DANIELSON State Engineer APR 12 1982 aim We have received your request to again review the Krausch Exemption. This office issued one household use only well on the tract subsequent to our previous review. We are now being asked to consider a second household use only well. Mr. Krausch currently has an application before the Water Court (Case No. 81CW286) which would provide the necessary water supply if approved. In our previous letter, we indicated that we could not comment on the avail- ability of a domestic well permit until the Water Court had made its decision. Had this proposal originally been submitted with a request for two house- hold use only wells, we could not have recommended approval since we would have considered the cumulative effect of the two additional wells. Events that have occurred since our original review would not seem to alter our com- ments regarding this proposal. In light of the available information, we would have to continue our previous recommendation. We could not recommend approval of the residential portion at this time since a need for water for two residences would be created. However, we have no objection to separation of the park area since no addition- al need for water supply would be created. Also, we would not object to a land split after a suitable Water Court decree has been issued. This proposal would permit Mr. Krausch to separate 12 acres from a 24 -acre tract so that he may donate it to the Town of Carbondale. The remaining 12 acres is planned for residential use. This office has no objection to Mr. Krausch donating 12 acres to the park. The park will not require a well, therefore, we can recommend approval of this part of the proposal. We cannot recommend approval of the residential portion of this proposal at this time. The remaining 12 acres is apparently intended for two residential units according to the application to the Basalt Water Conservancy District. The applicant is seeking a domestic well pursuant to a water court filing for the well and a complimentary filing to allow the well to be used as an alter- nate point of diversion for the Conservancy District water. This office cannot commit to the availability of a permit until the court has made its decision as to whether it will issue a decree and the contract with the Water Conservancy District has been finalized. In summary, we have no objection to separation of the 12 acres from the original tract for purposes of creating a park. This recommendation is made on the basis that the park will not require a well. It should be stated that the separation of this parkland would not effect the availability of a well on the remaining 12 acres. It is possible the applicants can obtain a permit for a domestic well upon approval of their court filings. We would have no objec- tion to approval of a land use strategy which was in accordance with a court approved well permit. Please let us know if you have any questions.
