BEFORE THE BOARD OF COUNTY COMMISSIONER OF
GARFIELD COUNTY, COLORADO
PETITION FOR EXEMPTION
Pursuant to C.R.S . (1973) Section 30-28-101 (10) (a)-(d ) as amended , and the Subdivision
Regulations/l of Gal 1ld ,£oun,t y, Colorado, adopted April 23, 1984, the undersigne~. L.UJ!,, e f-l~c..her respectfully petitions the Board of County
Commissioners of Garfield County, Colorado, to ex~t by Resolution the division of

approximately 90 Q#-~ acres each, more or less , from the definitions
of "subdivision" and "subdivided land" as the terms are used and defined in C .R.S . (1973) Section 30-
28-101 (10) (a)-(d) and the Garfield County Subdivision Regulations for the reasons stated below :

Sketch map at a minimum scale of 1 "=200 ' showing the legal description of the
property, dimension and area of all lots or separate interests t o be created, access to
a public right-of-way , and any proposed easements for drainage, irrigation, access or
utilities ; and
Vicinity map at a minimum scale of 1 "=2000' showing the general topographic and
geographic relation of the proposed exemption to the surrounding area within two (2)
miles, for which a copy ofU.S .G .S . quadrangle map may be used ; and
Copy of the deed showing ownership by the applicant , or a letter from the property
owner(s) if other than the applicant ; and
Names and addresses of owners of record of land immed iately adjoining and within
200 feet of the proposed exemption, mineral owners and lessees of minerals owners
of record of the property to be exempted, and tenants of any structure proposed for
conversion ; and
Evidence of the soil types and characteristics of each type; and
Proof oflegal and adequate source of domestic water for each lot created, method of
sewage disposal, and letter of approval of fire protection plan from appropriate fire
district ; and
If connection to a community or municipal water or sewer system is proposed, a letter
from the governing body stating a willingness to serve ; and
Narrative explaining why exemption is being requested ; and

I. It shall be demonstrated that the parcel existed as described on January 1, 197 3 or the
parcel as it exists presently is one of not more than three parcels created from a larger
parcel as it existed on January 1, 1973 .

The Board of County Commissioners has the discretionary power to exempt a division of land from
the definition of subdivision and thereby from the procedure in these Regulations, provided the Board
determines that such exemption will not impair or defeat the stated purpose of the Subdivision
Regulations nor be detrimental to the general public welfare . The Board shall make exemption
decisions in accordance with the requirements of these regulations . Following a review of the
individual facts of each application in light of the requirements of these Regulations, the Board may
approve, conditionally approve or deny an exemption . An application for exemption must satisfy, at
a minimum, all of the review criteria listed below . Compliance with the review criteria, however,
does not ensure exemption . The Board also may consider additional factors listed in Section 8 :60
of the Subdivision Regulations .
A. No more than a total of four (4) lots, parcels, interests or dwelling units will be created
from any parcel, as that parcel was described in t he records of the Garfield County Clerk
and Recorder's Office on January 1, 1973 . In order to qualify for exemption, the parcel as
it existed on January I , 1973 , must have been 3 5 acres or greater in size at that time and
not a part of a recorded subdivision; however , any parcel to be divided by exemption that
is split by a public right-of-way (State or Feder al highway, County road or railroad),
preventing joint use of the proposed tracts, and the division occurs along the public right-of-
way , such parcels thereby created may , at the discretion of the Board, not be considered to
have been created by exemption with regard to the four ( 4) lot , parcel, interest or dwelling
unit limitation otherwise applicable . For the purposes of definition , all tracts of land 3 5 acres
or greater in size, created after January 1, 197 3 will count as parcels of land created by
exemption since January 1, 1973 .

