DANIELSON S tate Engineer Mr. and Mrs. William Fuhst 1748 East Elk Creek Road (County Road 241) New Castle, Co 81647 Subject: Certified Mail P 177 374 581 Water Wells Permit Nos. 68284 and 65l•25 at/n ear The Old Harris Subdivision on East Elk Creek in Garfield County, Water Division 5, Water District 39 On November 28, 1977 The Board Of County Commissioners of Garfield approved RllSOLlfrION No. 77-102. A± 6.15 acre tract was split into two tracts of ± 3.0 acres and± 3.15 acres. It appears the county neglected to refer the proposed water supply plan to the State Engineer as required by Section 30-28 -136(l)(h)I, C.R.S. (1973). Currently three parcels are involved in a water well conflict regarding water service to each parcel. A) County Parcel No. 2125 134 00 022 owned by Bill and Patricia Fuhst (created in Resolution No. 77-102). B) County Parcel No. 2123 183 00 005 owned by Cleyo and Rosie Ferrin (created in . Resolution No. 77-102). This parcel is vacant and currently listed for sale. C) County Parcel No. 2123 183 00 003 owned by Cleyo and Rosie Ferrin. Surveys of this property show two ±5 acre tracts and one ±4.2 acre tract. Deeds show one ±10 acre tract (Book 439, Page 243) and one ±4.2 tract (Book 439, Page 246). Further research on the ±10 acre tract shows two ±5 acre tracts (Book 495, Page 83) recorded 4/5/77 but NOT CREATED THROUGH THE EXEMPTION PROCESS. Review with Garfield county assessors office show taxes are assessed on one ±14.2 acre tract, and to be recognized as three separate parcels it most go through the Exemption p r ocess. To date !.liQ. HOUSEHOLD USE ONLY WELLS exist (Permit Nos. 65425 and 68284) on the three parcels noted above. Both wells have the following conditions of approval: "Approved for household only, for one (1) single family dwelling and not to be used for irrigation. The return flow from the use of this well must be returned to the same stream system in which the well is located." Three homes exist on the subject property's and is described as follows: A) A cabin exists on Parcel No. 2123 183 00 003 (Ferrin) serviced by Permit No. 68284 (HUD). B) Additionally, one single family dwelling exists on Parcel No. 2123 183 00 003 (Ferrin) serviced by both Permit No. 68284 and 65425. 1 • FERRIN/FUHST, AT/NEAR THE OLD HARRIS RANCH ON EAST ELK CREEK IN GARFIELD COUNTY WATER DIVISION 5, WATER DISTRICT 39 • C) One single family dwelling ex i sts on Parcel No 2125 134 00 022 (Fuhst) serviced by Permit No. 65425 (HUO). D) Permit No. 65425 (HUD) exists on Parcel No. 2123 183 00 005 (Ferrin) which is a ±3 acre tract of vacant land and is currently for sale. Additionally, a well sharing agreement is recorded wi th Garfield county (Book 612, Page 569) for this well. The agreement is for an undivided one- half interest in said well. Currently the well sharing agreement is between Fuhst and Ferrin. Please note this well was constructed more than 200 feet from the permitted location, and service s two dwellings each on separate parcels. Additionally, Mr. Ferrin has submitted a new application form (Receipt No. 335569) to correct the location of Permit No. 65425 and is currently pending. Currently the conditions of approyal for each well has been expanded to service two single family dwellings. The expansion of use was not approyed by THH OFFICE OF THE STATE ENGINEER. Tberefore. diyersions from each well are considered to be illegal! At this time one of the following most occur; A) Create a plan of augmentation in water court and permit the existing wells as non-exempt with the Office Of The State Engineer. B) Submit new permit application forms for individual HOUSEHOLD USE ONLY WELLS (Exempt). 1) Regarding Garfield County Resolution No. 77-102 if the ± 6 acre tract was created prior to June 1, 1972 a household use only well may be available to one of the ±3 acre tracts. With the county approving Resolution No. 77-102, an additional household use only well mi..&!!!;. also be available to the second ±3 acre tract. 2) Regarding the Ferrins ±10 acre tract, Well Permit No. 68284 currently exists on this parcel for household use only. If this parcel was created prior to June 1, 1972 and has not previously been subdivided or exempted since 1972, an additional household use only well m.i&ht. be available if a one-time only exemption is approved by Garfield county. Therefore creating two ±5 acre tracts as noted (surveyed/deeded) above. 3) Regarding the Ferrins ±4.2 acre tract, if the parcel was created prior to June 1, 1972 a househo l d use only well may be available. C) Plug and abandon the existing wells. 2 ' • • FERRIN/FUHST, AT/NEAR THE OLD HARRIS RANCH ON EAST ELK CREEK IN GARFIELD COUNTY WATER DIVISION 5, WATER DISTRICT 39 • If no action is taken within 30 days from receipt of this letter, our office will be forced to act pursuant to Colorado Revised Statutes, Section 37-90-llO(l)(d) and issue a cease and desist order to each of the subject wells. The Witzke's will maintain fences, irrigate, maintain pasture , harvest, help with structure repairs and generally oversee all property con- di ti ons. In return, they will be allowed to pasture, keep and ride their horses on the property, plus use the hay harvested for feeding. Mr . Ferrin and Mr. Witzke will construct a barn and hay storage area on the property. Mrs. Ferrin will move her horse back onto the property in the spring, and all horses and property will be checked on a regular bas i s by the Witzke's. During the winter months, most of the feeding and care of the horses will be done by the Witzke's for all horses . Any problems on the property or with the horses will be reported by/t o the Ferrin's or the Witzke's as soon as possible. The Witzke's will not be charged monitarily for pastur i ng or damage done by the horses or tennants , but they will assist with repairs as will the Ferrin's . This is a work/trade agreement . If either party wishes to terminate this agreement a thirty (30) day written/witne ssed notice must be given from one party to the other .
