BEFORE THE BOARD OF COUNTY COMMISSIONERS OF
GARFIELD COUNTY, COLORADO
PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) Section 30-28-lOl(a)-(d) as amended, and
the Subdivision Regulations of Garfield County, Colorado, adopted
September 1, 1972, and as thereafter amended, the undersigned Kenneth K.
Kuhns, Sr. and Opal K. Kuhns, respectfully petitions the Board of County
Commissioners of Garfield County, Colorado, to exempt by resolution the
division of that certain tract of land containing forty (40) acres, more
or less, and described as the NE~NE~, Section 33, Township 6 South,
Range 92 West of the Sixth P.M., in Garfield County, Colorado, into
three (3) tracts containing approximately ten (10) acres, fifteen (15)
acres and fifteen (15) acres respectively, from the definitions of
"subdivision" and "subdivided land" as the terms are used and defined in
C.R.S. (1973) Section 30-28-lOl(a)-(d) and the Garfield County Sub-
division Regulations for the following reasons:
1. The petitioners desire to convey said ten (10) acre parcel to
their daughter.
2. The requested exemption results in lots of a size which are
consistent with other parcels in the general area and are in conformity
with the county's land use planning goals .
In support of this petition, the petitioners also submit the
following:
(a) Map drawn to scale showing proposed lot subdivision and
access.
(b) Copy of deed by which petitioners acquired subject parcel.
(c) Vicinity map.
(d) The domestic water for the proposed three (3) lots will be
supplied by a domestic well drilled pursuant to permit #113066

Your request for an extension of time to construct your well has been reviewed .
You ar: ereby given pot ice that an extension of one year to March 4, 1983
has een approved by'the State Engineer and a copy of the amended permit is
enc sed. , please be advised that additional extensions might not be
approved.
Once the permanent pump is installed, a perm a nent pump installation report and
permanent pump test data report must be submitted to our office. In -order to
properly complete registration of the above well, you must submit the enclosed
Statement of Beneficial Use .

This is to confirm our recent visit in which you advised me that
the Kuhns ' Exemption request has been tabled until the County has had an
opportunity to conduct a hearing and formulate its position regarding
the division of forty acre tracts in the area south of Silt. You
indicated that you would advise me of any scheduled hearing for this
purpose so that my clients and I would have an opportunity to attend. I
will look forward to hearing from you in this regard and hope that
fol l owing a review of this situation, the Commissioners can proceed to a
favorable consideration of the Kuhns' Exemption request.
Thank you for your cooperation and assistance in this regard. My
apologies again for not being able to attend the prior hearing of this
matter on August 16.

We have received the above referenced exemption proposal. The proposal is
to serve 3 houses from domestic well permit number 113066. We have reviewed the
permit for this well and found that there is no condition preventing the pro-
posed use.
So far as we know, the well has not yet been constructed. No information
was submitted concerning the expected yield of the well. If wells in the area
are not consistently adequate in performance, a well test may be advised.
We can recommend approval of this proposal upon the condition that a provi-
sion for joint ownership of the well would be contained in the plat and deeds
and any necessary easements be carried on the plat. Covenants should provide
for operation and maintenance responsibilities.

We reviewed information submitted concerning the above referenced pro-
posal to share well number 113066. Our review of the well permit indicates
this well was issued as the only well on 35 acres as a domestic well. The
well could legally serve two dwellings.
Information submitted describes a well test. The statement indicates an
expected yield of 0.6 to 0.8 gpm from the well. We cannot conduct a full
evaluation of the well test as drawdown-time data is not given and the pumping
rate varied.
We do not have a definite criteria fo r the yield required for each resi-
dence. Even with the best well test certifying the indicated yield, we would
have to question if the well was adequate from a practical standpoint. No
statement is made concerning water requirements; however, even if water use is
restricted to in-house use only (which we would certainly recommend), the
water requirements for a single-family dwelling would be approximately 300
gallons per day (0.21 gallons per minute). A higher number of peop l e or addi-
tional water requirements can add significan tly to this figure. As can be
seen, the accuracy of the well test, the water use in each of the units, the
capacity, quality, and reliability of the pump and storage tank, and inter-
ference from development of other wells in the vicinity are all factors which
would destroy any margin for error which mi ght exist.
While the well could legally be shared, we would not recommend approval
of a proposal to share the well which would result in a separate tract or a

rental. Also, we would suggest that water quality be given consideration at
this location.

Ken Kuhns has asked that I request the Commissioners to reconsider
the requirement that he pay the $1,000.00 Silt bridge fee in light of the
brief time during which the fee was imposed. I am accordingly scheduled to
appear before the Commissioners to discuss this matter on Monday, March 26,
1984, at 11:45 a.m. It is my understanding that the County Surveyor cur-
rently has the subdivision exemption pla t which has been filed pursuant to
the Commissioners' resolution approving the exemption. I would request that
you allow Ken to defer payment of the fee until we have had a n opportunity
to discuss t his matter with the Commissioners on the 26th. In the meantime,
can you permit Ken to proceed with the filing of the exemption plat and the
payment of other required fees? Please give me your thoughts in this
regard.
