One of the following requirements must be met to qualify for an exemption from the Garfield County Subdivision regulations: 1. The newly created parcel will be for a spouse, son, daughter, or spouse of a deceased child. 2. The subdivided parcel is split by a public right-of-way (State or Federal Highway, County Road or Railroad) or natural feature preventing joint use of proposed tracts and the division occurs along that public right-of-way or natural feature. 3. The newly created tract will be owned by a public entity or will be used solely for the purpose of providing access to existing parcels, resulting in the creation of no additional tracts. 4. The conveyance is for the purpose of adjusting property lines, and the conveyed tracts become part of existing tracts, there being no new parcel created. 5. The proposed tracts were created and separately identified prior to the 1st day of September, 1973, or were created and separately identified through the exemption process prior to the effective date of this resolution. 6. The property being subdivided has been under the same ownership for at least five (5) years, and the division together with any earlier permitted under circumstances not defined above, will create no more than three (3) new tracts under 35.0 acres in size. All new parcels created must meet all requirements of the applicable zone district. Procedures: 1. Applicant will obtain a copy of the petition for exemption from the Planning Office. 2. The completed petition for exemption will be returned with the required information as outlined on the application. 3. Upon review and determination that the application is complete, a meeting with the Board of County Commissioners will be set by the Planning Office. 4. If approved by the Board, a legal description of each new tract created will be furnished to the Planning Department within 120 days. A resol- ution will be prepared and signed by the Chairman of the Board granting the exemption. The following information will be submitted along with the petition for exemption: A. Map drawn to scale showing proposed lot subdivision and access, existing homes, wells, etc. B. Copy of deed and letter from property owner, if other than petitioner. C. Vicinity map with the total property acreage outlined (copy of USGS quadrangle map showing property location or equivalent). D. Statement on source of domestic water to each tract (individual well, community well, spring, cistern, municipal system, etc.) If a community or municipal system will provide service, then a letter from the governing body stating the willingness to serve the parcels must be provided. Please indicate clearly whether you are referring to proposed or existing service. E. Statement on method of sewage disposal (individual system or community system). All installation must comply with all requirements of the County Individual Sewage Disposal Regulations, adopted pursuant to au- thority granted in 66-44-4, CRS 1963, amended 66-3-14, CRS 1963. 2. This permit is valid only for connection to structures which have fully complied with County zoning and building requirements. Connection to or use with any dwelling or structures not approved by the Building and Zoning office shall automatically be a viola- tion of a requirement of the permit and cause for both legal action and revocation of the permit. 3. Howard if Garfield County Environmental Health Department DATE: May 24, 1982 SUBJECT: Bill Clough exemption for Northwest Pipeline pipe yard According to the Garfield County Individual Sewage Disposal Regulations, any commercial operation is suppose to have an engineer designed system. In this case it will probably be a mere formality of having the applicant take the specific- ations for the existing system to a registered professional engineer and having him write a letter stating whether the system is adequate to handle the additional use. As long as the uses of the system are limited to treatment of wastes from bathrooms and showers, no industrial waste is treated and the system is adequately sized, I don't anticipate any objections from this office to tying the guard trailer into the existing system. Milner Garfield County Building Official 2014 Blake Avenue Glenwood Springs, CO 81601 Dear Mr. Bud: Bill Clough has applied for a five acre exemption to lease the parcel to Northwest Pipeline so that they can acquire a Mobile Home Special Use Permit and have a "resident guard" next door to their pipeline laydown area west of Rifle. Clough is proposing to serve the 5 acre parcel with the existing septic system now utilized by the pipeline office building. Is this possible?
