The site is located in District C - Rural Areas / Minor Environmental Constraints as
designated on the Garheld County Comprehensive Plan Management Districts' Map.
I DESCRIPTION OF THE PROPOSAL
A.Site Trescrintion: The parcel is bordered on the west by County Road 250 and
on the south by County Road 2lL,norlhwest of the Town of Silt. The parcel is
relatively flat, and is dominated bynative grasses, typical ofhistoric agricultural
land. The parent parcel includes an existing single story house (approximately
40 to 50 years old) and several outbuildings associated with the agricultural uses

Adjacent land uses include irrigated agricultural land and single family

Project DescriFtion: The applicant is requesting an exemption to split the 40
acre parcel into two Q) 20 acre parcels. The applicant has submitted a sketch
plan indicating the proposed split and the location of the existing home. The
eastern exemption parcel would require an ac@ss easement from County Road

[I. MAJOR TSSUES AND CONCERNS
A.Subdivision Regulations. Section 8.52 ol the Garheld County Subdivision
Regulations state lhat" "No more than a total offour (4) lots, parcels, interests
or dwelling units will be created from any parcel, as that parel was described in
the records of the Garfield County clerk and Reoorder's OIIice on lanuary 1,
1973, and is not a part of a recorded subdiuision; however, any parcel to be
divided by exemption that is split by a public right-ofway (State or Federal
h i gh way, Co u n ty ro a d or rail ro a d) or n a t ural fea t wq preven ti n g jo i n t us e of th e
proposed tracts, and thediuision occursalong thepublicright-o-frwayornatural
feature, such parcels thereby created may, in the discretion of the Board, not be
considered to have ben created by exemption with regard to the four (4) lot,
parcel, interest or dwelling unit limitation otherwise applicable;
The applicant has submitted a deed (Book 376,Page 95) indicating the parent
parcel consisted of 40 acres in May of 1966. Therefore, up to four (4) parcels
may be created through the exemption process.
Zoning. Both parcels are consistent with the two (2) acre lot minimt'm lot size
for the A/R/RD zone district, and the existing residence meets all setback
requirements. All of the parcels created surpass the two (2) acre lot minimum
for the A/R/RD zone district.
Legal Access. No access easements are necessary for the exemption parcel,
however a driveway permit from County Road 2l4wtllbe necessary prior to the
signing of a flrnal plat.
Water and Sewer. The applicant currently has a well permit approving the
expansion of the existing well to accommodate an additional dwelling unit on
the exem ption parcel @ermit Number 169086, issued March 18, 1993, see page
Sewage disposal for all the existing dwelling is ISDS. The Soil Survey for the
Rifle Area (Soil Conservation Service, 1977) classifies the soils on the site to
include Potts loam and Potts-lldefonso. These soil types are considered to
present only slight or moderate constraints to ISDS systems, and can be
addressed by proper design.
State and Local Health Standards. No State or Local health standards are
applicable to the application.
Drainage. No drainage easements appear to be necessary due to the relative flat
profile of the parent parcel.

Easements. A waterline easement from the existing wellhead must appear on the
final plat.
School Impact Fees. The additional lot is subject to the required $200.00 per lot
school impact fee.
Natural Hazards. Staffreferenced the Lincoln - Devore Laboratories Natural
Hazards Mapping for the site, which indicated that the site is not in an area of
Soil, Slope, or Groundwater/Septic System constraints.
TV. SUGGESTED FTNDINGS
I That proper posting and public notice was provided as required for the meeting
before the Board of County Commissioners.
That the meeting before the Board of County Commissioners was extensive and
complete, that all pertinent facts, matters and issues were submitted and that all
interested parties were heard atthat meeting.
That for the above stated and other reasons, the proposed exemption is in the
best interest of the health, safety, morals, convenience, order, prosperity and
welfare of the citizens of Garfield County.
V. RECOMMENDATION
Staffrecommends APPROVAL ofthe application, subject to the following conditions:
That all representations of the applicant, either within the application or stated
at the meeting before the Board of County Commissioners, shall be considered
conditions of approval.
A Final Exemption Plat will be subnritted, indicating the legal description of the
property, dimension and area of all proposed lots or separate interests to be
created, access to a public right-of-way, and any proposed easements for
drainage, irrigation, access or utilities.
That the applicant shall have 120 days to present a plat to the Commissioners
for signature. Extensions of time may be granted if requested prior to the
expiration date.
That the applicant submit 5200 in School lmpact Fees for the creation of each
new lot.
A driveway permit from County Road 214 shall be obtained from the Road and
Bridge Department prior to the issuance of a building permit.
6. Control of noxious weeds is the responsibility of the property owner.

CONDMONS OF APPHOVAL
1) This well shall be used in such a way as to cause no material injury ro existing water rights. The i*suance of thepermit does not assure the applicant that no iniury will occur to another vesfud water right or preclude anotherowner of a vested water right from seeking relief in a civil court aclion.
2) The construction of this well shall be in compliance with the Water Well Construction and pump lnstallation Rules2 CCR 402'2, unless approvat of a variance has been granted by the State Board of Examiners of Water WellConstruction and Pump lnstallation Contraclors in accordance with Rule 17.
3) Approved pursuant to cRS 37-92€02(3)(bxlD(A) for the expansion of use of an existing we[, permit no. 66160,and as the only well on a tract of land of 40 acres described as the sw 1/4 of the sw tia oi sec. 32, Twp. 5South, Rng. 91 West of the 6th P.M., Garfield County. The issuance of this permit hereby cancels permit no.66't60.
4) The use of ground water from this well is limited to ordinary household purposes inside two (2) single famitydwellings, fire protection, lhe watering of pouhry, domestic animals, and livestock on farms and ranches, and theirrigation of not over one (1) acre of home gardens and rawns.
5) The maximum pumping rate shall not exceed 15 GpM.
6) The return llow from the use of the welt must b€ through an individual waste water disposal system of thenon-€vaporative type where the water is returned to the same stream system in which the welt is located.