INSTALLER TO DETERMINE THE ACTUAL WELL PRODUCTION AND WATER QUALITY. THIS SHOULD
ESTABLISH THE ACTUAL WELL PRODUCTION PARAMETERS WHICH WE CANNOT DETERMINE WHILE
DRILLING.
2. OUR GUARANTEE IS VALID ONLY IF A LICENSED PUMP INSTALLER I NSTALLS THE PUMPING SYSTEM !!
3. On Monitoring/Observation Holes (test holes) it is the customer's responsibility to obtain the proper
permit before the well is put to beneficial use (within one year) or the State may require the hole be plugged
and abandoned. We will be happy to assist you whenever possible in filling out the appropriate well
application.
4. The landowner is ultimately responsible for the plugging and abandoning of dry holes or replaced wells,
according to State Rules and Regulations. Please contact us for details and/or prices.
5. ALL INVOICES DUE AND PAYABLE WITHIN 10 DAYS OF INVOICE DATE. UNLESS PRIOR ARRANGe-
MENTS ARE MADE. A 1.5% HANDLING CHARGE PER MONTH MAY BE ADDED 15 DAYS FROM FIRST

66-Torriorthents-C amborth ids-Rock ouicrop com-1
plex, steep . This broadly defined unit consists of ex~
posed sandstone and shale bedrock, loose stones, and
soils that are shallow to deep over sandstone and shale
bedrock and stony basaltic alluvium. This complex
occurs throughout the survey area . The soils and out-
crops are moderately steep to very steep. Slop e ranges
from 15 to 70 percent.
Torriorthents make up about 45 percent of the com-
plex, Camborthids make up 20 percent, and Rock out-
crop makes up 15 percent. The Torriorthents are on
foothills and mountainsides below Rock outcrop. The
moderately steep Camborthids are on lower toe slopes
and concave open areas on foothills and mountainsides.
Torriorthents are sha llow to moderately deep. They
are generally c layey to loamy and contain variable
amounts of gravel , cobbles, and stones. The surface is
normally covered with stones weathered from the higher-
lying Rock outcrop. South of the Colorado River , basaltic
stones and cobbles are on the surface.
Ca mborthids are shallow to deep. They are generally
cla yey to loamy and have slightl y more cla y in the sub-
soil than in the surface layer. The surface layer is light
colored. The profile is normall y free o f stones. but scat-
tered basalt stones, cobbles, and sandsto ne fragments
are on the surface.
The Rock outcrop is ma i nly Mesa Verde sandstone
and Wasatch sha le . Some areas are covered with basal-
tic boulders and stones. Small areas oi lim estone out-
crops and exposed gypsum are in the eastern part of the
survey area.
Included in mapping are smal l. isolated areas of Ilde-
fonso, Lazear , Ansari , Begay, Held t, and Dollard soils.
These intermittent areas make up 1 O to 20 percent of
this map unit.
T h is complex is used for grazing , wilj life habitat. and
recreation.
The stones on the surface and the steep slopes make
this comple x unsuitable for crops. Some areas can be
reseeded to pasture by broadcast seeding. Other plant-
ing methods are made difficult by the stones and slopes.
The native vegetation includes wheaigrasses, blue-
grasses, Indian ricegrass , need:egrasses. bitterbrush ,
mountainmahogany, sagebrush, and an overstory of
pinyon and juniper.
The value of grazing is fair. The vegetation should be
managed to maintain wood product ion and limited graz-
ing . Selectively thinning the pinyon and juniper [mproves
grazing and provides firewood and posts. Steep slopes,
moderate to severe erosion hazard, anc slow r-egrowth
of trees affect harvesting and management.
, Most of this complex is a prime wintering area for
deer. Rabbits. coyote, and a few elk also find food and
cover on this comple x.
Building is limited by steep slopes and stoniness.
These lim itations can be ov erc ome bv appropriate
desig n and construct io n.
This comp lex is in ca pab ility subclass V il e, nonirrigat-
ed .
67-Torriorthen ts -Ro c k outcrop complex, steep.
Th is rnoad ly defin ed unit consists of exposed sandstone
a nd shale bedrock and stony soils that are shallow to
moderately deep over sandstone and shale and stony
basaltic alluvium. Areas of th is complex occu r throughout
the surve y area. The so ;l s and outcrops are moderately
steep t o ve ry steep. Slo pe ranges from 15 to 70 percent.
T orriorthents ma k e up about 60 percent of this com-
plex , and Rock outcrop ma ke s up 25 percent. The Tor-
riorthents are on footh ills and mountainsides below the
Rock outcrop.
Torriorthents are generally clayey to loamy and con-
tain variab le amounts of gravel, cobbles, anj stones.
The surface is normally covered with ston es we athered
from the higher-lying Rock outcrop. South of the Colora-
do River, stones and cobbles cf basalt are on the sur-
face .
The Rock outcrop is mainly Mesa Verde sandstone

