F'--'o .... r .... d,__ ____________ , County Attorney ~M~il...,.d=-re...,d'"-'-'A"""'ls ..... d..,..o'-'-r.__f ____________ , Clerk of the Board _C~hu~c~k~D_e~sc~h~e=n~es~-----------' County Administrator when the following proceedings, among others were had and done, to-wit: RESOLUTION NO. 94-083 A RESOLUTION CONCERNING APPROVAL FOR A SUBDIVISION EXEMPTION FROM THE GARFIELD COUNTY SUBDIVISION REGULATIONS FOR ESTER and KAZIMIERZ KOZAK, NATHAN AND ALINA KING, AND ROBERT KOZAK. WHEREAS, ESTER AND KAZIMIERZ KOZAK, ETC. (Kozak Exemption) petitioned the Board of County Commissioners of Garfield County, Colorado, for an exemption from the definition of the terms "subdivision" and "subdivided land" under C.R.S. 1973, 30-28-101 (10) (a)-( d), as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted April 23, 1984, Section 8:00 through 8:60 and for the division of a 40.351 acre tract as described in Book 356, Page 299 as filed in the Offices of the Clerk and Recorder of Garfield County, Colorado, into four parcels of approximately 13 .67, 13.67, 8.05 and 4.70 acres each, more or less , which the proposed tracts more practically described as follows: Tract 1: See Attached Tract 2: See Attached Tract 3: See Attached Tract 4: See Attached (in the State of Colorado and the County of Garfield); and ( location of septic tanks will be permitted by the Colorado Department of Health, that the requested division is not part of an existing or larger development an d does not fall within the general purposes and intent of the Subdivision Regulations of the State o f Colorado and the County of Garfidd, and should, therefore, be exe mpted from the definition or the te rm s "subdivision" a nd "s ubdivided land" as set forth in C.R.S. 1973, 30-28 -101 (10) (a)-(d), as amended; WHEREAS , on January 10, 1994, the Garfield County Board of County Commissioners conditionally approved the proposed exemption, with the following s pecific conditions included in the approval, required to be satisfied prior to the signing of an exemption pl a t: 1. That all representations of the applicant, either within the application or stated at the meeting before the Board of County Commiss ioners, shall be considered conditions of approval. 2. A Final Exemption Plat will be submitted, indicating t he legal desc ription of the property, dimension and area of all proposed lots or separate interests to be created, access to a public right-of-way, and any proposed easements for setbacks, drainage, irrigation, access or utilities . 3. That the applicant shall have 120 day s to present a plat to the Commiss ioners for signature from the date the Garfield County District Court enters final judgement finding and declaring that Lot 12 of the Elk Creek development may be legally used to provide vehicular access to Lots One, Two a nd Three, should the Final Exemption Plat specify and depict Lot 12 as providing access to lots shown on the plat. Extensions of time, not to exceed 120 days may be granted, if requested prior to the expiration date. 4. That the applicant submit $200 in School Impact Fees for the creation of each new lot. 5. Driveway permits, if necessary, shall be obta ined from the Road and Bridge Department prior to the issuance of a building permit. 6. Control of noxious weeds is the responsi bility of the property owner. 7. The following plat notes shall be included on the final plat: 1. Soil conditions on the site may require engineered foundation s and septic systems. 2. A supplemental setback for lots I, 2 and 3 prohibits the placement of any fencing, landscaping or other structure within 10 feet of the recorded easement to the water tank. 8. Prior to the signing of a Final Exemption Plat, the applicant shall have an engineer or geologist, licensed in the State of Colorado, identify building envelopes on Lots 2 and 3. These envelopes, either in the form of buildable or unbuildable areas, shall appear on the plat. .. (C) If Lo t 12 of the Elk Creek Deve lo pm e nt is use d to provide access to th e exempt ion parce ls, an access eas eme nt will need to appear on Lot 12 a nd a ppro pri a te ag reeme nt s rec o rded with th e Co un t y pri or to signi n g of a Final Ex emption Pl a t. Ho weve r , if Lo t 12 of the Elk Creek Deve lopme nt is t o be used to access the exemption lot s, th e requirements o f Condition 10 must be fir st satis fied and that the owners of Lot 12 must execute and record the appropri a te documents granting vehicular acces s easements through Lot 12 to the owners of Lot One, Two and Three of the exemption parcels. (D) Apparent conflicts with specific calls between the proposed exemption plat and the Elk Creek Development plat shall be addressed by the applicant's surveyor. 10. Prior to Count y review and approval of a Final Exemption Plat depicting and specifying that acces s to Lots One, Two and Three, shall be provided through Lot 12 of the Elk Creek Development the applicant shall submit written documentation , acceptable to the Garfield County Attorney, that a final judgement has been obtained from the Garfield County District Court declaring that Lot 12 o f the Elk Creek Development m a y be legally used to provide vehicular acce ss to Lots One , Two and Three of the Kozak Exemption. If such documentation is not provided when the Final Exemption Pl a t is submitted for County review and appro va l acc ess to the exemption pa rcels depicted on the Final Exemption Plat shall be obtained directly from an existing public right-of-- way. 11. U.S .F.S . Fire Protection Guidelines, as described in Wildfire Safe ty Guidelin es for Rural Homeowners, (Colorado State Forest Service) s hall be followed in the construction and placement of all struc tures within the exemption plat. NOW THEREFORE, BEITRESOLVED tha t th e divi s ion of th e above de scribed parcels"A", "B", "C", arid "D" from the above described 40 .351 acre tract is hereby conditionally exempted from such def mitions and may be conveyed in the form of such parcel s, as is more fully de scribed above and that a copy of the instrument or in struments of conveyance when record e d shall be filed with the final exemption plat.
