RESOLUT ION +'t't-7 -35
I^IHEREAS, MOUMAIN VALLEY DE\ruLOPMEM, INCORPORATED has petitioned the Board
of County Comnissioners of Garfield County, CoLorado, for an exemption under C.R.S.
30-28-101(10) (c) (WII) (d) anri 3.02.01 of the Garfield County Subdivision Regulations
of a lease from petitioner to Wtrolesale Market, Inc. dated December L, 1916 covering
0.18 acre of a 1.3277-acre tract, both tracts being more particularly described on
Exh. A:
WHEREAS, the Petitioners have shown to the satisfaction of the Board of Cor:nty
Commissioners of Garfield County, Colorado, that they desire said exemption for the
purpose of leasing said 0.18-acre tract; and
WIIEREAS, petitioner has demonstrated to the satisfaction.of the Board that
there is domestic water on each of said tracts, that there is adequate ingress and
egress to said tracts, that searage taps to the City of Carbondale system are in place,
that the requested exemption is in accordance with the general purposes and intent of
the subdivision regulations of the State of Colorado and the County of GarfieLd and
that said lease shoul-d therefore be exempted from the definition of the temrs
rreubdivisionrrand subdivided 1and" as set forth in C.R.S.3O-28-1.01(1'O)(a)-(d) as
anended';
N0W, THEREFORE, upon motion of Dl..v rr,-r Cf v i.\e seconded by
L and unanimousl y carried said 1.3277-acre tract of
I'and is hereby exempted from such definition as to the lease of said 0.18 acre tract
thereof, all as is more fully described in the Petition pertalning hereto, and
further that additional buiLding permits for the balance of the L.3277-acre tract
wil'1 not be issued unless Garfield County Subdivision regulations are adhered to,
or an additional exemption thereunder is obtained. A copy hereof sha11 be recorded
with the Clerk and Recorder of Garfield County.