and alluvial fans . Elevation ranges from 5 ,000 to 7,200
fee t. This soil formed ir. calcareous eolian materia l. The

Re: Subdivision Exemption Application for Lucille Fischer
Dear Mark,
Enclosed is a facsimile of Lucille Fischer's exemption proposal which I received from Cheryl Chandler
who is assisting with the application. It's my understanding that Mrs. Fischer is pursuing a boundary
line adjustment which will eventually provide for three lots on her property located at 027 County Road
12 7. One of these lot's incorporates the existing house where she resides and to which we provide
service within the scope of our abilities. Tne other two lots could pote ntially be sold to future
'1 omebui!ders.
In reviewing the 1994 Uniform Fire Code, (UFC), it's apparent that the present nonconforming access
to the property will violate UFC section 902 with the creation of the additional lots. In order for the
other two home sites to meet compliance a prospective builder woul d need to upgrade the road to
meet the intent of the Fire Code as well as County Road Standards er go with Exception I of Uniform
Fire Code article 902 .2.1. This exception allows the Chief to modify the access requirement when these
buildings are completely protected by an a pproved automatic sprinkler system. An approved fixed
water supply capable of delivering the given fire flow need will be required per UFC section 903 in
either of the above scenarios. We feel it's appropriate to enter these options as Conditions of Permit
making th e se items and all other applicable Fire Code provisions the responsibility of 'he builder at the
time of Building Permit application.
We request that, pending approval of the exemption, the above options be noted on the subsequent

