Johnson LOCATION: Section 10, T6S R93W; located approximately 1 1/4 miles east of downtown Rifle off County Rd. 294 SITE DATA: WATER: SEWER: ACCESS: EXISTING ZONING: ADJACENT ZONING: Tne site is approximately 5 acres in size and is proposed to be divided into two tracts of approximately 2 acres and 3 acres eacn. RELATIONSHIP TO THE COMPREHENSIVE PLAN The site sits within District A - The Rifle Urban Area of Influence. II. DESCRIPTION OF THE PROPOSAL A. Site Description: The site sits to the south side of County Rd. 294. It currently contains an access road and an older nome. The original parcel also contains the Jehovah's Witnesses Church. B. Project Description: The applicant wishes to divide a 5 acre parcel into two parcels of 2 acres and 3 acres each. The 2 acre parcel would be sold as a homesite. Tne 3 acre parcel would be maintained tor the applicant's existing nome. History: Tne applicant purcnased two separate 10 acre parcels in 1948 as part of a tax sale. Mr Jonnson sold one 10 acre parcel to the Estes family in 1978. In 1981, Mr. Johnson split a 2 acre parcel off of they aining 10 acre parcel to create a church site. Also, in 118, Mr. Jonnson sold the adjacent neignbor to the west, 3 acres in a boundary line adjustment leaving the existing 5 acre parcel. III.MAJOR ISSUES AND CONCERNS 1. The City of Rifle will not guarantee the 2 acre parcel water until a need nas been demonstrated. 2. The proposed parcels meet the acreage requirements for the A/R/RD zone district. 3. The proposed parcels are across County Road 294 from the Hignland subdivision wnich contains an average lot size ot 9000 square feet. 4. 19 lots smaller than 5 acres have been created by 21 exemptions granted in tne immediate area of the proposal. IV. SUGGESTED FINDINGS 1. That the meeting before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at tnat meeting. 2. That the proposed lot size will be compatible with existing lot sizes in the immediate area. 3. That for the above stated and other reasons, the proposed zoning is in the best interest ot the nealtn, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. V. RECOMMENDATION APPROVAL, with the following conditions: 1. That the applicants obtain an adequate source of water for the 2 acre parcel prior to final approval. 2. That a plat be prepared to be recorded in the Clerk and Recorder's office. This plat shall be submitted to the Planning section prior to final approval. The plat shall include tne following: A. A signature block tor the County Surveyor and a signature block for the Chairman of the Board of Commissioners. B. The plat snail show all easements, including access, ditch, utility and waterline easements. C. The plat shall make reference to the Resolution Number of approval for the exemption. D. Separate legal descriptions tor each parcel. 3. A written legal description of eacn lot including all easements. 4. A two hundred dollar ($200.00) School Impact fee be paid to the County prior to final approval. 5. That the applicants have 120 days from tne date ot conditional approval to meet all conditions. 6. That the applicant receive, if necessary, a driveway access permit from tne County Road department. vkl /D- 110/8f"
