BEFORE THE BOARD OF COUNTY COMMISSIONERS OF
GARFIELD COUNTY, COLORADO
RESOLUTION NO. 78 - 1/7

WHEREAS, Jerry Fevagg has petitioned the Board of County Commissioners
of Garfield County, Colorado, for an exemption from the definition of the -
terms "subdivision" and "subdivided land" under C.R.S. 1973, 30-28-101 (10.)
(a) -(d) as amended, and the Subdivision Regulations of Garfield County,
Colorado, adopted September 1, 1972 and amended April 14, 1975, Sections
1.02.17 (d) and 3.02.01, for the division of a 14.68 acre tract into two
(2) tracts of approximately 4.68 acres (hereinafter tract "A") and 10.0
acres (hereinafter tract "B"), more or less, and said tracts "A" and "B"
are more particularly described as follows:

Tract "A"
A tract of land situated in U.S. Government Lots 7 and 8 in
Section 33, Township 7South,Range 87 West of the Sixth
Principal Meridian described as beginning at a point in the ..
southerly right-of-way fence line of Colorado State Hiway
No. 82 whence the Southeast Corner of said Section 33 bears
S. 64°11'09" E. a distance of 5,351.797 feet; thence S 01°
15' W. a distance of 1,492.682 feet to the South line of
above U. S. Government Lot 8; thence S. 89°08' W. a
distance of 133.692 feet along the south line of above U.S.
Government Lot 8; thence N. 01°15' E. a distance of 1,537,742 •
feet to the southerly right-of-way fence line of said Colorado
State Highway NO. 83 thence S. 72°09'58" E. a distance of
140.441 feet along said southerly right-of-way fence line of
Colorado State Highway No. 82 to the point of beginning,
containing 4.68 acres, more or less. _
Tract "B"
A tract of land situated in Lots 7 and 8, Section 33,
Township 7 South, Range 87 West of the Sixth Principal
Meridian, in Garfield County, Colorado described as
Highway No. 82 whence the Southeast Corner of Section 33,
Township 7 South, Range 87 West of the Sixth Principal
Meridian bears S. 64°42'53" E. a distance of 5,728.75
feet; thence S. 72°10' E. a distance of 240.034 feet
along the above right-of-way fence line; thence S. 1°15' W.
a distance of 1,537.742 feet to the South line of above Lot 8;
thence S. 89°08' W. a distance of 282,100 feet; thence N.
1°15' E. a distance of 1,294.404 feet to the Southeast Corner
of land described in Doc. ;•7o. 233760 in Book 374 at Page 314
of the records of the Garfield County, Colorado Clerk and
Recorder; thence N. 13°20' E. a distance of 282.220 feet
along the Easterly line of land described in said Doc No.
233760; thence N. 7°37' W. a distance of 46.860 feet along
the Easterly line of land described in said Doc. No. 233760,
to the point of beginning, containing 10.001 acres, more or less.
WHEREAS, the Petitioner has demonstrated to the satisfaction of.the
Board of County Commissioners of Garfield County, Colorado, that he

desires said exemption for the purpose of resale of said tracts into
single-family residential acreage, and;
WHEREAS, the Petitioner has demonstrated to the satisfaction of the
Board of County Commissioners of Garfield County, Colorado, that there is
a reasonable probability of locating domestic water on each of said tracts,
that there is adequate ingress and egress to said tracts, that the loca-
tion of septic tanks will be permitted by the Colorado Department of Health,
that the requested division is in accordance with the general purposes and
intent of the Subdivision Regulations of the State of Colorado and the
County of Garfield, and should, therefore, be exempted from the definition
of the terms "subdivision" and "subdivided land" as set forth in C.R.S.
1973, 30-28-101 (10) (a) -(d) as amended;
NOW, THEREFORE, upon the motion of Richard C. Jolly, seconded by
Eleven J. Cerise, and carried, said 14.68 acre tract of land is hereby
exempted from such definitions and said tract may be divided into two
(2) tracts of 4.68 and 10.0 acres, more or less, all as is more fully
described above, and said divided tract may be conveyed in the form of
such smaller tracts without further compliance with the aforesaid sub-
division statutes and regulations; provided, however, that said exemption
is conditioned on the Petitioner obtaining a proper legal description
of said tracts prior to any conveyance thereof. A copy of the instrument
or instruments of conveyance when recorded shall be filed with this
Resolution.
