AMENDED PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as amended, and
the Subdivision Regulations of Garfield County, Colorado, adopted January 2, 1979
Section 2.02.01 (d) and 3.02.01 the undersigned W. F. Clough, individually and GPR
of the Estate of Iva H. Clough, Deceased
respectfully petitioners the
Board of County Commissioners of Garfield Courjty, Colorado, to exempt by resolu-
tion the division of a 158.23 acre tract of land into 2 tracts of
approximately 136.43 & 21.80 acres each, more or less, from the difinitions of
"subdivision" and "subdivided land" as the terms are used and defined in C.R.S.
(1973) Section 30-28-101 (a) - (d) and the Garfield County Subdivision Regulations,
for the reasons stated below: Petitioner has agreed to sell or exchange a 158.23 acre
tract to Cathedral Bluffs Shale Oil Company (CB) a Colo. partnership, which concurrently
has assigned its interests thereunder a . - • '

covering 21.80 acres to Rio Grand Land Company, a Colo. Corp., retaining Parcel 2 coverin

and which are to be conveyed per the agreement by 3 separate deeds.
In support of this petition, the petitioner also submits the following:

Pursuant to C.R.S. (1973) Section 30-28-101(10)(d) as amended, and the

and amended April 14, 1975, Sections 1.02.17(d) and 3.02.01, the undersigned
W. F. Clough, individually and as PR of the
Estate of Iva H. Clough, Deceased respectfully petitions the Board
of County Commissioners of Garfield County, Colorado, to exempt by resolution
a 21.80 -acre tract
, more fully hereinafter described, from the
definitions of "subdivision" and "subdivided land" as the terms are used and
defined in C.R.S. (1973) Section 30 -28 -101.(10)(a) -(d) and the Garfield County
Subdivision Regulations, for the reasons stated below:
Petitioner desires to sell a 161.52, plus or minus -acre parcel which is the
subject of the Board's Resolution Nos. 80-178 to Cathedral Bluffs Shale Oil
Company (CB) to be conveyed by 3 deeds, one deed for each of 3 parcels as
shown on attached plat with Parcel 1 covering 99.72 acres and Parcel 3 covering
21.80 acres to then be conveyed by CB to the Denver & Rio Grande Western Rail-
road Co., CB retaining Parcel 2 covering 40.0 acres.

Dear Ray:
Enclosed is Petition for Exemption in connection with the pending
transaction between W. F. Clough, individually and as PR of the Estate of
Iva H. Clough, Deceased, as Seller, and Cathedral Bluffs Shale Oil Company,
as Buyer, together with check in the amount of $72.00 payable to the
Garfield County Planning Department to cover the filing fee.
As indicated on the Petition, it is contemplated that Clough will
convey to Cathedral Bluff Shale Oil Company(CB) the entire parcel covering
approximately 161.52 acres(the plat attached to the Petition shows a total
of 160.84, but the individual parcels add up to 161.52) to be conveyed by
three separate deeds, it being contemplated that concurrently with the
closing of such transaction, there will be a separate closing at which CB
conveys to the Denver & Rio Grande Western Railroad Company Parcels 1 and 3.
Because of the way the transaction is structured the exemption should run,
as I see it, to both Clough and CB. I trust you find everything in order,
but if not, please advise.

X33BC-Arvada loam, 1 to 6 percent slopes. This is a deep, well
drained soil on sloping fans and high terraces. It forzued in highly
saline alluvium from sandstone and shale. Elevation ranges from 5,100
to 6,200 feet. The average annual precipitation is about 12 inches, the
average annual air temperature is about 48 degrees F., and the average
frost -free period is about 120 days.
Typically, the surface layer is pale brown loam about 3 inches
thick. The subsoil is brown silty clay loam about 14 inches thick.
The substratum is light brown or brown silty clay loam that extends
to a depth of 60 inches or more.
Included with this soil in mapping are small areas of Limon, Kim,
Heldt, and Wane_soils all on similar slopes. Also some areas high in
silt are included.
Permeability of the Arvada soil is moderately slow. Effective
rooting depth is 60 inches or more. Available water capacity is high.
Organic matter content in the surface is low. Surface runoff is medium
and the erosion hazard is moderate.
This soil is used mainly for wildlife habitat, limited livestock
grazing, and some irrigated farming.
Irrigation methods suitable for this soil are borders, furrows,
and corrugations. Leaching is a requirement to remove excess salts when
this soil is irrigated. Commercial fertilizers containing sulfates
and carbonates are preferred to obtain reasonable production of alfalfa,
corn, and small grains.
X33BC-Arvada loam 2
The native vegetation on this soil is mainly saltgrass, western
wheatgrass, alkali sacaton, and greasewood.
When the range condition deteriorates, forbs and woody shrubs increase.
Proper grazing management maintains and improves range condition. Seeding
is advisable if the range is in poor condition. Suitable plants for
seeding are western wheatgrass, alkali sacaton, and tall wheatgrass.
For successful seeding, a good practice is to prepare a seedbed and
drill the seed. Temporary irrigation of a new seeding may be required
for successful establishment. Reduction in brush improves deteriorated
range sites, provided there is adequate grass understory.
Arvada soil is used by cottontail rabbits and pheasants for
shelter when they can obtain food from surrounding areas.
This soil has poor potential for sanitary facilities, community
development, and source material. The high shrink -swell potential,
slow permeability, and soil salinity are the main limiting features.
