon ranges from moderately alkaline to very strongly alkaline . The B horizon has hue of 1 OYR or 7.5YR , value of 5 or 6 dry and 4 or 5 moist, and chroma of 2 to 4. The C horizon has hue of 10YR or 7.5YR , value of 5 to 7 dry and 4 or 5 moist, and chroma of 2 to 4. The average annual precipitation is about 12 inches, average annual air temperature is about 48 de- grees F, and the average frost-free period is about 120 days. Typically, the surface layer is moderately alkaline, pale brown loam about 3 inches thick. The subsoil is brown silty clay loam about 14 inches thick. The substratum is light brown or brown silty clay loam to a depth of 60 inches. Included with this soil in mapping are small areas of Limon, Kim, and Heldt soils. Permeability is very slow, and available water capacity is high. Effective rooting depth is 60 inches or more. Organic matter content of the surface layer is low. Sur- face runoff is moderately rapid, and the erosion hazard is severe . This soil is used mainly for wildlife habitat and limited grazing . The native vegetation on th is soil is mainly sagebrush, greasewood, and wheatgrass. When range condition deteriorates, grasses decrease and weedy forbs, cheatgrass, big sagebrush, and greasewood increase. Properly managing grazing main- tains and improves range condition. Seeding improves range in poor condition. Western wheatgrass and tall wheatgrass are suitable for seeding. Preparing a seedbed and drilling the seed are good practices. Irrigat- ing new seedings is necessary for successful establish- ment. Brush should not be reduced because grass pro- duction is low and some desirable native shrubs could be destroyed. The soil formed in alluvium derived from sandstone and shale. The average annual pre c ipitation is about 14 inches, the average annual air temperature is about 48 degrees F, and the average frost-free period is about 120 days. Typically, the surface layer is brown fine sandy loam about 5 inches thick . The subsoil is·· brown and yellowish brown sandy clay loam about 30 inches thick. The sub- stratum is very pale brown sandy clay loam to a depth of 60 inches. Included with this soil in mapping are small areas of Olney and Potts soils that have slopes of 1 to 6 percent. Permeability is moderate, and available water capacity is moderate . Effective rooting depth is 60 inches. Sur- face runoff is slow, and the erosion hazard is moderate. This soil is used mainly for irrigated crops, hay, and pasture. Some areas are used for grazing and wildlife habitat. This soil is irrigated mainly by corrugations. Sprinklers are also suitable. This soil erodes easily . Such practices as minimum tillage, grassed waterways, and tail water control reduce the danger of excessive erosion. Drop structures in irrigation ditches control water and prevent excessive ditch erosion. The native vegetation on this soil is mainly need- lea ndthread, wheatgrasses , and sagebrush . When range condition deteriorates, forbs and shrubs increase. When the range is in poor condition, undesira- ble weeds and annual plants are numerous. Properly managing grazing maintains and improves range condi- tion. Reducing brush also improves the range . Seeding improves range in poor condition. Pubescent wheat- grass, western wheatgrass, and big bluegrass are suit- able for seeding. Preparing a seedbed and drilling the seed are good practices. This deep, well drained, moderately sloping to roll ing soil is on mesas, terraces, sides of valleys, and alluvial fans. Elevation ranges from 5,000 to 6,500 feet. The soil formed in alluvium derived from sandstone and shale. The average annual precipitation is about 14 inc he s, the average annual air temperature is about 48 degrees F, and the average frost-free period is about 120 days. This soil is in cap ability subclass Vile, nonirrigated . 2-Arle-Ansari-Rock outcrop complex, 12 to 65 percent slopes. This complex consists of strongly slop- ing to steep soils and Rock outcrop on mountainsides and sloping alluvial fans . Elevation ranges from 5,500 to 7,500 feet. The soils formed in alluvium derived from red-bed shale and sa ndstone. The average annual pre- cipitation is about 16 inches, the . average annual air temperature is about 42 degrees F, and the average frost-free period is about 100 days. The Arie soil makes up about 45 percent of the com- plex, the Ansari so il makes up about 35 percent, and Rock outcrop makes up about 20 percent. The Arie soi l is moderately deep and well drained. Typically, the surface layer is reddish brown very stony loam about 10 inches t hick. The subsoil and substratum are reddish brown very stony loam about 22 inches thick. Soft reddish brown sandstone and shale are at a depth of 32 inches. Permeability of the Arie soil is moderate , and available water capacity is low. Effective rooting depth is about 20 to 40 inches. Surface runoff is medium, and the erosion hazard is severe . The Ansari soil is shallow and well drained. Typically, the surface layer is reddish brown loam about 1 O inches thick. The substratum is reddish brown stony loam. Bed- rock is hard, reddish brown sandstone. Pe r meability of the A nsari soil is moderate , and availa- ble water capac ity is low. Effective rooting depth is about 10 to 20 inches . Surface runoff is rapid , and the erosion hazard is severe . Rock outcrop is ma inly red sandstone . This complex is used mainly for grazing and wildlife habitat. The native vegetation on the Arie soil is mainly wheat- grass, Indian ricegrass , mountainmahogany , and sage- • SOIL SURVEY brush.
