III.MAJOR ISSUES AND CONCERNS
Garfield county approved an Exemption creating this 11'87 acre

#g2-75. Based on the Subdivision Regulations, the proposed
division would be Lhe last allowed by exemption on these parcels
and a plat note should be included stating this fact.

The applicants currently utilize a single weII and irrigationditch rights to serve the existing uses with water. The Divisionof Water Resources has questioned the legality of using thepresent weII for the farm eguipment sales yard and the livestockauction barn. Apparently the well permit is only valid for thefarm eguipment sales yard. The applicant should establish theIegality and adequacy of these water sources to serve the
separate parcels as reguired by the Subdivision Regulations.
The Special Use permit was issued for a single agriculturalrelated business that includes a farm sales eguipment yard andIivestock auction barn. The County Attorney has expressed aconcern about the legalit.y of splitting a special use rnto two
separate uses, without going through the appropriate proceduresrecognizing the split. This j-ssue needs to be resolved prior tosigning an exemption plat.
