BEFORE THE BOARD OF COUNTY COMMISSIONERS OF
GARFIELD COUNTY, COLORADO
PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) Section 30-28-1O1(1O)(a) - (d) as amended,
and the Subdivision Regulations of Garfield County, Colorado, adopted
September 1, 1972 and amended April 14, 1975, Sections 1.O2.17(d) and
3.02.01, the undersigned Joe F. Kline and Paul W. Fischer
respectfully petitions the Board of County Commissioners of Garfield
County, Colorado, to exempt by resolution see Exhibit A (attached)
,
more fully hereinafter described, from the definitions of "subdivision"
and "subdivision land" as the terms are used and defined in C.R.S. (1973)
Section 30-28-1O1(a) - (d) and the Garfield County Subdivision Regulations,
for the reasons stated below:
1. Paul N. Fischer and Joe F. Kline each own 1 interest in the
above 9 acres. In order to obtain a, building loan, each must
own full interest in of the land.
2. Land has no agricultural uses at this time. It is suitable
for division in the manner shown in Exhibit A, because it is
rolling terrain. Covering is sagebrush and pinon. If two
houses are built (one on each division) one house will not be
visible by the other. And only one house will be seen from the
county road. There is BLM adjacent to each property which will
supply ample green belts.
3. There are road and power easements to the property. Road has
been constructed. Water available at approximately 50 feet

4. This property lies so that it is physically seperated
from adjacent properties.
5. Mr. Fischer and Mr. Kline would both like to build a
home on this property that they have owned for the past
seven years.
6. This land has also been taxed at residential rates for
the past three years.

Beginning at a point on the East-West centerline of said Section 17, whence the East
Quarter corner being a stone found in place bears: S. 89°38'31" E. 1283.83 feet;
thence N. 89°38'31" W. 213.38 feet along said East-West centerline; thence N. 10°16'
34" W. 734.00 feet; thence N. 89°37'21" E. 330.00 feet; thence S. 01°07'58" E. 725.88
feet to the Point of Beginning'.. Above described parcel of land contains 4.51
acres, more or less.
