WHEREAS, ERNEST and CAROL GIANINETTI have petitioned the Board of County
Commissioners of Garfield County, Colorado, for an exemption under C.R.S. (1973)
Section 30-28-101 (10) (a) - (d) as amended, and the Subdivision Regulations of
Garfield County, Colorado, adopted September 1, 1972 and amended April 14, 1975,
Sections 1.02.17 (d) and 3.02.01, for the division of a 155.25 acre tract into
two (2) tracts of approximately two (2) acres and one hundred fifty-three (153)
acres, more or less, and more particularly described as follows:
Part of Lot 17, Section 28, Lot 11, Section 27, Lots 1
and 8, Section 23, Lots 4 and 5, Section 34, Township
7 South, Range 88 West, 6th P.M., approximately 155.25
acres.
WHEREAS, the Petitioners have shown to the satisfaction of the Board of
County Commissioners of Garfield County, Colorado, that they desire said
exemption for the purpose of re -sale into single-family residential acreage; and
WHEREAS, the Petitioners have demonstrated to the satisfaction of the
Board that there is a reasonable probability of locating domestic water on each
of said tracts, that there is adequate ingress and egress to said tracts, that
the location of septic tanks will be permitted by the Colorado Department of
Health, that the requested division is in accordance with the general purposes
and intent of the Subdivision Regulations of the State of Colorado and the County
of Garfield, and that said division will actually restrict the density of housing
within said area and should therefore, be exempted from the definition of the
terms "subdivision" and "subdivided land" as set forth in C.R.S. (1973) Section
30-28-101 (10) (a) - (d) as amended;
NOW THEREFORE, upon motion of r (cam 1/'e h e f ri 5C- seconded by
LrrL Ue,(�, ��2 and carried, said two (2) acre tract of land is
hereby exempted from such definition and transfer of said tract may be made by
division into two (2) tracts of two (2) and one hundred fifty-three (153) acres,
more or less, and further that a proper legal description will be prepared prior
to conveyance of any tract as is more fully described above. A copy of the
instrument or instruments of conveyance when recorded, shall be filed with this
Resolution.

PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) Section 30-28-101(10)(a) - (d) as amended,
and the Subdivision Regulations of Garfield County, Colorado, adopted
September 1, 1972 and amended April 14, 1975, Sections 1.02.17(d) and
3.02.01, the undersigned ERNEST AND CAROL GIANINETTI
respectfully petitions the Board of County Commissioners of Garfield
County, Colorado, to exempt by resolution 2 acres out of the
ranch tract 1
more fully hereinafter described, from the definitions of "subdivision"
and "subdivision land" as the terms are used and defined in C.R.S. (1973)
Section 30-28-101(a) - (d) and the Garfield County Subdivision Regulations,
for the reasons stated below: For a new ranch home, old home will
be used for ranch hand or one of the children.
Water, via present well located by old house (see map) well pumps
in access 100 gals per min.
