RESOLUTION `j-.
WHEREAS, JOE F. KLINE and PAUL W. FISCHER have petitioned the Board of
County Commissioners of Garfield County, Colorado, for an exemption under C.R.S.
(1973) Section 30-28-101 (10) (a) - (d) as amended, and the Subdivision
Regulations of Garfield County, Colorado, adopted September 1, 1972 and amended
April 14, 1975, Sections 1.02.17 (d) and 3.02.01, for the division of a 9.01
acre tract into two tracts of approximately 4.50 and 4.51 acres, more or less,
and said parcels are more particularly described as follows:
Parcel No. 1
A parcel of land situated in the SW' NES of Section 17,
Township 7 South, Range 88 West of the Sixth Principal
Meridian; said parcel of land is described as follows:
Beginning at a point on the East-West centerline of said
Section 17, whence the East Quarter corner being a stone
found in place bears: S. 89° 38' 31" E. 1283.83 feet;
thence N. 89° 38' 31" W. 213.38 feet along said East-
West centerline; thence N. 100 16' 34" W. 734.00 feet;
thence N. 89° 37' 21" E. 330.00 feet; thence S. 010 07'
58" E. 725.88 feet to the point of beginning. Above
described parcel of land contains 4.51 acres, more or
less.
Parcel No. 2
A parcel of land situated in the SW1/4NE1/4 of Section 17,
Township 7 South, Range 88 West of the Sixth Principal
Meridian, said parcel of land is described as follows:
Beginning at a point on the East-West centerline of
said Section 17, whence the East quarter corner being a
stone found in place bears: S. 89° 38' 31" E. 1283.83
feet; thence N. 89° 38' 31" W. 426.76 feet along said
East-West centerline to the true point of beginning;
thence N. 19° 00' 21" W. 760.16 feet; thence N. 89° 37'
21" E. 330.00 feet; thence S. 10° 16' 34" E. 734.00 feet
to a point on said East-West centerline; thence N. 890
38' 31" W. 213.38 feet along said East-West centerline
to the true point of beginning. Above described parcel
of land contains 4.50 acres, more or less.
WHEREAS, the Petitioners have demonstrated to the satisfaction of the Board
of County Commissioners of Garfield County, Colorado, that they desire said
exemption for the purpose of re -sale into single-family residential acreage;
and,
WHEREAS, the Petitioners have demonstrated to the satisfaction of the Board
of County Commissioners that there is a reasonable probability of locating
domestic water on each of said tracts, that there is adequate ingress and
egress to said tracts, that the location of septic tanks will be permitted by
the Colorado Department of Health, that the requested division is in accordance

with the general purposes and intent of the Subdivision Regulations of the
State of Colorado and the County of Garfield and should, therefore, be exempted
from the definition of the terms "subdivision" and "subdivided land" as set
forth in C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as amended;
NOW THEREFORE, upon motion of deli v 4 e j o H e cf seconded by
(erisc_ and carried, said 9.01 acre tract of land is
hereby exempted from such definition and transfer of said tract of land may be
made by division into two tracts of 4.51 and 4.50 acres, more or less, all as is
more fully described above. A copy of the instrument(s) of conveyance when
recorded shall be filed with this Resolution.
