HomeMy WebLinkAbout2.0 BOCC Staff Report 09.10.1990s • BOCC 9/10/90 PROJECT INFORMATION AND STAFF COMMENTS REQUEST: Exemption from the Definition of Subdivision APPLICANT: Robert Gillespie LOCATION: A portion of Lot 14 in Section 18, Township 7 South, Range 87 West of the 6th Principal Meridian; located on the east side of C.R.100 opposite the intersection with C.R. 103 approximately 3.5 miles north of Highway 82. SITE DATA: The site consists of 8 acres. WATER: Existing and proposed wells. SEWER: Individual Sewage Disposal Systems. ACCESS: Existing driveway off C.R. 100. EXISTING AND ADJACENT ZONING: A/R/RD I. RELATIONSHIP TO THE COMPREHENSIVE PLAN The site is located in District B, Subdivision/Rural Serviceable Areas, Minor Environmental Constraints, as designated on the Comprehensive Plan Management District's map. II. DESCRIPTION OF THE PROPOSAL A. Site Description: The site is located in a rural portion of the County with adjacent land uses consisting of primarily single family residential, agricultural and open space. The site is currently developed with a single family residence. B. Project Description: The applicant is proposing to divide the 8 acre tract into two (2) parcels of approximately four (4) acres each. The improvements would be located on the western most lot. (See exhibits on pages/-.) C. History: Deeds submitted by the applicant indicate that the tract has existed in its current configuration since prior to January 1, 1973. III. MAJOR ISSUES AND CONCERNS 1) The purpose of the proposed exemption is to create a new lot which the applicants would exchange with the owners of an adjacent lot. (See map on page -1 ,) The rationale for the trade is to provide privacy for their residence and to acquire ownership of the access road to the residence, currently an ingress/egress easement. The adjacent lot was a portion of the recently approved Tomasetti Exemption. • • 2) Soil Conservation Service information on the site indicates that the soils are poorly suited to homesite development due to large stones and slopes. 3) The newly created lot would be served by an extension of the existing driveway. 4) The existing residence is served by a well. 5) The application has been referred to the State Division of Water Resources with no written comments received at this time. Verbal response from the Division of Water Resources indicates that there should be no major obstacles in obtaining a well permit. Written verification from the Division that a new well permit will be issued for the new parcel should be provided prior to approval of the exemption plat. IV. SUGGESTED FINDINGS 1. That proper posting and public notice was provided as required by law for the meeting before the Board of County Commissioners. 2. That the meeting before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted, and that all interested parties were heard at that meeting. 3. That for the above stated and other reasons, the proposed exemption is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. RECOMIqNDATION�fcv�5 ArToo404,1 -54tp; ��- 1) That all representations of the applicant, either in the application or stated at the public meeting, shall be considered conditions of approval unless otherwise approved by the Board of County Commissioners. 2) That the applicants shall have 120 days to obtain approval of the plat. The applicants may request extensions of 6 months not to exceed 1 year from the original date of approval. 3) The applicant shall submit $200 in School Impact fees for the newly created lot. 4) Forest Service and State Forestry Wildfire Prevention Guidelines shall be implemented in the development of the proposed lot and homesite. 5) The following notes shall be included on the exemption plat: 6 A. An engineered foundation and wastewater system shall be required. B. A soils report prepared by a professional engineer shall be required as a prerequisite to a Building Permit application.
