NOV 10 198 f3 nK 559 P.►.r,E 528 < 1:15 MILDRED ALSDORF, RECORDER RES0LUTI ON tt7S-`5'3 WHEREAS, ARTUR and ELFRIEDE KUEN have petitioned the Board of County Commissioners of Garfield County, Colorado, for an exemption under C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted September 1, 1972 and amended April 14, 1975, Sections 1.02.17(d) and 3.02.01, for the division of a 6.5. acre tract of land into two tracts of 2.5 and 4 acres, more or less, and said 6.5 acre tract of land is more particularly described as follows: A tract of land situated in Lots 4 and 18 of Section 31, Township 7 South, Range 87 West of the Sixth Principal Meridian, lying Southerly of the Northerly line of said Section 3i and Northerly of the Northerly right-of-way line of State Highway No. 82, said tract of land being described as follows: Beginning at a point on the Northerly line o4. said Section 31, whence a rock -corner found in place and properly marked for the Northwest corner of said Section 31 bears: S. 89° 55' 23" W. 869.14 feet; thence N. 89° 55' 23" E. 423.00 feet along the Northerly line of said Section 31, thence South 707.60 feet to a point on the Northerly right-of-way line of said Highway; thence N. 79° 51' 12" W. 429.72 feet along the Northerly right-of-way line of said Highway; thence North 631.33 feet to a point on the Northerly line of said Section 31, the point.of beginning. WHEREAS, the Petitioners have demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that they desire said exemption for the purpose of re -sale into single-family residential acreage; and, WHEREAS, the Petitioners have demonstrated to the satisfaction of the Board of County Commissioners that there is a reasonable probability of locating domestic water on each of said tracts, that there is adequate ingress and egress to said tracts, that the location of soptic tanks will be permitted by the Colorado Department of Health, that the requested division is in accordance with the general purposes and intent of the Subdivision Regulations of the State of Colorado and the County of Garfield and should, therefore, be exempted from the definition of the terms "subdivision" and "subdivided land" as set forth in C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as amended; BOOK 559 PATE 529 NOW THEREFORE, upon motion of laves �.eri5e seconded by _ C . j11) I/c__i and carried, said 6.5 acre tract of land is I hereby exempted from such definition and transfer of said tract may be made by division into two tracts of 2.5 and 4 acres, more or less, all as is more fully described above, and further, that said exemption is conditioned upon the Petitioners obtaining a proper legal description of said tracts prior to any conveyance thereof.