WELL SHARL~G AGREEMENT
THIS AGREEMENT, made and entered into this __ th day of ___ , 1998, by and between
__________ ("Lot __ & _ Ov.11er") and _______ (" Lot_ 0VvTier").
WITNESSETH:
WHEREAS, the Lot B 0VvTier owns certain property located in Garfield County, Colorado
described on the attached Exhibit "A" (Lot B); and
WHEREAS, the Lot C Owner oVvTis certain property located in Garfield County, Colorado
described on the attached Exhibit "B" (Lot C); and
WHEREAS, the Lot D OVvTier owns certain property located in Garfield County, Colorado
described in the attached Exhibit "C" (Lot D), and
WHEREAS, there is an existing well located on "Lot C" ("The Well") which is generally
depicted on the attached map (Exhibit "D"). The well is scheduled to provide a domestic water supply
to Lots B, C, and D; and
WHEREAS, a permit has been obtained for an exis t ing well from the Co lorado D ivision of
Water Resources as Permit No . and a well completion report therefore has been filed
with the State Engineer's Office; and
WHEREAS, the Lot OVvTiers desire to set forth in writing the conveyance of rights to and their
agreement concerning the oVvTiership of the well and related improvements, the use and maintenance of
the Well, and the rights and obligations of the parties concerning the Well and the use of the water
therefrom.
NOW, THEREFORE, for and in consideration of the mutual promises contained herein, the
parties agree as follows:
1. The Lot B 0VvTier, Lot C 0VvTier and Lot D 0VvTier shall each oVvTI an undivided 1/3 interest in said
Well, related improvements and water right associated therewith; and the C 0VvTier hereby
quitclaims to Lot B 0VvTier and D Owner, each an undivided 1/3 interest in said well, related
improvements and water right associated therewith. The intent of the foregoing conveyance to be
that the three Lot OVvTiers shall each have an equal right to use an equal amount of the water
produced from the well to provide domestic water supply for one single family residence on each
of the respective Lots to the extent permitted by law.
2. Thereafter, any Lot OVvTier shall have the right to undertake, without the consent of the other
parties, all repairs and improvements reasonably required to alleviate an emergency whereby water
supplies are threatened or cu11ailed by emergency reasons or factors. Non-emergency repairs,
replacements, improvements and activities shall be made by mutual agreement. In the event that
parties can not mutually decide upon what improvement, operation, maintenance, or replacement
activities are necessary and proper, any party may provide notice in writing of a list of repairs,
improvements or replacements, together with a budget therefore. Unless the other parties object in
writing within fourteen (14) days of receipt of said Notice, consent to such shall be deemed
conclusively given . In the event Objection is timely made, the parties agree to mutually select one
qualified professional engineer or well driller to make recommendations and a budget and to be
bound by such recommendations and budget.
3. Each Lot 0VvTier connected to the Well agrees that the combined outside usage of water production
from the Well shall be limited to the irrigation of not more than 43,560 square feet of lawn and
gardens (14,520 sq. ft. each to Lot B, Lot C and Lot D) supplied by the Well (with each party
sharing in such proportionately subject to the reasonable in-house requirements of each lot,
together with car washing and other incidental uses).
4 . In the event that any party experiences water pressure or quantity problems, that party may give
notice to the other parties of their intent and desire to increase well pump capacities and/or to
construct up to 1000 gallons of underground water storage within the easements described in
Paragraph 10, below, Exhibit "B" and Exhibit "E". The storage, pump and related improvements
shall be designed to provide equal benefits to each lot in terms of water pressure and quantity. All
costs and expenses associated with the engineering, design, and construction of such water storage
and related improvements shall be borne equally by the parties connected to the well.

5. The parties agree to pay the common costs of maintenance, and improvement of the well, pump
house and all other appurtenant facilities; each party shall pay all expenses and costs in accordance
with their 1/3 ownership interest. All costs and expenses incurred by one party shall be reimburses
to the paying party within ten (10) days of presentment of written statement of such charges. In
the event any party fails to timely pay such costs, the non-defaulting party may pay the obligation
of the defaulting party, and the party in default shall then owe the non-defaulting party the amount
of the obligation, together with interest on said amount at the rate of eighteen percent (18%) per
annum; provided further that in addition to any other remedies provided by law for the collection
of such costs, the non-defaulting party shall have the right to secure and receive payment of any
sums so advanced with interest, by a lien on a defaulting party's parcel and, in the event
foreclosure of the lien, or any other collection proceeding, the right to reasonable attorney fees and
costs .
6. The parties agree to pay an electrical allowance $5 .00 per month into an escrow account until this
account reaches the balance of $750 . This escrow will be used for repairs and improvements to the
Well. At such time a draw for maintenance is made payment will resume until the balance again
reaches $750. This account shall have all three of the lot owners as authorized Signatures and it
must require the signature of two separate lot owners to make a withdrawal. The place of the
escrow account shall be made by mutual decision of the lot owners.
7. each party shall be solely responsible for all operation, maintenance and capital costs associated
with the delivery of water from the Well to their respective Lots.
8. In the event any party desires to clarify and confirm the legal description of the easement conveyed
in paragraph 10 herein and reduce said conveyance and legal description to writing, said party
may, at his sole option, have a legal description of said casement prepared by a registered surveyor
and convey the easement to the grantee by appropriate instrument, which conveyance shall be
deemed to supersede and satisfy the provisions herein of the said party granting an easement;
provided, however, that the party granting an easement shall provide the grantee with a copy of the
survey upon which the conveyance is based .
9. Notices. All Notices required or permitted hereunder shall be in writing and shall be deemed given
and received when (a) personally delivered, or (b) 48 hours after the same is deposited in the
United States mail, addressed to the other parties at their address appearing on the signature page
hereof or at such address as shall be designated by such other parties by written notice to all the
others .
I 0 . Binding Effect. The rights and obligations of each party set forth herein shall be appurtenant to
their respective Lots, shall not be transferred separate and apart from said Lot, and shall be deemed
covenants running with the land for the benefit and burden of Lots B, C and D and shall be binding
upon heirs, successors, and /or assigns of the parties hereto.
11. Entire Agreement. This agreement contains the entire agreement of the parties concerning the
subject matter herein and supersedes all prior agreements, if any.
12. Counterparts . This Agreement may be executed in multiple parts as originals or by facsimile copy;
provided however, if executed and evidence of execution is made by facsimile copy, then an
original shall be provided to the other party(ies) upon request. When all of the parties to this
contract have signed at least one copy, such copies together will constitute a fully executed and
binding contract.

