The City of Rifle responded to the Gilbert Exemption request in a fashion that came as quite a shock to the
Planning Department. In his letter Selby Myers, City Manager of Rifle stated that city water was not
obtainable outside the city and that City of Rifle was not in receipt of a Petition of Annexation for the
Gilbert property. In a letter from your office, dated October 30, 2000, you stated that you intended to file
for annexation and would be sending me a copy of this as soon as practical. To date I have not received a
copy of this Annexation application. With the Exemption application, for a water source, it was stated that
domestic water is expected to be received from the City of Rifle, should that be unavailable the applicants
would apply for a multi -family well permit.
At this time, there is no water to source for the proposed lot. It is critical that there be a source of water
"proved up" for the Board of County Commissioners to approve this application. Therefore, the Planning
Department recommends removal of this application from the scheduled Board of County Commissioners
meeting on 1/15/2001.

The exemption is being requested to offer for sale a 4.84 acre parcel adjacent to
Highway 13, Rifle, Colorado. This land is not being used by the Gilbert family and
the family would like to offer this parcel for sale.
Concurrent with this filing, an application for annexation is being filed with the
City of Rifle.
Domestic water is expected to be received from the City of Rifle, pending the
annexation application. If the annexation application is withdrawn or denied, an
application for a multi family well permit, supported by a plan for adjudication of
the existing well will be filed.
Sewage disposal is expected to be received from the City of Rifle, pending the
annexation application. If the annexation application is withdrawn or denied, an
approved septic system will be required.

In re: The Gilbert Exemption
Dear Mr. Butler:
I confess a lack of knowledge regarding the procedure whereby Colorado counties
achieve subdivision, so I cannot comment upon that matter.
In reviewing the application by Jim and Jackie Gilbert, it was mentioned that they
intended to obtain water from the City of Rifle. I am unaware of any arrangement that
the Gilberts currently have with the City. In order to obtain water, it is customary that a
landowner must first apply for annexation and agree to abide by the development
procedures of the City. To this date, the Gilberts have not done so.
The City has no other comments.
