Johnson A tract of land situated in Section 19, T7S, R87W and Section 24, T7S, R88W; located approximately 4 miles east of Carbondale off C.R. 103. The site consists of a 170.19 acre tract. Existing and proposed individual wells. Individual Sewage Disposal Systems ACCESS: County Road 103 EXISTING ZONING: A/R/RD ADJACENT ZONING: A/R/RD I. RELATIONSHIP TO THE COMPREHENSIVE PLAN The site is located in District C, Rural Areas with Minor Environmental Constraints, as designated on the Comprehensive Plan Management District's Map. II. DESCRIPTION OF THE PROPOSAL A. Site Description: The site is located in a rural portion of the County with land uses on the site and in the vicinity primarily single family residential and agricultural. One lot is currently vacant, while the other has a single family residence, cabin for a ranch hand, several accessory buildings and existing wells and septic systems. Slopes on the site are moderate with several streams, irrigation ditches and a small lake located on the western portion of the site. County Rd. 103 crosses the eastern portion of the site. B. Project Description: The applicant proposes to divide the 170.29 acre tract into two lots of approximately 8.74 acres, and 161.55 acres in size, based on their division by the County Rd. The existing improvements and lake will be located on the larger lot. C. History: The applicant has submitted evidence that the overall tract has existed since prior to 1973 with no subdivision occurring since that time. Apparently, portions of several adjoining tracts have been purchased by the applicant and merged with the overall 170 acre tract. III.MAJOR ISSUES AND CONCERNS 1. The application has been referred to the State Division of Water Resources with no comments received at this time. 2. The Carbondale & Rural Fire Protection District has submitted comments on fire protection. (See page /7 3. The applicant has represented that he would be submitting the existing well permits for the larger tract. Requests to the Division of Water Resources for an additional well permit have been made by the applicant and are pending. • • Page Two 3. Soil Conservation Service information on the site indicates that the main limitation for homesite development is slopes and stones in soil. 4. While the applicant has not had any previous exemptions on the site, the request is for approval based on division by a public right-of-way in accordance with Section 8:52A of the Garfield County Subdivision Regulations. IV. SUGGESTED FINDINGS 1. That proper posting and public notice was provided as required by law for the meeting before the Board of County Commissioners. 2. That the meeting before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted, and that all interested parties were heard at that meeting. 3. That for the above stated and other reasons, the proposed exemption is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. V. RECOMMENDATION APPROVAL, with the following conditions: 1. That the applicant submit evidence of a domestic water source for each of the proposed tracts, consisting of well permits or other verification acceptable to the Board of County Commissioners. 2. That all properties included under this application shall be considered to have merged for the purpose of subdivision, and that any future divisions will be required to conform with the Garfield County Subdivision Regulations. 3. That the applicant obtain a driveway access permit for the 8.74 acre lot or a letter from the Garfield County Road and Bridge Department indicating they would issue such a permit at some future date. Any new or improved driveway access shall include culverts capable of substantially supporting a 56,000 lb. fire truck, should culverts be necessary. 4. That the proposed division of the tract shall occur along the County Road and therefore the creation of 8.74 acre parcel shall not be counted toward the four lot limit on subdivision exemptions. 5. That the applicant submit $200 in School Impact Fees for the creation of one new lot. 6. That all representations of the applicant, either within the application or stated at the meeting before the Board of County Commissioners, shall be considered conditions of approval. I WOULD LIKE TO OFFER THE FOLLOWING COMMENTS REGARDING THE SUB -DIVISION EXEMPTION, AS BILL AND I HAVE PREVIOUSLY DISCUSSED. ACCESS TO BOTH PARTS OF THE SUB -DI VISION WILL BE ACCESSIBLE TO FIRE TRUCKS FROM THE CARBONDALE FIRE DEPT. IF ANY CULVERTS ARE PLANNED THEY SHOULD BE CAPABLE OF SUPPORTING A 56, 000 LB. FIRE TRUCK. RESPONSE TIME TO THE SUB -DIVISION IS APPROXIMATELY 15 TO 20 MINUTES ON GOOD ROADS. RESPONSE WILL BE FROM THE CARBONDALE FIRE STATION L OCA TED SOUTH OF CARBONDALE ON HIGHWAY 133 . WATER SUPPLY FOR FIRE PROTECTION OF THE PROPOSED AND EXISTING STRUCTURES (SINGLE FAMILY HOUSES) WILL BE PROVIDED WITH THE WATER CARRIED ON THE FIRE TRUCKS (5,500 GALLONS) .