I 901.6 Fire Protection in Recreational Vehicle, Mobile Home and Manufactured Housing

SECTION 902 -FIRE DEPARTMENT ACCESS
902 .1 General. Fire department access roads shall be provided and maintained in accordance
with Sections 90 l and 902.
902.2 Fire Apparatus Access Roads.
902.2.1 Required access. Fire apparatus access roads shall be provided in accordance with Sec-
tions 901 and 902.2 for every facility, building or portion of a building hereafter constructed or
moved into or within the jurisdiction when any portion of the facility or any portion of an exterior
wall of the first story of the building is located more than 150 feet ( 45 720 mm) from fire apparatus
access as measured by an approved route around the exterior of the building or facility. See also
Section 902.3 for personnel access to buildings.
EXCEPTIONS: I. When buildin gs are completely protec te d with an approved automati c fire sprinkler
system, the provisions of Sections 902.2.1 and 902.'.P ma y be modified by the chief.
2. When access roads cannot be installed due to location on property, topography, waterways, nonne go-
tiable grades or other similar conditions, the chief is authorized to require additi onal fire protection as specified
in Section I 001.9.
3. When there are not more than two, Group R. Divi s ion 3, or Group U Occupancies, the requirements of
Sections 902.2. I and 902.2.2 may be modified by the chief.
More than one fire apparatus road shall be provided when it is drtermined by the chief that acces s
by a single road might be impaired by vehicle congestion, condition of terrain, climatic conditions
or other factors that could limit access.
For high-piled combustible storage, see Section 8102.5 .1.
For required access during construction, alteration or demolition of a building, see Section
8704.2. ,-
902.2.2 Specifications.
902 .2.2.1 Dimensions. Fire apparatus access roads shall have an unobstructed width of not less
than 20 feet (6096 mm) and an unobstructed vertical clearance of not less than 13 feet 6 inches (4115
mm).
EXCEPTION: Vertical clearance may be reduced , provided such reduction does not impair acce ss by fire
apparatus and approved signs are installed and maintained indicating the established vertical clearance when
approved by the chief.
Vertical clearances or widths shall be increased when, in the opinion of the chief, vertical clear-
ances or widths are not adeq uate to provide fire apparatus access .
902.2.2.2 S u rface. Fire apparatus access roads shall be designed and maintained to support the
imposed loads of fire apparatus and shall be provided with a surface so as to provide all-weather
driving capabilities.
902.2 .2.3 Turning radius. The turning radius of a fire apparatus access road shall be as approved
by the chief.
902.2.2.4 Dead ends. Dead-end fire apparatus access roads in excess of 150 feet (45 720 mm) in
length shall be provided with approved prov isions for the turning around of fire apparatus.
