Pursusant to C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as
amended, .anal. the. Subdivision Regulations of Garfield .County, Colorado,
adopted April 23, 19$4 Section 2:20.49, •the undersigned__
L respectfully petitions the Board
of County Commissioners of Garfield County, Colorado, to exempt by
Resolution the division of ; ,/,/--acre tract of land into
tracts of

"subdivision" and subdivided land as the terms are used and defined in
C.R.S. (1973) Section 30-28-101 (10) (a) - (d) and the Garfield County
Subdivision Regulations for the reasons stated below:

SUBMITTAL REQUIREMENTS:
An application which satisfies the review criteria must be submitted with
all the following information.
A. Sketch map at a minimum scale of 1"=200' showing the legal
description of the property, dimension and area of all lots or
separate interests to be created, access to a public
right-of-way, and any proposed easements for drainage,
irrigation, access or utilities;
y/g. Vicinity map at a minimum scale of 1"-2000' showing the general
topographic and geographic relation of the proposed exemption to
the surrounding area within two (2) miles, for which a copy of
U.S.G.S. quadrangle map may be used.
Copy of the deed showing ownership by the applicant, or a letter
from the property owner(s) if other than the applicant; and
Names and addresses of owners of record of land immediately
adjoining and within 200 feet of the proposed exemption, mineral
owners and lessees of mineral owners of record of the property to
be exempted, and tenants of any structure proposed for
conversion; and
----- E Evidence of the soil types and characteristics of each type; and
2 F Proof of legal and adequate source of domestic water for each lot
created, method of sewage disposal, and letter of approval of
fire protection plan from appropriate fire district; and
- G. If connection to a community or municipal water or sewer system
is proposed, a letter from the governing body stating a
willingness to serve; and

It shall be demonstrated that the parcel existed as described on
January 1, 1973 or the parcel as it exists presently is one of

10C -Potts loam, 3 to 6 percent slopes. This deep, well drained,
moderately sloping soil is on mesas, benches and valley sideslopes.
It formed in eolian materials on alluvium from sandstone, shale or
basalt. Elevation ranges from 5,000 to 7,000 feet. The average
annual precipitation is about 14 inches, the average annual air
temperature is about 46 degrees F., and the average frost -free period
is about 120 days.
Typically, the surface layer is brown loam about 4 inches thick.
The subsoil is reddish brown light clay loam about 24 inches thick.
The substratum is pinkish white loam extending to a depth of more
than 60 inches.
Included with this soil in mapping are small areas of Olney,
Kim and Ildefonso soils which make up 10 to 15 percent of the mapping
unit. These soils have slopes of 3 to 6 percent.
Permeability of the Potts soil is moderate. Effective rooting
depth is 60 inches or more. Available water capacity is high. Sur-
face runoff is slow and the erosion hazard is moderate.
This soil is used mainly for irrigated crops and hay, and for
dryland farming. Alfalfa, small grains, and grass -legume hay are
grown. Small areas of this soil are also used for livestock grazing.
Flooding is the usual method of applying irrigation water.
Conservation practices that include irrigation ditch drop structures,

grass waterways, and minimum tillage are necessary to avoid serious
erosion losses. These soils pipe easily, and irrigation water manage-
ment is extremely important in avoiding excessive piping. Cover crops
or stubble mulching in dryland farming areas will also help to limit
erosion losses.
The native vegetation on this soil is mainly bluebunch wheat -
grass, western wheatgrass, needleandthread, and big sagebrush.
When the range condition deteriorates, forbs and woody
shrubs increase. When the range is in poor condition, undesirable
weeds and annual plants are numerous. Proper grazing management
maintains and improves range condition. A reduction in brush im-
proves deteriorated range sites. Seeding is a good practice if the
range is in poor condition. Suitable plants for seeding are crested
wheatgrass, western wheatgrass, and Russian wildrye. For successful
seedings, a good practice is to prepare a seedbed and drill the seed.
Wildlife using this soil for habitat include pheasant, mourning
dove, cottontail rabbit, some mule deer, and squirrel.
Potts soil has good potential for community and recreational
development The main limitations for these uses are strength, piping,
and frost -heave. Dwellings and roads design can be designed to compen-
sate for these limitations. Community sewage systems are needed if
the population density increases. Capabilty subclass IIIe.

described tract "A" from the above described 7 acre tract is hereby
exempted from such definitions and said tract may he divided into tract
"A" all as is more fully descr;hed above, and said divided tract may be
conveyed in the form of such smaller tracts without further compliance with
the aforesaid su'_,division statutes and regulations; provided, however,
that this exemption is granted on'the condition and with the express under-
standing and agreement of the Petitioners that no further exemptions be

Dear Mr. Hall:
Enclosed is a request for a S.B. 35 Exemption for Fred A. Johnson. The
request is to divide a five + acre parcel into a three + acre parcel and a
two acre parcel. The property is located approximately 1 1/4 mile east of
Rifle. You may recall the Estes exemption request (letter sent from your
Department on 9/12/84). Mr. Johnson is the other part owner of the spring
rights refered to in the Estes Exemption request. Mr. Johnson's nouse
sits on the existing five acre tract (the proposed three acre tract) and
is served by the spring. The City of Rifle has agreed to extend their
water services to Mr. Johnson's house. However, the City will not commit
a water tap to the proposed two acre tract until it is developed. Mr.
Johnson cannot sell the two acres until the exemption is approved by the
County and the County cannot approve the exemption until there is an
adequate water supply.
Do you feel it is feasible for Mr. Johnson to transfer his water rights
(spring) to the two acre parcel until such time it is built upon and can
receive city water or could the two acre lot receive an individual well
permit?
I have scheduled this request before the Board of County Commissioners for
December 10th. I would appreciate any comments before that time if
possible.
If you have any questions, please do not hesitate to contact me. I know
this one is somewhat confusing.

We have reviewed the above referenced application to split five acres
into a two and three acre tract. One tract is presently served by an adjudi-
cated spring. The City of Rifle has also agreed to serve the existing tract.
The applicant would also like to serve the second tract with Rifle water but
he is unsure of the availability of water from this source.
The proposed alternate source of water for the new tract is a spring or
household use only well. The water right for the spring is junior and subject
to being called out. For this reason, we do not consider the spring a reli-
able source of water.
Our office could issue a household use only permit for the second tract.
Based on this, we can recommend approval of this exemption request if this
type of well is acceptable to the applicant.
