(1973) Section 30-28-101 (10) (a) -(d) as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted September 1, 1972 and amended April 14, 1975, Section 1.02.17 (d) and 3.02.01 the undersigned r-spectfully petitions the Board of County Commissioners of Garfield County, Colorado, to exempt by resolution the division of 4F,5acre tract of land into, tracts of approximately j` (42,5,-.5 acres each, more or less, and which tract to be subdivided is more particularly described as follows: (legal description - attach separate sheet if additional space is required) ,16 from the definitions of "subdivision" and "subdivision land" as the terms are used and defined in C.R.S. The developers propose to use wells for the water supply which would intercept ground water tributary to the Colorado River at a point where there is still water available for appropriation. Johnson and Goldie Johnson submit this Request For Sketch Plan Review And Exemption of a proposed division of property located in Garfield County which would result in the creation of two tracts of land, each of which would be less than 35 acres and Petitions the Board to exempt the division of these tracts from the provision of the Garfield County Subdivision Regulations, otherwise pertaining. In support of this request, the Petitioners state as follows: 1. Petitioners Fred A. Johnson and Goldie Johnson are the owners in fee of a parcel of land situate in the W2SE4 Section 10, Township 6 South, Range 93 West of the 6th P.M. comprising 28.478 acres, more or less. This parcel is designated subject parcel on the vicinity map submitted herewith. 2. It is the intention of the Petitioners, Fred A. Johnson and Goldie Johnson to divide the subject property into two parcels, one of which would contain 23.5 acres, more or less and would be retained by the Petitioners, Fred A, Johnson and Goldie Johnson, for single family residential, the other parcel would comprise approximately five acres and is intended for sale to the Petitioner, First Baptist Church of Rifle, for use as a site for a church. 3. The respective legal descriptions of the two tracts proposed for division are annexed hereto as Exhibits B and C. 4. The Petitioners are unable to proceed with the division and sale of the two tracts without the permission of the Board of County Commissioners. 5. The proposed source of domestic water for the church to be constructed by the Petitioner First Baptist • • Church of Rifle is either a well or water from the City of Rifle municipal supply, a storage tank for which is located one-third mile from the subject properties. The Petitioner First Baptist Church would utilize an individual sewage treatment system situated on the tract and to be in compliance with Garfield County and State regulations. 6. Access to the tracts to be subdividied is via County Road 294 which forms the northerly boundary line of each of the properties. The current zoning of the subject properties is A/R/RD. Single family residential use is permissible in this zone and the proposed use of the site for a church would be a conditional use under this zone. 7. The proposed development is not inconsistent with the natural topography, soil drainage and other physical charactaristics of the subject property. 8. The division of the property requested is not part of a larger existing or proposed subdivision of land. 9. Upon conveyance of the five acre parcel to the Petitioner First Baptist Church of Rifle, a copy of the deed of conveyance will be filed with this request and a resolution of exemption, if granted.
